The Senate Friday night impeached Embu Governor Martin Wambora after a committee found him guilty of three of the five charges levelled against him.

But the Senators found no evidence to sack his deputy Dorothy Nditi, clearing the path for her to become Kenya’s first female governor.

The committee found Mr Wambora, a former provincial administrator, guilty of violating public procurement and public finance management laws as well as the Constitution.

Baringo Senator was the only one who voted no to the charges while Embu Senator Lenny Kivuti abstained from voting altogether. Wambora was found guilty of three of the five allegations levelled against him which include violation of the procurement and disposal act 2005, violation of the public finance management act 2012 and violation of the constitution. Embu Deputy Governor Dorothy Nditi will serve for remainder of the term as per the constitution and she becomes the 1st woman governor in Kenya.

  • The governor was accused breaching the Public Procurement and Disposal Act 2005 and Regulations 2013, the Public Finance and Management Act and the Constitution.
  • The committee ruled that the big issue was on who was responsible for the mess; the governor as the County Assembly had decided or other officers in the county.
  • Dr Khalwale said witnesses that the governor brought to testify on his behalf turned against him, and instead gave evidence to implicate the Mr Wambora more. Even the auditor general confirmed the accusations.

This sets a bad precedent. Arm-twisting governors will slow the the country's plan on devolution.

Only temporarily, eventually he will go down but at least it should teach the various arms of government to respect court orders, how many times have te executive rescinded a decision on the strength of a court order?
