Kenya: Governors have differed with President Uhuru Kenyatta’s remarks during his State of the Nation address that his government has fully devolved functions as per the Constitution.


“The President in his speech talked of his support for devolution yet in action, the central government is still stuck with some of these functions such as roads,” said Council of Governors (COG) chairman Isaac Ruto.

They censured the Jubilee administration over failure to fully devolve functions to counties and allocation of 14.7 per cent of the internal generated revenue. This has been the basis for their push for a referendum to increase the percentage to 45.

President Kenyatta said his government had increased county allocation from the stipulated 15 per cent to 32 per cent.

The county bosses criticised the proposed vertical distribution of national raised resources based on shareable revenue amounting to Sh1.026 trillion, of which the National Assembly Budget committee proposed Sh217.87 billion. The National Government is supposed to retain Sh808.44 billion, including Rural Electrification Authority and Sh3.5 billion Equalisation Fund.

Governors Evans Kidero (Nairobi) and William Kabogo (Kaimbu) noted that Sh217.87 billion proposed as counties equitable share, which translates to 32 per cent of the 2011/2012 audited resources is not satisfactory.

“In the last allocation, counties received 14.7 per cent of the national revenue contrary to the Government’s argument that it was 23 per cent,” said Dr Kidero.

He also noted some functions devolved to counties are still with the National Government, including staff. “What we want is at least a minimum of Sh238 billion up from the Sh190 billion equitable allocation for last year,” said Kabogo.

National allocation

Wajir Governor Ahmed Abdullahi Mohammed explained that the fund should exclude level five hospitals and donor grants, which amounted to Sh20 billion in the Division of Revenue Allocation 2013/2014.

“There is the cost of administration, devolved functions and pensions. All these need money to execute. It is a danger if counties are starved of funds,” warned Kidero, who is also the vice chair of COG.

He explained that national allocation should also be based on population, poverty index and area instead of only the share between the two levels of governments.

The governors argued that functions under various ministries such as Roads, Environment, Devolution, Agriculture, Health, Energy, and Mining among others are yet to be devolved.


According to Ruto who is also the Bomet Governor, the National Government is also plotting to return health services to Nairobi following a report tabled in the National Assembly that seeks to rescind the devolution of health services until proper systems are put in place.

“Energy is fully devolved, some aspects of agriculture, which include irrigation are still with the National Government,” noted Ruto.

The county chiefs have noted that attempts by the Government to interfere with the devolution conference in Kwale is an indicator that it is not committed to support devolution, contrary to President Kenyatta’s continuous pledge.

But yesterday, Transport and Infrastructure Cabinet Secretary Michael Kamau told off the governors over the roads issue, stating that he will not engage them in the media. He said they should instead go to his office if they have any complaints. “Who has prevented governors from constructing roads in their areas,” he questioned.

Senate report

However, Senate devolution chairman Kipchumba Murkomen has insisted that all functions have been devolved to counties as stipulated in law.

“We have devolved all the functions and the Senate report will be tabled in the House next week,” said Murkomen, in defence of the President, adding: “The allocation will go with all the functions.”

The law assigns functions of roads to both governments with the National Government being in charge of national trunk roads while counties will administer all other roads referred to as county roads.

Transition Authority Chairman Kinuthia Wamwangi when contacted by The Standard on phone, confirmed that not all functions have been devolved.

PRESIDENT Uhuru Kenyatta and Deputy President William Ruto have come under sharp criticism from governors for an alleged plot to sabotage their meeting in Kwale this week. The governors said Uhuru and Ruto have been encouraging Jubilee MCAs to boycott the meeting.

The Council of Governors has convened a meeting for all governors, their deputies, county assembly speakers and ward representatives to review their year in office.

On Saturday, Uhuru met some county leaders at State House, where well-placed sources said he assured them that his government is “committed to devolution and there is no need to attend the Kwale meeting”.

The late afternoon meeting was attended by nine MCAs and nine members of Executive Committee of the County Forum led by vice-chair Susan Kihika of Nakuru county and secretary general Albert Kochei who is Elgeyo Marakwet speaker.

“We understand the intention was to dissuade them from attending the conference. The President and his deputy are on course to fight devolution,” Council of Governors chairman Isaac Rutto said.

Rutto accused Uhuru and Ruto of trying to create a rift between governors and MCAs.

However, Speakers Forum chairman Abdi Nuhu yesterday denied that State House instructed them not to attend the governors' meeting but confirmed the meeting with the President took place.

He said they talked with the President only on “how to strengthen devolution". Nuhu defended the MCAs from accusations that they are being used to fight governors. He said Uhuru had asked them to cooperate with the national government to tame rogue governors embezzling public funds.

“We had fruitful deliberations on how to run devolution. Whether we were instructed to attend or not to attend the Kwale meeting is a non-issue. The President and his deputy are above such petty gossip. We talked majorly on how we can effectively play our oversight role on the governors,” Nuhu said.

He said MCAs are at liberty to attend the three-day meeting that is expected to be officially opened by the Deputy President.

“Us in Tana River county will not be attending as we have important agenda. To set the record straight we are yet to get formal invitation. We cannot be invited through newspapers; we are an institution,” Nuhu said.

Elgeyo Marakwet Senator Kipchumba Murkomen defended Uhuru and Ruto saying they are "officials of national government and have no power over the MCAs". He accused the council of governors of being an institution of "competition and confrontation" instead of "consultation and cooperation". "MCAs are intelligent enough to know what is good for them. Rutto's assertions are an insult to the honourable MCAs," he said.

At the same time three Governors from Western have faulted the government for the planned boycott. Busia Governor Sospeter Ojaamong, Bungoma's Kenneth Lusaka and Kakamega's Wycliffe Oparanya said there are indications that Uhuru and Ruto will not honour their invitation.

Speaking during the first regional meeting on devolution at Masinde Muliro University of Science and Technology in Kakamega on Saturday, the governors said the meeting is vital if devolution is to be realised.

"Uhuru has been avoiding us for meetings. Bishops need to pray for our leaders to open their hearts to enable them come on board," they said.

Ojaamong said he wondered how the President and his deputy could skip a meeting which aims to ignite discussions around devolution and why it must work.

“We are concerned on the behind the scenes manoeuvers to have MCAs across the country brought back to the government. The same agents of the national government are also trying to have deputy governors swayed in that direction and yet we work in one office," Ojaamong said.

Oparanya said history has been created during their first year into office with the release of money that had not been received for the combined 50 years of the country's independence. He said despite the government's planned boycott of the three-day conference, they will travel to Kwale as a united force.

“The challenges are with us governors. Do not get fired up as devolution founding fathers. We should soldier on and shrug off outside forces who are trying to scuttle our bid. Devolution is the only gain we achieved in the new constitution," he said, and pledged to sit and make their own decisions.

Lusaka urged the government to be transparent while handling devolution issues instead of always being critical of what the government does. He said devolved system of government was there to stay despite mounting pressure to silence governors' worthwhile course.

The leaders have been accused the government of failing to do enough to support devolution, but the latter has defended itself, saying, it has in fact exceeded constitutional expectations.

Focus will now turn to how the county bosses have performed in their first year in office.

An analysis by the Nation team has established that County Assemblies have passed few Bills since they were inaugurated.

A speaker in one of the counties blamed the Executive for the few Bills passed, saying, governors only forwarded Bills they regard as important for enactment.

LEGISLATIVE PROPOSALS

"Bills originate as legislative proposals from the Executive, which are then published and enacted by the Assembly.

The few proposals are limited to those the Executive feels are important and in most cases, those which result in the generation of more money," the Speaker who sought anonymity said in an interview at the weekend.

For instance, Taita Taveta County has not passed even one Bill - not even its Finance Bill that authorises the county to collect levies from businesses.

Nyeri, Baringo, Narok and Nakuru are among counties that have only passed the Finance and Appropriation Bills, while Nairobi and Turkana are leading after passing seven and six Bills respectively.

Kilifi received the thumbs up after passing a Bill that will pave the way for the establishment of a County Scholarship Fund, but the MCAs took the thunder out of it two weeks ago when they started debating another that will culminate in the banning of miniskirts in the county.

Embu County made history by being the first to impeach the its governor, Mr Martin Wambora and his deputy, Ms Dorothy Nditi. While the Senate upheld the impeachment of Mr Wambora which is now the subject of a court case, Ms Nditi was cleared of any wrong-doing and the court later said she could take over as acting governor.

This also set a precedent as she is now the first woman governor, albeit acting.

The county has passed four Bills, three of which were originated by MCAs.

Nairobi County Assembly topped the list of Bills passed - Seven Bills in seven months.

"We are proud that we have been setting the pace," the Nairobi County Assembly speaker Alex ole Magelo said.

It's a tussle for more allocation, other than mutua what have they done with what they were allocated? Health sector was devolved and the end result is nothing to smile about? Devolve but be very sure the end result is not a step back.

I look at the bigger picture...one year down the line and what had the President done to meet KE's

This was for Kabaridi lakini naona una uchu wa kujibu. My point is not off topic but Im going after the head that is used
to giving people empty pledges...including security matters.

When it gets to the point of MP's getting carjacked at gunpoint, then things have changed for the worse. The other day
the DP's personal assitantt got jacked...then sijui the Presdo's relative also got jacked. These are people with clout
but the thugs aint about that no more....thay just go get em regardless. No security or protection for the elite...walalahoi

When you have a president giving press conferences where we are told the same old same old...then we have a problem.
How many uiltimatums has the man issued since being in office about terrorism? Did you see him after Westgate?

Kenya still gets bombed!!

All that happens when Kenya gets attacked are commisssions and inquiries yet we see nothing coming out of
these set-ups. Taxpayers money goes to waste and the citizenry are at the mercy of thugs. This happens on a
dialy basis mpaka its no longer news to hear a Kenyan has been robbed. Tryng to defend that is absurd!

Hii ya Al-Shabaab kuwekewa mikakati inayofaa ni hadithi za alfu-lela-u-lela. They have been saying that since
the cows went to graze now they are coming back hadithi bado ni ile ile. The Kenya police are notorious for their
choreographed knee jerk reactions in such matters. As usual a bunch of loiteres get arrested, innocent somalis
are victimised, press conferences galore...blah blah blah...then all those arrested are released back into the
streets and we are back to square one!

So when are these mikakati going to be put in place? What about the money laundering by somali pirates in KE..who
is stopping that? How about the immigration guys who hand out Kenyan passports & IDs to somalis? What is being
done about them?..si bado wanachapa wira tu like nothing has happened. How many Kenyans need to die before
somebody gets serious on these matters? You dont have to be a rocket scientist to see that the President of Kenya
and the one before him have failed in the sacred duty of protecting the citizenry period!

Give Kenyans what they deserve.
 
Nakuelewa sasa, when the big shots start being targeted in crime; the levels have escalated. Unlike you who have to rely on media reports to form an opinion, i live within the confines of the republic and i can tell you without battling an eyelid that there has been no upsurge in crime.
We have been there when we had to pay protection money to rival criminal gangs in the name of 'protection' or risk becoming a statistic, we have been there when we could not drive off the compound after nine without witnessing a crime or being a victim of it and it doesn't in any way compare to the present situation just because some influential people have fallen victim.
Its ages since i saw a police chopper in the air pursuing stolen vehicles.

f you believe we are at the mercy of thugs, then in short you are commenting the level of incompetence of the police force in combating crime. In the past legal militia have protected politicians, if these militia evolved into something else and we are under their mercy wewe ndio utatuambia, these things are not automatic unless those that are meant to legally protect you are benefiting from crime!.



let us set facts straight ten years down the line, crime has escalated in kenya to unprecedented levels because. During the kibaki-raila government when grenades were going off in the city, there was a wait and see strategy meaning even then the government was clueless...which has made the egos of alshabaab reach top aided by social networking/tiwtter. If terror is hard fighting in africa it is because of social networking sites like facebook and twiiter controlled by even the *CIA/homeland with the gigantic budget to combat terrorism in the world we will still experience security lapses. The wait and see strategy was wrong in the first place because it has emboldened them. I know of a certain lieutenant who I took an insult from that was on top of his game until west-gate, where he decided to bury his head in the sand...upto that point I advice the grace of God is sufficient in such times.... no man can swear to provide security for all if he's himself a victim of insecurity. Ironically even the police have been victims of insecurity... instead of your legislators using the same mandate to come up with solutions against terrorism and insecurity in the context of fighting corruption how outsiders can come to kenya and quickly get passports citizenship in record hours etc, they are busy arguing who is fit to wear pants and if they have a right to own many wives. Kama tumeshindwa tuwaulize wenzetu wa ujamaa how they do it..how they are able live in peace with their criminal elements some of whom are here heading car-theft racketts.

The national government Wednesday appeared to have pulled out its officials from the governors' conference that starts Thursday.

The strained relations between the leadership of the national and county governments played out on Wednesday at the meeting's venue, Leisure Lodge Resort in Kwale, when it became clear that top officials, among them, Deputy President William Ruto, who was scheduled to close the three-day meeting on Friday afternoon, would not attend.

Others previously listed to address the Coast parley, whose objective is to take stock of the governors' one year in office, are seven Cabinet ministers and a number of senior civil servants.

Indications were that senators listed to address the conference would not turn up.

However, Senate Majority Leader Kithure Kindiki spent the better part of the day Wednesday with the governors and called for more consultation and cooperation between the two levels of government to ensure devolution takes root.

The chairman of the Council of Governors, Mr Isaac Ruto, said that the national government had been involved in its planning. This is why President Kenyatta and his deputy had been scheduled to attend to open and close respectively.

However, Mr Ruto, who is also the governor of Bomet, said that county governments would not be discouraged by the development but would go ahead with the meeting.

"We consulted and arrangements were done jointly with the national government and all the protocols followed.

It is not like no one was aware of this meeting," Mr Ruto said at a meeting of the Kenya Private Sector Alliance (Kepsa), which preceded today's conference.

He said county governments would not allow the national government to lord it over them because doing so was a contravention of the Constitution.

Wednesday, the Nation learnt that some civil servants who were already at Leisure Lodge in readiness for the meeting returned to Nairobi following the uncertainty.

Sources within government indicated that a minister, who was also listed to speak, asked the public servants not to attend.

The governors of this countries are just lazy people who after failing to
start working in their own counties with the little they have,,, are
trying to blame somebody for their failures.


Ask anybody in Kenya,,,they are the most unpopular people,, of all
the politicians of this country.

The president is leading a whole country,,but these governors are
supposed to take care of small areas.

Most of these governors, more than 95% of them,, never fought
to come to the positions,,they enjoy.


They rode on the popularity of their parties,,,that all those areas
where jubilee was popular,,all governors were elected on jubilee
platform,,the same with Cord.

Now after sailing very comfortably to the other side,,people like
Isaac Ruto,,,a person who came through the Jubilee,, has guts
to feel as if he is an equal to the president and the Deputy
president of Kenya,,,people who have fought wars to be
what they are,,when he is just a new born kid.

I do not know my governor,,,the Kajiado county governor,,
i have never seen him just his motorcades some months
ago.


I don't know where are his offices,,,this is another new
born kid who came through the CORD party,,he never
campaigned for his election,,he just got lucky that
his party picked him.

This is the problem we are facing with these people.

That they never campaigned for themselves,,,their
parties did that for them,,through Uhuru Kenyatta
and Raila Odinga.


But next time,,,they will do that for themselves which
will be better,,that after elections they will have the
feelings that it is the people who had brought them to
the positions they enjoy

feel as if,,they are everything.

money for many meetings in expensive places
when the government is fighting them ,,and,,

We don't know what he means by this,,but we support
anything that will make Kenya feel safe.

But here in Ngong,,,we never feel unsafe as is many
parts of Kenya.

And,,also,,bombs are not exploding in Nakuru,,Bungoma,
Machakos,Laikipia,,Lokichoggio, Kisii, Lamu, Narok, Kitui,
Eldama Ravin, Eldoret, Kanjido, Baringo,,,Taita
Taveta, Kisumu and many other parts.

The enemies of Kenya wants to see Kenya burning up,,,but it
is not.

The problem is only in Eastleigh,,,a small part of the,,, Nairobi area
and some churches in Mombasa.


So no curfews in Kenya,,,,,for those speaking of insecurity,,,
as if the whole country is in a big problem,,,,we tell them that
we have not reached there,,

And,,the KDF,,will not leave Somalia till everything there is
free from the hands of Alshabaabs.


The port of Kismayu is free from them,,no more pirates
and abduction of Kenyan security forces,, tourist,,if the
price of this is those stupid home made bombs in
Eastleighs and the killings of worshipers in Mombasa,,,
then,,let us pay it,,,for we will never kneel before
these terrorist.

President, deputy court MCAs in bid to clip governors' powers

The national government is wooing members of county assemblies as it shifts gears in an effort to tame the governors.

The County Assembly Forum (CAF) is preparing to hold a meeting in Nairobi where President Uhuru Kenyatta is expected to announce goodies for the more than 2,000 ward representatives.

The meeting, whose date is yet to be determined, will follow a visit by the forum's executive committee members to State House last week.

"That was a good-intentioned visit to thank the President for gracing our retreat in Mombasa. As the executive committee of the CAF, we had been mandated by our members in Mombasa to make a follow-up on his pledges of a car grant and mortgage," Bogichora County Ward Representative Beauttah Omanga told the Sunday Nation.

The meeting at State House last week preceded the governors' forum, also held in Mombasa, to which the national government gave a wide berth.

At the State House meeting, President Uhuru Kenyatta and CAF executive members are said to have negotiated for money to buy cars.

The MCAs are demanding Sh2 million car grants which the President reportedly warned was a massive allocation that could raise public anger given that he has been seeking to slash salaries and allowances. The President further informed the MCAs that the money had not been budgeted for.

"The President told us he will consult the Salaries and Remuneration Commission and inform us of the outcome at the next meeting in Nairobi," Mr Omanga said.

But the President's courting of the MCAs, while appearing to create a bridge between the national government and the governors, has not gone done well with the county bosses.

According to Bomet Governor Isaac Ruto, the President's meeting with MCAs is meant to undermine the county chiefs.

"There are indicators that the national government is using MCAs to fight governors so that we get pre-occupied with sideshows instead of implementing devolution. One would wonder why the President would want to meet the MCAs. It is in total disregard of the law," Mr Ruto, the chairman of the Council of Governors, said.

But Mr Omanga said MCAs were out to act in the best interest of the people rather than be used as pawns.

"We are independent as MCAs. We will not be pocketed to do dirty work for any one. Unlike our predecessors, the councillors, MCAs are not people to be manipulated," the Bogichora ward representative said.

President Kenyatta wants to woo the MCAs who he believes have the power to tilt the balance in an election and could even send the governors home. The President is also said to be wary of a possible plan by the governors to front one of their own to run against him in the 2017 General Election and wants to trim their influence.

The accusations come as governors said they will soon move to the Supreme Court to compel the national government to respect the Constitution and devolve all functions as outlined in the supreme law.

The governors have warned they will push for a national referendum to have more resources be devolved to the counties.

The reaction comes after it emerged that State House had distanced itself from the planning of the governors' conference early last month.

In a correspondence between the Council of Governors and State House seen by Sunday Nation, the latter said it would not participate in the engagement.

"Regrettably, we could not participate in the meeting of March, 4 because your letter reached my office on March, 11, a week later. I will, however, inform the President about the conference and in particular the proposal to have him officially open it," a letter from Chief of Staff and Head of Public Service Joseph Kinyua reads. Instead, State House nominated two senior officers to follow up on the conference.

"I have nominated Hon Mohamed Abdikadir, Senior Advisor, Legislative and Constitutional Affairs and Dr Mbui Wagacha, Economic Advisor, both in the Executive Office of the President to, as necessary, follow up on the conference," part of the letter from Kinyua reads. The letter was copied to Deputy President William Ruto.

Governor Ruto accused both President Kenyatta and his deputy of plotting to kill devolution. He said the governors had read mischief in the absence of President Kenyatta at the opening of the conference and that he was not committed to the event from the word go, the meeting with MCAs notwithstanding.

Mr Ruto accused the DP of traversing the country inciting the public to have total disregard of devolution. He said there were even plans to throw him out as Council of Governors chairman as a way of killing devolution and scuttling their efforts to push for more resources.

"I will not be cowed into silence; I will soldier on and will fight for the survival of devolution tooth and nail," Ruto told the Sunday Nation.

He noted that the President and his deputy are slowly but steadily using different avenues to confront governors.

"They are now using MCAs, the Ethics and Anti-Corruption Commission and even the Auditor General to micro-manage counties," said Mr Ruto. He added the governors will call for a referendum to rally Kenyans to making the national government devolve more funds to the counties.

"It is sad that everywhere the Deputy President goes, he is busy talking ill about governors and dismissing them for their incompetence when he is supposed to oversee matters of the national government," Ruto said.

According to the governors, the recent performance by the Cabinet secretaries to give their scorecards was a publicity gimmick to hoodwink the public that the government it is working when in essence it is not.

"Why did it have to come now? Their one year in office ends April 29. They could have waited until then before trying to confuse the public at a time when governors want to literally give their score cards," he said.

He dismissed contentions by President Kenyatta that over 32 per cent of national resources have been devolved, saying that is a warped calculation based on the 2010/11 revenues that doesn't make sense.

President Kenyatta accused governors of misusing resources on their recent conference that came barely two weeks after the MCAs held a similar meeting.

The governors are also reeling from the shock of losing the privilege of flying small national flags on their cars after the National Assembly passed a Bill they believe was orchestrated by the national government.
