Lamu County Governor Issa Timammy

Saturday, June 28, 2014 - 00:00 -- BY BRIAN OTIENO

IN a sensational claim, Lamu Governor Issa Timamy yesterday asserted that his arrest is part of a wider plot by the government to take over Lamu county.

He intimated that the Lapsset project and the land in Lamu could be the reason for toppling the Lamu county government.

“They have wanted this seat in many ways. I have had no peace since I took this seat. If it is not court battles, it is MCAs, or many other things," said Timamy from his jail cell.

Timamy was speaking to his UDF party leader Musalia Mudavadi and several MPs who visited him at the Port Police station in Mombasa where he is being held during investigation about the Mpeketoni killings of more than 60 people. He is being detained for xxx days, but has not yet been charged.

Timamy also revealed that his deputy Eric Mugo is under immense pressure from members of his community to resign.“I have told my supporters to fully support you,” he told Mugo.

The governor is said to believe that with his arrest and Mugo’s resignation, the government will have the perfect excuse to call a by-election, or even dissolve the Lamu county government.

“I am not a civil servant who will resign," said Mugo.

Earlier, at the Moi International Airport shortly after landing, Mudavadi said Timamy’s incarceration was unlawful. Mudavadi was accompanied by MPs Hassan Dukicha (Galole), Bunyasi Sakwa (Nambale) and Alfred Agoi (Sabatia).

Other MPs who visited Timamy at the police station were Hezron Awiti, Badi Twalib, Suleiman Dori, Lamu Senator Abu Chiaba, former Mombasa Mayor Ahmed Mohdhar, and MCAs from Kwale and Lamu counties.

Mudavadi said the governor, who is the only one on a UDF ticket and Amani coalition, is being used as a scapegoat for the Jubilee government’s inability to contain insecurity in the country.

“We strongly believetthe security agencies are failing to tackle the real issues in Lamu,” he said.

He said the government has failed to charge Timamy in court because they do not know what to charge him with.

“Timamy, even though he is a governor, could not have had a network to be able to do what was done. That was an act of terrorism and security agencies should look clearly at that element of terrorism,” Mudavadi said.

Mugo said certain powerful people are out to ensure they are in positions of power.

“There are some people who do not believe that there is a government if they are not in government," he said, without naming names.“We know there are many plans to ensure certain people are back in government even without being elected,” Mugo said.

He said the Mpeketoni attacks on June 15 and 16 have been politicised. He said before Timamy’s arrest, he had received several threatening messages and calls from people Mugo did not identify. He said he would record a statement about them.

It is likely that Timamy's arrest was planned well in advance, he said..“Some already had anticipated what was going to happen and told me to resign so that after arresting governor Issa Timamy, they see how they will come in,” said Mugo.

Timamy said the government is trying to make it appear that only a certain community was targeted in the attack so they can justify his arrest.

He said there were over 30 victims who did not belong to the Kikuyu community that the government insists was targeted.“There were Luhyas, Luos, Kalenjins, Kambas, Giriamas and Kisiis who also died in the attack,” said Timamy.

In Summary

  • Mudavadi termed Mr Timamy's arrest a cover up and the detention a violation of his rights
  • The UDF leader said Mr Timamy could not have visited harm on people who voted for him and Deputy Governor Eric Mugo.

The Amani Coalition on Friday rallied to the defence of detained Lamu Governor Issa Timamy and demanded his immediate release on bail.

Coalition and UDF leader Musalia Mudavadi said the best way in dealing with insecurity in the country was to have a commission of inquiry look into the Lamu attacks and similar incidents witnessed across the country and termed Mr Timamy's arrest a cover up and the detention a violation of his rights.

Only a proper investigation would identify whether there are weaknesses within the security system and if so, have them addressed, said Mr Mudavadi.

"Issa Timamy is being used as a scapegoat so that some people somewhere can give the impression that they have tackled issues of insecurity."

The UDF leader said Mr Timamy could not have visited harm on people who voted for him and Deputy Governor Eric Mugo, who is from Mpeketoni where more than 60 people were killed last week.

Mr Mudavadi criticised the government for playing down the Al-Shabaab angle in the Lamu attacks.

"I know that several friends of Kenya have shared intelligence with the security agencies pointing to an Al-Shabaab attack. I do not know why the Kenyan Government is ignoring this shared information."

He was addressing journalists at Moi International Airport in Mombasa shortly after landing from Nairobi. He was accompanied by Mr Mugo and MPs Badi Twalib (Jomvu), Hassan Dukicha (Galole), John Bunyasi (Nambale), Alfred Agoi (Sabatia) and a group of Lamu MCAs.

THREATENING TEXT MESSAGES

The team visited Mr Timamy at the Port Police Station. Mr Mugo warned other leaders against drawing political mileage from the deaths in Lamu.

He disclosed that some leaders had threatened him with text messages and asked him to resign.

"I will make a statement over the texts and threatening calls. Our governor is still very innocent since no charges have been levelled against him. I am sure this is the work of malicious individuals who have been sleeping on their job," he said.

On Friday, Mombasa County Woman Representative Mishi Mboko recorded a statement with the CID in Mombasa and is expected to face hate speech-related charges on Monday.

"We have been here with the County Woman Representative. She will appear in court on Monday," Mombasa County DCIO Ndumba Thangalani told journalists in his office.

Ms Mboko was accompanied by two lawyers and was reluctant to talk to journalists, asking them to await her court appearance.

"I have already done my part. I am now waiting for Monday to appear in Court. We cannot talk much as the matter is already in Court," she said.

The Director of Public Prosecutions ordered her prosecution over remarks she allegedly made during Madaraka Day celebrations in Mombasa.
