The President is the Head of the State. In a republic it is a privilege granted by an election. That privilege can be withdrawn and it has been withdrawn in some countries. Thabo was a case in point.

A government has three components; the State or the Executive, the Legislature and the Judiciary.

The 5th Phase President is clearly ignorant of these separations of powers and his view is - he is tops over everybody, false. His public statements are evident of his view.

We need an intelligent lawyer to bring up a case of contempt of the Constitution. I am not a reader of law but I assume this is a possibility. The President has made recorded statements that can be used as evidence of contempt of the legislature and or the Judiciary. It wont be too difficult to generate this evidence.

What saddens me is the extent to which these views extend to weakening of institutions in both the state, in Judiciary and in the Legislature. This is even more damaging and will severely hurt sustainability of Tanzania as a country in good and sound governance.

As of now we have no governance at all - ni uhuni mtupu.

My suggestion is for the Judiciary to handle the Makonda Case, of course via a private legal avenue. We have good lawyers, dont we?
