I think we have not had a freer judiciary since the new constitution came to effect... anyone who is going to insinuate that the govt forced or directed the judge to jail doctors is not interested in truth (the govt mistake was that it supported the decision instead of bieng the bigger man and seek more dialog, or atleast look like you trying)

the court jailed them, and the appeal court freeid then 24hrs later, No one should blame or insult the judiciary for anything, they are an independent institution

The subject that I was discussing was about the powers of the court to stop and induatrial action here, and that no one should blame rhe judiciary........ the same law that gives any union right to strike is the same law that gives the court right to stop a strike and contempt any leader of the strike who defies that order... that is the law...
On Mutea Iringo, again, you cannot blame tge court, as far as we are concerened, the courts did issue arrest warrants for the PS without fear or favour didnt they? So should we blame the judiciary or the police? once again, I say the judiciary is not to blame

With a persistent doctors’ strike in Kenya and their union leaders jailed for contempt, a user created a fake post implying that the American surgeon, who has performed life-saving operations in Africa, was chiding the Kenyan government.
“Came across sad news from Kenya. Their judiciary jails doctors. Such a pathetic government,” the supposed tweet read.
A screenshot of the tweet, spread by many users under hashtag [HASHTAG]#AsystemIsComingDown[/HASHTAG], showed it had been written and posted on Monday by Dr Carson’s verified account, @RealBenCarson.
For many Kenyans on Twitter, especially the medics angry at the government for jailing their union leaders, it seemed that one of their own had felt their predicament.
FAKE NEWS PHENOMENON
An examination of the post, however, reveals that it is fake as it does not exist on Dr Carson’s account.
The last message on his Twitter page was posted on New Year’s Day.
In fact, as a nominee for a Cabinet post, the use of the word "pathetic" to describe another government was unlikely from a man who will have to deal with foreign entities, especially governments keen to learn about US housing policies.
But as the tweets started to fizzle, some users started to acknowledge the tweet wasn’t genuine and alerted others that it was not legit.

you are confusing two things here, the right for the unions to demand what ever they demand, and to do it under the law..... If you look at history of strikes even doctors strike in kenya, you will find very few times the unions defied court orders when they were issued, they might have dared them but at the end of the day something always happened before the deadline to warrant the courts to make hood their threats....

the courts dont usually stop anyone union from strike, but they do have the powers to declare a strike illegal in certain circumstances for one reason or another, and when they declair a strike illegal, the union heads are supposed to order their workers back to work, then the union can argue their case on why the strike is warranted, and if they provebtheir case (like negotiations have completely failed) the court can then legalise the strike and thusprotect all the workers from any harm from their employers.........

The industrial court has most of the time legalised strikes when the govt tried to argue otherwise in the past so this is not a one sided thing from the judiciary

did the so called Judiciary even raise a finger to condemn such a reckless act? ...Your guess is as good as mine. There
other myriad examples that litter the Kenyan landscape that could go along to show you that the Kenya Judiciary as
a whole is not independent but makes decisions after calculating the reaction from the executive. Only a few individuals
can stand up to the impunity that comes from Statehouse.
