Moot Court Scenario for LLB-II
Ally, son of Ramadhan, and Aneth, daughter of Fredrick, are childhood friends. Two years ago, they completed their Bachelor of Laws degree together at Lawyers Only University, a university based in Dar es Salaam, Tanzania. Ally and Aneth had great aspirations in the legal field, referring to each other as the future Director of Public Prosecution (the Future DPP) and the Future Chief Justice (the Future CJ).
In order to achieve their lifetime goals, the two started a joint business with a slogan that read, "Let the Future DPP and Future CJ fight together so that we can get money to support ourselves at the law school of Tanzania in the year 2023." As per the Business License issued by Dar es Salaam City Council, their major activity is the importation of Chemical Products from South Africa.
However, their dream seems to have hit a stumbling block following their arrest for illicit trafficking on 3rd January 2023. Ten days later, they were arraigned before the Resident Magistrates Court of Dar es Salaam at Kisutu, along with Mirza Prakesh, a Palestinian who is said to be the drug lord. According to the police, Ally, Aneth, and Mirza have been importing illicit drugs since 5th December 2022.
After the Public Prosecutor read out the Charge to them, the Resident Magistrate informed them that they were not required to enter any plea, as the said Court has no jurisdiction to try their case. As per the charge sheet, the value of drugs is estimated to be TShs. 2,000,000,000/-. Ally and Aneth are growing frustrated since they are aware that committal proceedings may take up to four years while they rot in jail.
