The disputed Othaya TNA nomination is headed to court after businesswoman Mary Wambui said she was denied the party's ticket despite claiming victory.

Ms Wambui said the TNA certificate was issued to her rival in the primaries, Gichuki Mugambi, after he lodged a complaint with the party's dispute resolution team.


At a news conference at her Lavington home in Nairobi, Ms Wambui blamed powerful forces in government for alleged interference saying the certificate was taken away from her unfairly.

Ms Wambui said she was given an interim certificate on being declared the winner on January 19 and asked to go for the original certificate in Nairobi.

"The people of Othaya spoke, and they chose me and their will should be respected. I even greeted my opponent and we agreed to work together. Unfortunately, I later learnt that he had been given the certificate," she said flanked by her daughter Winnie Wangui.

"There are powerful forces who do not want me to become MP for Othaya and the people have decided."

Ms Wangui said Jimmy Kibaki was among the powerful forces her mother was alluding to.

"Jimmy Kibaki does not work for government so there are other forces working with him to make sure Mama does not get the certificate even though she won,'' she said.

The two appealed to TNA leader and Jubilee presidential candidate Uhuru Kenyatta to intervene saying he has always said that everybody would be given a chance to participate in a free and fair nomination.

Ms Wambui said she would seek the court's intervention but she did not indicate when she intended to make the move.


Mr Mugambi told the Nation he was handed the ticket after successfully lodging a dispute citing massive irregularities during the nominations which saw Ms Wambui declared winner with 13,000 votes against Mr Gichuki's 10,000.

"I received the certificate yesterday (Monday) after my complaints which I had lodged were investigated and addressed,'' Mr Mugambi said.

However, Ms Wambui said she was not called before the dispute board for a hearing.

There has been bitter rivalry between Mr Gichuki, the chair of Othaya Development Association and Ms Wambui since December when President Kibaki's son Jimmy, announced publicly that the latter was his father's preferred candidate.

Yusuf receives TNA certificate in hospital

Former Kamukunji MP Yusuf Hassan was yesterday cleared to defend his seat on a TNA ticket.

Mr Hassan received his nomination certificate at the Aga Khan Hospital, where he is still admitted following the December 7 bomb attack on a mosque in Eastleigh.

He suffered serious injuries on both legs and left arm.

Mr Hassan received his certificate from party chairman Johnson Sakaja.

Nairobi TNA governor candidate Ferdinand Waititu and women's representative Rachel Shebesh were also at the function.

Businesswoman Mary Wambui on Tuesday sensationally led an invasion of the Independent Electoral and Boundaries Commission (IEBC) offices at Annniversary Towers late in the evening.

The aspirant for the Othaya MP's seat had in tow three outgoing MPs - Ms Rachel Shebesh, Cecily Mbarire and Njoroge Baiya.

They staged a sit-in the boardroom for close to three hours, from 9:00pm to midnight, demanding to be addressed by officials of the electoral body.

The three MPs – Githunguri's Njoroge Baiya, Runyenjes' Cecily Mbarire and TNA nominee for women's representative in Nairobi Rachel Shebesh – accompanied Ms Wambui to complain that her name had allegedly been removed from the list of TNA nominees for the Othaya MP seat even after she had been informed by an unnamed source that her name had all along been on the list upto 4:00pm.


"I had confirmed with TNA hq that my name was in the list by 4:00pm, but I later discovered from sources in IEBC that my name had been omitted and the certificate awarded to my opponent," she said.

Ms Shebesh said that IEBC officials should be aware that the there are heavy penalties involved in the Elections Act, which was enacted to curb fraud which had occurred in the last elections.

In the event that any of them is found to have flouted any of these rules, she added, then they would go to jail.


Dozens of supporters of Mr Baiya and Ms Wambui, camped on the 21st floor where the IEBC offices are located and only left after their leaders had issued their last statement.

Earlier efforts to have them vacate government offices were met with resistance as the fiery Ms Shebesh insisted that they first be addressed by an IEBC commissioner.

She said that she and her colleagues had camped at the IEBC offices before midnight so that the matter can be out of their hands in good time and to beat the deadline for handing over the list of nominees to the electoral body.

Earlier, Ms Wambui accused powerful forces in government of blocking her from succeeding President Kibaki as MP for Othaya.

Her daughter, Ms Winnie Wangui, accused Mr Jimmy Kibaki, the President's son, of being among those intent on blocking her mother's election.

The National Alliance reportedly withdrew her nomination following a successful petition by her rival, Mr Gichuki Mugambi.

Mr Mugambi says he has been issued with a nomination certificate after a determination in his favour by the TNA dispute resolution team.


Mr Jimmy Kibaki denied Ms Wangui's allegations, saying that it was not in his character to intimidate people.

"I do not want my name to be dragged into the Othaya nomination dispute... the Othaya people know that it is not and has never been my style to intimidate anyone," he told the Nation.

And in a statement last night, TNA chairman Johnson Sakaja said Ms Wambui won the January 20 nominations and "has not been denied a certificate."However, Mr Mugambi filed an appeal which is still pending, he said, adding that the party's disputes team had reversed the results of seven seats.

The controversial businesswoman said she would seek the intervention of the courts as a last resort.

Mr Mugambi told the Nation on Tuesday that he was given the ticket after successfully lodging a dispute citing massive irregularities during the nominations which saw Ms Wambui declared winner with 13,000 votes against his 10,000.

He said he complained of, among other things, irregularities in the polls, immediately after the controversial and influential businesswoman was announced the winner in the chaotic TNA primaries.

"I received the certificate yesterday (Monday)," Mr Mugambi said, but declined to go into details of the dispute.

Ms Wambui said she was not called before the dispute board for a hearing.

There has been bitter rivalry between Mr Mugambi, the chairman of the Othaya Development Association, and Ms Wambui since December when Jimmy announced publicly that the former was his father's preferred candidate.

TNA secretary-general Onyango Oloo said the party had cleared all complaints and expected to forward them to the electoral commission.

"We have acted on the recommendations of the Disputes Resolution Board which has overturned certain decisions and confirmed others," he said at the Laico Regency.

ODM has also had its fair share of controversy related to the party primaries after Ms Ruth Odhiambo Odinga, the sister of Prime Minister Raila Odinga,
withdrew from the Kisumu gubernatorial race following protests.

Dr Oburu Oginga, another member of the Odinga family, was disqualified alongside his rival for the Siaya governor race.

Business came to a standstill in Kikuyu town yesterday when members of the National Youth Congress demonstrated against last week's nominations results.
Led by the district NYC chairman James Kamau, the youth took to the streets singing slogans against Kimani Ichungwa who won the Kikuyu constituency TNA ticket.

They said Ichungwa manipulated the results in his favour to deny Owen Ndung'u the ticket. Ndung'u on Sunday launched a complain with TNA's election board where he produced video clips showing Ichungwa receiving ballot boxes and papers from the returning officer and ferrying them to different polling stations.

Kamau said they were denied a chance to vote in Friday's nominations. He said they will rally the youth in the district to vote against TNA and to instead support the Cord Alliance in the March 4 elections if the party does not resolve the matter through a repeat of the nominations.

"We love TNA so much and we support Uhuru Kenyatta for the presidency. But since the party seems to be playing games, we shall not vote for it and instead support the Cord Alliance," Kamau said.

The chair said fake ballot papers, which he claimed were black and white in colour instead of red, the dominant TNA colour, were used in the nominations.
He said the nomination was managed by Ichungwa's agents in most of the polling centers. Peter George. a loser in the Sigona county representative nominations, said the ward's residents did not vote because there were no ballot papers.

George demanded for a repeat of the nominations in Kikuyu.

Kimunya awaits TNA tribunal to settle Kipipiri dispute

The fate of Transport Minister, Amos Kimunya still hangs in the balance after TNA Returning Officer in Kipipiri Constituency declined to announce the results of parliamentary aspirants.

This is after a dispute emerged over ballot boxes from Rumwe and Ngatho polling stations, which were intercepted on Friday by supporters of Kimunya's main opponent, Samuel Gichigi.

They were intercepted after the driver of a van ferrying ballot boxes to the tallying centre at Miharati Trading Centre declined to carry party agents.

Police had to intervene by impounding the van and locking the ballot boxes at Engineer Police Station.

By Monday, the ballot boxes were still being held at the police station.

And the TNA Returning Officer in the constituency, Isaac Kung'u said he had handed over the case to the party tribunal to resolve it.

"I cannot determine the winner without the results from the two polling stations since the elections were highly contested," Mr Kung'u had told journalists outside Engineer Police Station on Sunday.

On Monday, he said the matter was still being addressed by the tribunal from Nairobi but the disputing parties are expected at Engineer Police Station later in the day.

Nyandarua South police boss Samson Munyao confiscated the van ferrying the ballot boxes after angry mob who had intercepted it, threatened to lynch the driver and the presiding officer.

And they issued the threat on discovering that the boxes containing names of parliamentary aspirants had been interfered with.

Following the threat Mr Munyao said the driver fled into a bush.

"We are still looking for him so that he can record a statement," the police boss said.

Mr Gichigi who is a Nairobi lawyer and a long-time aide to Mr Kimunya claimed that the two polling stations are his stronghold.

Apart from him and Mr Kimunya, there was also former area MP Mwangi Githiomi who was also trying to secure the TNA ticket to contest the seat.

Since Saturday, Mr Gichigi's supporters have been staging protests outside TNA office in Miharati Trading Centre alleging plans to rig out their candidate.

This is after rumours started circulating that Mr Kimunya had beaten his rival by 81 votes in provisional results.

"I did not release the results and the winner will only be known after results from the two polling stations are released," Mr Kung'u said.

He said after tallying results from 65 polling stations out of 67, there was a difference of less 200 votes and he did not want to say who had won.

Earlier, a group of Mr Gichigi's supporters had been arrested by police on Friday afternoon after they drove their vehicle into Kipipiri Food Factory.

They were chasing another vehicle they claimed was spotted ferrying ballot boxes.

And they were only released on Saturday on a cash bail.

Jubilee alliance presidential candidate Uhuru Kenyatta has asked TNA aspirants who feel their complaints were not addressed through the party's dispute resolution mechanisms to lodge appeals to the Independent Electoral and Boundaries Commission (IEBC).

While apologising for late start of the nomination exercise, Uhuru said there were disputes that arose during TNA primaries especially on official results.
"Even as the vast majority of disputes were resolved amicably through the Party's internal processes, there may be a small number of complainants who would wish to be heard further. There is an avenue for appeal to the IEBC for review of particular nomination results," he said in a statement.

While congratulating winners, Uhuru said TNA elections were conducted well and only seven seats saw reversal of results initially announced.

"I would like to extend my sincere apologies for the inconvenience that our Members and Observers experienced as a result of this. Lessons have been learned and in future we anticipate that we shall run a smooth and flawless exercise, "he said.

He said over 3.7 million voters participated in the nominations exercise.

But the elections, which have been described as a sham, have given other political parties in the region a lifeline, as most of the TNA losers have defected to them.

The move is likely to anger Jubilee presidential aspirant Uhuru Kenyatta, who has rooted for one strong party to represent the region.

One of Uhuru's rallying calls has been for the region to unite so that they can get a majority in both Houses and also control the devolved government.

Parliament

His argument has been that President Kibaki's presidency was affected by his lack of numbers in Parliament, as most of the MPs were elected in different parties.

"We don't want a repeat of 2007 where Kibaki was overwhelmingly voted as president but was denied numbers in Parliament. That is very dangerous," Uhuru had said during his tour of the region.

And with the conclusion of the nominations, Uhuru has to contend with the same headache, as some parties, most of which are supporting his candidature, are fielding candidates in other elective seats.

Sitting on his laurels waiting for the TNA nominations outcome was Mwangi Kiunjuri's Grand National Union (GNU) and Kiraitu Murungi-led Alliance Party of Kenya (APK).

Already, GNU and APK have lined up candidates to contest for various seats in the General Election.

Leading the pack is Kiraitu, who will vie for the Meru senator seat while assistant minister Peter Munya is the APK governor candidate for the county.

From the onset, there was confusion in TNA nominations, which were pushed forward by a day following the delay in the delivery of election materials.

So Ab-titchaz, this signals that odinga will not win elections in the first round, neither will uhuru. The second round will ultimately give us the winner. So the smaller parties still remain relevant in canvassing support for second round.

Businesswoman Mary Wambui has finally clinched The National Alliance (TNA) ticket for Othaya constituency after a protracted dispute.

TNA said Wednesday it had reached the decision to hand Ms Wambui the ticket after the party's dispute resolution mechanism determined she had defeated her rival Gichuki Mugambi.

"On the Othaya matter, after carefully considering all the evidence adduced before it by both the challenger and Ms Mary Wambui; as well as considering independent testimonies from the Returning Officer, Vote Tallying personnel, Observers and reports from Media and voters; it was the decision of the Tribunal that the nomination of Ms. Wambui was factually correct in that she indeed garnered the highest numbers of votes in the nominations," said TNA chairman Johnson Sakaja in a statement.

"Additionally, the Tribunal found that the nomination was not impaired by any irregularities that would otherwise render it a nullity or cast doubts on the veracity of the results," he said.

The party said Mr Mugambi's application was dismissed and he did not appeal.

"We wish to inform the challenger as well as the general public that pursuant to Section 74 of the Elections Act that there is an avenue open to those aggrieved by the decision of the TNA's Tribunal to appeal the decision to seek the intervention of the Independent Electoral and Boundaries Commission (IEBC) in this matter."
