Vita dhidi ya ufisadi vimeshika kasi, kufikia sasa wote waliowasilisha maombi kwa ajili ya uwenyekiti wa taasisi ya kupigana na ufisadi ya EACC, hakuna aliyekidhi vigezo, wamepigwa chini wote 68.
Tume inayowasailisha inafuatilia vigezo kwa umakini sana, natumai sio kiini macho. Lazima uwe msafi kama pamba, ujuzi na elimu ndio ufaulu kukalia hicho kiti.

Japo cha kuridhisha ni kwamba sio rais anayeteua na kuajiri, shughuli zote siku hizi zinaongozwa na taasisi huru kwa mujibu wa katiba mpya. Utawala wa sheria ndio nguzo yetu.

The Public Service Commission (PSC) on Friday announced that it will advertise afresh the vacancy of chairman of the anti-corruption agency after failing to get qualified applicants.

In a statement, PSC chairman Margaret Kobia said the commission had received 68 applications when the deadline expired on September 28.

“On scrutiny of the applications and shortlisting, the commission did not find adequate qualified applicants to proceed to the next stage of interviews,” Prof Kobia said in the statement.

She said the commission will re-advertise the position of Ethics and Anti-Corruption Commission (EACC) chairman next week.

She advised those who had applied earlier not to reapply.

According to the PSC, the requirements for appointment as EACC chairman are a degree from a university recognised in Kenya, over 15 years experience in any of the following fields: ethics, law, public administration leadership, social studies, accounting, fraud investigations, public relations, media, religious studies or audit.

The applicants also need to meet the requirements of Chapter 6 of the Constitution.

The position became vacant after Philip Kinisu, who had held the job for less than a year, bowed to pressure and resigned over allegations that a company linked to his family had business dealings with the scandal-plagued National Youth Service.

Hizo ni sarakasi zenye hazina maana. Vita dhidi ya ufisadi yafaa itoke kwenye Rais mwenyewe. Haya mengine yote ni upuuzi wa kutufumba macho. Mambo ya Rais kuja kutuambia kuwa ohh katiba inasema kuwe na tume huru ya kupigana na ufisadi ni njia tu ya kupata excuse.

Wakati Waiguru alikuwa akiiba hela, Rais alikuwa wapi? Ikiwa hawezi chunga shilingi bilioni ishirini na tano na kila siku akopa hela huku na kule, kazi yake ni ipi?
 

Kwenye hilo la Waiguru na NYS kwa kweli lilinifanya nimtoe maksi rais Uhuru, hana ubavu kabisa wa kuangalia ufisadi kwa macho na kufanya maamuzi magumu. Yeye kama rais lazima ana timu yake ya kukusanya intelijensia, alifaa kuwa wa kwanza kugundua huo ufisadi na kuwapiga chini. Leo hii jamaa wanapeta tu, kila nikiwaona kwenye TV hao mafisadi wa NYS nahisi kichefuchefu. Halafu baadhi ya Wakenya tuna laana ya kiaina, leo hii huyo Waiguru anataka kuwa gavana na atapewa kura na mijitu ya kule kijijini.

Ndio mimi hadi leo huwa siamini sana maneno matupu ya wanasiasa, wote hata wale wa upinzani ni wanafiki watupu. Huwa sina imani na yeyote kati yao, na ndio maana ukiangalia sana ninaomba tuwe na taasisi huru zenye uwezo wa kupigana dhidi ya ufisadi bila kutegemea mihemko au maamuzi ya wanasiasa.

Usidanganywe na mtu kwamba kuna mwanasiasa mwenye uwezo wa kupigana na ufisadi moja kwa moja, maana wanakua kama wafungwa fulani kwenye jela. Hayo mafisadi ndio yana uwezo ndani ya nchi.
Hata kule Bongo Magufuli kaja kwa kishindo cha kushutikiza shtukiza watendaji wa nyanja za chini kwenye ofisi zao, lakini ukifuata taarifa za Bongo, ameshindwa kugusa samaki wakubwa walioifilisi na wanaoendelea kuitafuna nchi, hebu fuatilia huu uzi hapa Tanzania tumechezewa mno na tumeibiwa mno
 

Wewe endelea kujipa moyo tu, Magufuli amemaliza ufisadi mkubwa na mdogo. Hamna mtu anayethubutu kufanya ufisadi chini ya kiongozi shupavu Magufuli. Huyo Anne Waiguru angekuwa Tanzania angekuwa jela siku nyingi.
Historia ya utendaji kazi wa Magufuli inaeleweka sio ya huyo mla mirungi wenu.
 

Labda nitakua nipo nyuma sana kwa taarifa za Bongo, naomba nitajie nyangumi yeyote mithili ya Waiguru aliyetiwa jela na Magufuli kufikia sasa, nini cha mno zaidi ya matamko na mikwara. Magufuli alianza vizuri kwa vitisho na ubabaishaji hadi nikawa na imani kwa mwanasiasa kwa mara ya kwanza, kisha nikafuatilia sakata ya Lugumi ili nione kama kweli Magu ana ubavu wa kupigana na samaki wakubwa, lakini wapi hadi sasa.

Yapo mengi tu, angalia hata ule wa IPTL, vinara waliokua wakiitetea IPTL leo hii bado wanapeta ndani ya serikali ya Magu. Sijataja yale ya MV

Ni vigumu kupigana na ufisadi kwa mihemko, nyangumi zinakaa na kukondoa macho wakati unafuata fuata samaki wadogo. Kidogo Kenya yangu nimeipa hongera maana leo hii kuna mawaziri wanne wamepigwa chini kwa ajili ya kutuhumiwa ufisadi. Japo sio sana kwa juhudi za rais Uhuru, bali taasisi za kupigana na ufisadi. Lakini haitoshi, nataka kuwaskia wakinyea debe kule magerezani.

Nitajie hata ufisadi mmoja hapo juu uliofanyika wakati Magufuli yupo madarakani? Kesi ya IPTL ipo mahakamani hiyo, mikataba ya ovyo ilisainiwa wakati wa serikali nyingine na mingine sio rahisi kuivunja sababu za kisheria.
Taasisi zote zilizokuwa zinasifika kwa rushwa sasa hivi zimenyooka.

Magufuli namsifia kwa kuonyesha nia ya kupambana na ufisadi, lakini hadi afanye maamuzi magumu ya kumtia jela kiongozi fisadi yeyote mkubwa awe alifanya ufisadi mwaka jana ama leo, bado hajaridhisha, atabaki kuongea ongea na kuwafuata watendaji wadogo na kuwacha hayo manyangumi yakipeta.

Kwa suala la kupigana na ufisadi hapa Kenya sitegemei mwanasiasa yeyote afanye chochote cha muhimu, hata huyu rais Uhuru hajaonyesha ubavu wa kupambana. Inabidi nitegemee taasisi huru zilizobuniwa ili zifanye yake, lakini sio wanasiasa maana wao wote ni vigeugeu, leo hii hata hao wa upinzani kila mmoja ana kashfa mgongoni.

Former Eldoret South MP Peris Simam and her husband Enock Kimeli were detained on Friday after they were found guilty of corruption.

This was after they were unable to pay fines amounting to more than Sh10 million as ordered by the court.

Chief magistrate Wanjiku Cherere ordered Simam to pay the fine for 10 counts of corruption, failure of which she will serve 20 years in jail.

The former MP, her husband and four other people faced charges related to economic crimes and abuse of office when she was in office between 2007-2013.

Among the charges against her was influencing the award of a road construction tender to her company - Kachur Holdings.

It was reported that more than Sh4.5 million was illegally paid out to the company.

The former MP and her husband were charged alongside Laban Shachile, Pamella Maluti, John Simiyu and Wisdon Kimutai Maina.

The first count stated that between January 6, 2010 and April 1 in Eldoret, they jointly conspired to commit an offense of economic crime - influencing the award of a tender for the improvement of Bayete-Chuiyat-Bargeiywa road in Eldoret South constituency.

The charge sheet stated that the contract was awarded to Simam's company but that it did not qualify.

The charge further stated that the tender was awarded in contravention of procurement regulations and that Simam worked as a public servant while being director of the company.

The others were employees of the Kenya Rural Roads Authority. They were accused of illegally facilitating payment for the company, causing loss of public funds.

The court found that the road was not repaired and that some documents used by the accused in the case had been falsified.

"As rightfully stated by the prosecution, Kenyans should know that embezzlement of public funds and economic crime and corruption do not pay," Cherere said.

"As a result of actions by the six accused the residents of Eldoret South did not get value for money. The worst part is that the lead player in this game was an MP entrusted to faithfully deal with public funds for the benefit of her constituents, but she failed to do so."

Cherere ordered Simam to pay fines ranging between Sh700,000 to Sh5 million for the various counts she faced.

"The prosecution has proven all the 10 counts beyond reasonable doubt and I find the accused guilty," she ruled.

Deputy director of prosecution Nicholas Mutuku sought maximum sentences for the accused.

Lawyers for the accused said they would appeal against the judgement but Cherere ordered they be detained until Monday.

She will rule then on their application for bond pending their appeal at the High Court.

Top 5 Corruption Cases that Remain Unresolved in Kenya NIJUZE JUU HIZI HAPA NDIO UANZE KUSEMA YA TANZANIA

A recent report by Transparency International on Corruption Perception Index (CPI) ranked Kenya as one of the most corrupt countries in the world.

The country came in at position 139 out of the total 168 countries that were sampled in the study. The struggle to manage and contain the vice in the country, has constantly been slowed down by hurdles with some of the high profile graft cases remaining unresolved over years. Kenyans.co.ke takes a special focus on five of the mega corruption cases Kenya has ever witnessed:

1. Anglo-leasing and related cases

The Anglo-leasing scandal came to light in 2004 during Moi's regime and was carried forward to former President Mwai Kibaki's government. The scam involved high ranking officers, businessmen and companies, who carried out shocking transactions worth billions of shillings.

Former Finance Minister David Mwiraria, Kisii Senator Chris Obure, former PS Joseph Magari, businessman Deepak Kamani are among the individuals accused in a conspiracy to commit economic crimes in the procurement of security equipment worth 40 Million Euros (Sh4.4 Billion), abuse of office and fraudulent acquisition of property.

The Hearing of the case is set to continue between 28th-31st of March 2016 after Mwiraria failed to make a court appearence over illness in February.

2. Tokyo Embassy Property Scam

In 2010, around Sh1.57 Billion was allegedly misappropriated in the purchase of property to house Kenya's embassy in Tokyo, Japan, by the Ministry of Foreign Affairs in the Kibaki government. Former Foreign Affairs Permanent Secretary Thuita Mwangi and two others were accused of involvement in the scandal.

The scam arose after parliamentary investigations established that the Kenyan government, through the Ministry of Foreign Affairs, had rejected a free embassy house offered to them by the Japanese government. It was reported that the ministry instead, withheld around Sh1.6 Billion which was in turn used to purchase another property in Tokyo at a lower value.

The then Minister of Foreign Affairs Moses Wetang'ula was forced to step aside to allow investigations into the matter. The hearing of the case has often been delayed due to difficulty in procuring Tokyo based witnesses.

3. The National Youth Service Scam

This is one of the recent scandals that have emerged in the Jubilee government. The alleged embezzlement, which took place at the Devolution Ministry between December 2014 - April 2015, involves an estimated Sh791 Million.

The saga has since led to the resignation of former Devolution Cabinet Secretary Ann Waiguru. More than 21 state officers were named in the scandal in which public funds disappeared in a grand scheme that also involved former Principal Secretary Peter Mangiti. Other key suspects included business persons Josephine Kabura and Ben Gethi, who were accused of playing major roles in loss of the colossal amount at the National Youth Service.

The case has overtime taken different twists, with the most recent being sparked by an affidavit that was filed by Ms Waiguru. The Waiguru-sworn affidavit dragged into the scam top Jubilee politicians leaving Kenyans wondering how big the scandal was. Sermons have since been issued for March 8th, while fresh hearing is slated for March 22- 24, 2016.

4. Cemetery land Acquisition scam

This graft case involved irregular procurement of cemetery land in Nairobi, where one Sammy Kirui is accused of abuse of office. About Sh283 Million was allegedly lost in the scam. The case is awaiting a last prosecution witness to appear in court between March 22 and 24.

5. The NHIF conspiracy.

The 2012 corruption saga at the National Health Insurance Fund (NHIF) involved a grand conspiracy purportedly executed by one Richard Lang'at and five others, to defraud the insurer of Sh96 Million by entering into a contract to provide medical scheme to civil servants.

The scandal involved payments to ghost clinics and unprocedural selection of clinics. In addition, the case also included a conspiracy to defraud the public insurer and Meridian Clinic Sh126 Million.

Fresh hearing of the case commenced on February 17, 2016.

Former Eldoret South MP Peris Simam and her husband Enock Kimeli were detained on Friday after they were found guilty of corruption.
