Did you intend to marry the cow, magistrate quips
A casual labourer who engaged in an unnatural act with a neighbour's cow has been jailed for 14 years. Jackson Githaiga Kiruga, 35, was found guilty of having carnal knowledge with the animal on July 24.
Senior Principal Magistrate Wendy Kagendo on Wednesday said the prosecution's five witnesses had produced enough evidence against Kiruga. She said he deserves the maximum sentence of 14 years.
Kagendo said Kiruga wanted to change his plea from not guilty to guilty but she decided that the court should proceed with the hearing since the offence was serious.
Kiruga told the court that he was too drunk before he found himself mounting the cow. The owner of the cow, Ann Wanjiru, said she woke up at 5amon July 24 and warmed up some water for milking the cow. Since it was still dark she carried a torch to the cowshed only to find Kiruga having intercourse with her cow.
Wanjiru said Kiruga whose trousers were halfway down was too engrossed in the that he did not notice her prescence until she raised the alarm.
The evidence brought to court included a pair of trousers, a jumper and a marvin which he was wearing. They were smeared with dung and the cow's hair. The veterinary officer who examined the cow, Douglas Munge, said the the cow's private parts had human hair, He said they were also swollen and had bruises.
Kiruga said he should be pardoned because he had taken too long to marry. He said his father had just passed away and his mother needs him to help her manage their coffee farm.
Kagendo said this request was "interesting". "The accused mitigation is interesting. He says that he has been late to marry and I wonder if he intended to marry the cow," she said.
She therefore handed the accused 14 year's sentence behind bars. "The court cannot fathom why the accused person had to do such an act to an animal."
