The arrest of Blogger Robert Alai on monday, for allegedly posting a gory picture of Kenyan fallen soldiers, has received wide condemnation by a section of social media users.

Alai was apprehended on Monday morning and taken to the Directorate of Criminal Investigations (DCI) on Kiambu Road for interrogation.

Alai, who has now been transferred to the Anti-terrorism unit, was arrested following a Monday warning by the National Police Service (NPS) after he took issue with how the government handled policemen killed in Wajir on Saturday.

“As we mourn our fallen heroes, posting of their pictures online by one blogger is very unfortunate, inhuman, glorifies terror and is tantamount to supporting terrorism. This is indeed the lowest we can go. We condemn this act in the strongest terms possible,” said Police Spokesperson Charles Owino in a statement.

Eight soldiers died after their vehicle ran over an Improvised Explosive Device (IED) planted by Al Shabaab militants.

The Police and the National Cohesion and Integration Commission (NICC) issued statements saying Alai’s acts glorified acts of terrorism.

Taking to Twitter moments after Alai was arrested and driven to DCI headquarters for questioning, tweeps faulted the government for arresting Alai, further calling for his immediate release using the hashtag #FreeAlai.

According to some, Alai posted a picture, which was taken by one of the police officers handling the bodies of the dead policemen, hence, didn’t deserve to be arrested.

Some said the blogger was just informing the public how the government treats men and women in uniform – with zero dignity.

However, there are some who felt the blogger didn’t do the right thing and deserved to be behind bars.

Any person who, without authorization from the National Police Service, broadcasts any information which undermines investigations or security operations relating to terrorism commits an offence and is liable on conviction to a term of imprisonment for a term not exceeding three years or to a fine not exceeding five million shillings, or both.
(2)
A person who publishes or broadcasts photographs of victims of a terrorist attack without the consent of the National Police Service and of the victim commits an offence and is liable on conviction to a term of imprisonment for a period not exceed three years or to a fine of five million shillings, or both.

The law penalizes ONLY IF THE PHOTOS etc, relates or concerns of the "VICTIM".

Then question is, who is the victim (majeruhi) in law?. Is a died person a victim capable to give consent?

You are just beating around the bush. Like most lawyers.
Alai broadcast gory photos without anyone's permission. He was arrested based on this and other related laws.

It is him to go to court and argue his case out. The judge will rule who is right between him and the prosecutor.
 
It is not a good civilization to publish photos of the deceased without the consent of their relative or respective authorities. Let's preserve our fallen soldier's dignity. For now, i can't blame the authority but my worries are if he is gonna get there in good shape, physically and physiologically

A civil rights activist in Nairobi also died a few months ago, while procuring an abortion. Every activist came out to demonstrate, until a postmortem overseen by her family confirmed the abortion story.

If the government was killing opposition like yours does, an unknown catholic priest from Kisumu would not even make the list. There are many other fatter targets.
