Five-judge bench to determine Uhuru, Ruto eligibility

The High Court of KENYA HAS JUST RULED AS FOLLOWS:-

1) It has no jurisdiction to determine the case. According to Kenyan Constitution that jurisdiction lies with the Supreme Court of Kenya pertaining to the eligibility of presidential elections.

2) The High Court of Kenya can not interfere with powers of the executive to determine the petition as such dispute was to be originally lodged and determined by the IEBC. To their knowledge-read the high Court-, the petitioners had not filed their complaints with IEBC, and hence the judicial process can not be invoked.

3) The petition was speculative and presumptuous and the Court has no power to speculate and determine on abstract issues raised in the petition.

4) Only the trial court the ICC has the power to debar Uhuruto from running for presidency but not courts which are not involved in determining the criminal charges that they are facing.

5) Petitioners "kwa kiherehere chao" wanatakiwa kuwalipa gharama za kesi AG, IEBC, Uhuru na Ruto..............................

ofisi ya serikali wakati
wanatuhumiwa kwa
kesi za uhalifu. Hali ambayo mashirika

kwenda kinyume na
katiba ya nchi. Mahakama ilikuwa
iangalie iwapo Uhuru
na Ruto

jukumu la kuiongoza nchi, wakati
wanatuhumiwa kwa

zilizoshuhudiwa Kenya
baada ya uchaguzi
mkuu wa mwaka 2007, katika mahakama ya
uhalifu ICC, mjini Hague
Uholanzi. Uamuzi huu umetolewa
baada ya hapo jana
kuwepo kikao cha
mahakama hiyo ya
uhalifu ICC, kukagua hali
ya kesi hiyo inayowakabili wawili
hao. Kesi hiyo
iliyowasilishwa na
mashirika yasiyo ya
kiserikali inaendelea
katika mahakama kuu
mjini Nairobi na inatarajiwa kutoa
uamuzi iwapo
mahakama ina uwezo
wa kutoa uamuzi juu ya
wawili hao au iwapo
itahitaji usaidizi wa mahakama ya juu
nchini kufikia uamuzi

ya uchaguzi mkuu wa
mwaka 2007.

Huyu Uhuru naona ana influence kubwa ,mahakama imesem haina mamlaka ya kutoa maamuzi juu ya kesi ya Uhuru na Ruto eti kwa kuwa wameshapitishwa kugombea uraisi na tume ya uchaguzi,nayo tume ilisema haina haki ya kuwazuia Uhuru na Ruto kwa kuwa mahakama haijatoa maamuzi ya kuwazuia Uhuru na Ruto,kesi yenyewe imengoja mpaka wapitishwe na tume ndio mahakama itoe hukumu,ukweli ni kuwa hawa jamaa wana hatia lakini wametumia hila mahakama na tume zijichelewesha mpaka jamaa watumie hivyo vifungo vya sheria vya kusema mahakama haina mamlaka kutoa hayo maamuzi,swali kama ilikuwa haina mamlaka sasa ilikaa nini kusikiliza ikijua haina mamlaka na ikijua ikizidi kuchelewa umamulaka wake hautakuwepo sababu tume ya uchaguzi itakuwa imeiwapitisha kugombea uraisi na umakamu raisi,na hapo ndio maana wazungu na wapenda haki wanasema kesi za hawa vigogo haziwezi kuendeshwa na mahakama za hapo Kenya.hapo ndipo ICC inapozidi kupata uhali wa kuwashtaki hawa watu,jamaa wapo tayari kuwatisha mashahidi ,ukiangalia hata Ruto kesi zake za kuuza viwanja zinajulikanika kabisa kuwa anawatisha mashaidi na hushinda kesi kwa kuwa ''mashahidi wamejitoa au hawaji mahakamani'' hao ndio raisi na makamu raisi watarajiwa wa Kenya lol kazi ipo

Court ruling on Uhuru, Ruto case to be challenged

NAIROBI; KENYA: The battle to stop Jubilee Alliance luminaries Uhuru Kenyatta and William Ruto from running for the top offices could now head to the Supreme Court.

One of the petitioners in the cases thrown out by the High Court on Friday said they were taking the challenge and would take the integrity petition to the top most court.

Mr Ndung'u Wainaina the executive director of International Center for Policy and Conflict (ICPC), who were petitioners in the four cases, said in a statement that they would also challenge orders issued on Friday to pay costs of the suits to those they had sued.

"For sure, we are ready for Supreme Court engagement. The Court was categorical the jurisdiction lies with Supreme Court," Ndungu said.

But lawyers involved in the cases argued that taking the matter further to the Supreme Court could be an uphill task that could heavily interfere with the March 4, General Election.

The Supreme Court has recently gazette rules on how disputes arising from the nomination of presidential candidates by the IEBC and those arising from the actual election should filed in court, heard and determined.

But using the rules to challenge the nomination of a presidential candidate will be a challenge for any petitioner. Under the timelines set out in the rules, the period between filing a petition and determining it could be anything beyond three weeks.

Filing papers in such a petition alone will cost you over Sh500,000 as filing fees which is a figure set in the rules. In addition the petitioner must deposit Sh1 million as security to be paid to the other parties in the event that he or she loses the case.

The rules set establish how the papers should be filed, served on the respective parties and how the court should organise and hold a housekeeping pre-trial conference before the actual hearing of the petition and determination.

The printing of presidential ballots will already be completed by the time the case is determined and changing them could cost the tax payers a great deal.
Ndung'u said the new constitution had been enacted to serve the country and had to be tested.

He said it was strange that even after that ruling judges went ahead to make adverse inference on the issues in the cases.

"To make matters worse, they issued costs orders contrary to principles governing costs in public interest litigations," he added saying he was preparing for battle at the Supreme Court.

I agree with u let the ICC set them free then they will try their luck and participate in the next election after hon raila finishes two tenure as presindent of URK
 
What the high court has done is good by upholding its integrity as non-partisan in controversies surrounding elections and candidates. Can you imagine if it would openly declare uhuruto were ineligible? if they declared that, it could have been the agent that innocuously handed raila the presidency on a silver platter. they really understood and differentiated well their JURISCITION, and that of the IEBC's.
