A boda boda operator in Embu town was on Tuesday sentenced to 10 years in prison after he was found guilty of raping a client.
Principal Magistrate Samuel Mutai ruled that the prosecution had proved the case against Robert Kariuki Gatitu beyond reasonable doubt.
Gatitu was charged that on September 18, 2016, at Kangaru Village, he raped a woman whom he had ferried to her destination.
He also faced additional charge of indecent act by touching the genitals of the said woman without her will.
The court found him guilty of rape after the prosecution produced four witnesses with corroborating evidence.
The court also heard that on the material day, the complainer was invited by a friend for a meet-up in Embu, after which she reportedly rode on the accused’s motorbike where he raped her before speeding off, leaving her in a bush.
The woman is said to have arrived home late that evening and narrated the ordeal to her husband who is also boda boda operator in the area.
Her husband then visited Embu Police Station where he reported the matter and was able to identify the accused as they ferry passengers from one area of operation.
The Magistrate, while delivering his judgement, stated that the prosecution had been able to prove its case that the accused committed the offence.
He also added that since the accused was a first-time offender, he would spend 10 years in jail in order to deter such behaviour from anyone else with similar intentions.
