Cord leaders Saturday sensationally claimed that the Jubilee administration would not last more than two years due to what they described as its inability to govern.

They claimed that a series of misfortunes facing the government, among them the Jomo Kenyatta International Airport fire tragedy, incidents of insecurity, and failure to pay civil servants and teachers in good time, depicted a leadership on the brink of collapsing.

The over 30 lawmakers, including three senators, who gathered at a sports ground in Homa Bay, said the trials in The Hague would not allow President Kenyatta and his deputy William Ruto to take charge of the country's affairs.

Senators James Orengo (Siaya), Johnstone Muthama (Machakos) and Otieno Kajwang (Homa Bay), who led the onslaught against the Jubilee administration, vowed that they would not rest until former Prime Minister Raila Odinga takes oath of office as the President.

Senators Kajwang' and Orengo wondered who would be in charge of the country during the period the President and his deputy will be in The Hague facing trial.

"If for the next 12 months Mr Kenyatta and Mr Ruto will be in the Hague, who will be in charge of this country? Kenyans may be forced to put Raila on the throne because the presidency is not a personal property of the current occupants," said Mr Kajwang'.

Mr Orengo said Kenyans must not be made to wait until 2017 because they have the sovereign power to decide who their leader should be.

The Siaya senator vowed that Cord would use both constitutional and legal means to have Mr Odinga installed in State House.

"This time round, Raila will not be made to fight hard by bringing the Constitution, which was his baby, and others reap," he said.

Mr Muthama claimed that Cord garnered 7.5 million votes during the March 4 polls and that 2.2 million votes were given to Jubilee.

He said Cord won in six and half provinces while Jubilee only had one and half provinces.

He faulted the Jubilee government for harassing them whenever they speak on the ills currently bedevilling the country.

"Is it a crime if I as Muthama challenge the government on the expenditure of Sh2.5 billion for Jubilee celebrations or Sh700m to establish an office for a retired President?" he posed.

Funyula MP Paul Otuoma warned that a repeat of 2007 and 2013 would not be allowed since Cord had put in place an anti-rigging mechanism that would ensure that only one who wins the election is sworn in as the President.

"If anybody thinks that he will always rig elections and get away with it, this time round I will be personally in charge," he said.

The legislators spoke during a home coming party for Homa Bay Town MP Peter Opondo Kaluma, where the guest of honour-Mr Odinga- reiterated that Cord was committed to ensuring the success of devolution.

He accused the government of attempting to sabotage devolution by creating unnecessary roadblocks, among them claims that county governments have no capacity to handle devolved functions.

He urged Kenyans to prepare for a referendum that would increase revenue allocations for county governments from the current 15 per cent to 40 per cent of the national revenue.

ICC Cases may be heard at the same time

Uhuru, Ruto might be away for 12 months.

The International Criminal Court is considering holding the trials of President Uhuru Kenyatta and his deputy William Ruto at the same time.The ICC says "circumstances and developments" may see both cases held simultaneously especially in the course of next year. The two cases are expected to take one year to conclude.

Presently, the cases are listed as being conducted consecutively. If the cases are conducted simultaneously, it means that both President Kenyatta and Ruto may find themselves at the Hague at the same time for their trial.

Ruto's trial and that of radio journalist Joshua Sang is set to start on September 10, which is exactly a month from today. Kenyatta's trial is set to commence on November 12, which is three months from now.

The two are on record stating that ICC cases cannot impede their capacity to rule the country. During the campaigns ahead of the March 4 elections, both Kenyatta and Ruto repeatedly said that they could use technology and specifically Skype to discharge their duties and responsibilities to the country while at the Hague.

The ICC chief prosecutor Fatou Bensouda has appealed against the court's decision exempting Ruto from attending some sessions of his trial at the Hague. Bensouda has maintained that all accused ought to be present all through the trial.
If the cases are conducted simultaneously and if both Uhuru and Ruto are expected to appear in person during all the court sessions, it might lead to both being out of the country for a year.

The court said the cost of conducting the trials simultaneously over a 12 month period would cost Sh1 billion -Sh546 million on field operations and Sh386 million in court spending when the trials start.

"On the information currently available, the budget is based on the assumption that court hearings in all trials covered by the present budget could run consecutively until the end of 2014. However, the need for parallel trial hearings could well arise in the course of the year as a result of case specific circumstances and developments in the Kenya," the ICC budget committee has said in a report.

ICC has said that the Trial Division "will face two trials of unprecedented complexity in the Kenya situation." The cases will however be heard in separate Chambers.

"Possible judicial developments make it likely that in 2014 provision will have to be made for parallel trial hearings to avoid substantial delays in particular cases," the committee has added.

The report will be presented to the twelfth session of the Assembly of States Parties in The Hague to be held between November 20 and 28. It is the first time the Assembly of State parties is meeting at the Hague. The assembly in December 2010 resolved that this year's session will be at the Hague. The State parties have already been reminded of the meeting venue.

President Kenyatta is expected to attend the session which is most likely will coincide with the hearing of his case. The President however has the option of delegating to any other government official to attend the session.

"Credentials of representatives, and the names of alternate representatives and advisers, should be submitted by 19 November 2013 to the Secretariat of the Assembly of States Parties, International Criminal Court," the secretariat has said in its invite to the member states.

According to the budget committee, ICC has spent Sh3 billion so far on Kenya alone since 2011 when the Hague-based court took over cases related to the 2008 post election violence.

It has said €7,740,800 (Sh967.6 million) was spent in 2011 while €7, 412, 130 (Sh967 million) was spent in 2012 on the Kenyan cases. A further €6,913,200 (Sh864.1 million) is being spent in the course of 2013.

In its report to the assembly, the budget committee says that the continuation of resources comparable to those already requested in the Court's 2013 proposed programme budget for the two Kenya cases will be essential.

I think raila is just beleaguered and at a cross roads and is struggling to find relevance in the current political scene..Kenyans have not yet even seen a sign goodwill from governors to hit the ground running in delivering the pledges. what they are witnessing is a continual bashing of uhuruto and jubilee from the council of governors.

There is nothing new that CORD will offer either. It is just the same old monkeys, nothing changes. Give us a break and allow us an opportunity to concentrate on other things. We are tired of forever campaigning.

comedians,,,the like of Otieno Kajwang' and that John Muthama,,people who can
bite but very very,,,,harmless.

The comedy,,,in all of these,,,is that,,they do not have a concrete plan
of how to do it,,of making the jubilee government not last for,,what time.

Who is going to take them,,serious if not,,,their likes,,who expects things,,to
just happen,,,like that,,without working for it.

They said so much things,,,during the last general elections,,their way of doing
things,,,but forgot to look for votes.

They lost heavily and could not believe,,,, started blaming everything,,nearby
,,but still,,were on the ground and nobody could help them,,,that time round,,,as
happened in 2007,,,,,,for things were different,,,,not even their friends,,,in the
west,,could help them.

Uhuru Kenyatta has started,,even,,ahead of him,,,he was hosted in several
vernacular radio stations,,,this morning talking about it,,to the people.

Wembe ni,,Ule ule,,,bring it,,on,,,,,we shall burry you,,even before the next
general,,elections.


We shall vote against any move,,kwani,,,namba ni ile ile,,,and i do not see many,,
in their side,,,voting overwhelmingly for it will not be Odinga being voted.

They are going to loose very,,heavily,,,but are very blind and do not see,,this.

They will loose many areas,,like that of western and many others.

Raila is selecting this option,,of a referendum,,,to make him,,relevant in
Kenya after having nothing to do,,,,but very mistaken.

He is fighting a reigning president,,Uhuru is not the other Uhuru he
was,,Raila,,used to,,,this is a very powerful Uhuru.

Just the other day,,,Raila ran to Kampala,,for help,,,and Uhuru gave

Kenya: The March 4 election spell is yet to leave us and it manifests itself more in the social Internet sites. I am sure you too can feel its undercurrent sweeping through the body of Kenya's politics. The frustration as of now is to get our finger on the right vein to gauge its pulse and throb.

Not that the tidal wave staved off by Mr Raila Odinga and his team by way of demands for a referendum, through collection of a million signatures to force a referendum on the Constitution, is of immediate threat to President Uhuru's and deputy William Ruto's rule.

I believe the cases starting next month for Ruto, and in November for Uhuru, could be more distracting for the two leaders than this referendum debate.

But you would soon understand why they are also not taking this other matter lightly.

Political Discourse

However, even if only for political discourse or banter, we may need to give this renewed rivalry fresh look because the political battle line follows the pattern of the ethnic constellation that built up into the March 4 implosion. On the one hand you have the Jubilee brigade, fortified by nascent incumbency and cushioned by veneer of being the Executive.

On the other, we have CORD, with the ‘captain' remaining Mr Raila Odinga, deputised by Mr Kalonzo Musyoka.

There are certain things we had predicted before, and they are all coming to fruition. We said by virtue of their triumph, Uhuru and Ruto would soon enough realise how difficult it is to fulfil their big promises against our rising levels of consumption of public funds because of increased expenditure from the new institutions and commissions created by the Constitution, and of course legendary greed. Worse still for the pair, the previous regime handed them a huge public debt, mainly from the Chinese and the roads we glorify Mr Mwai Kibaki for, and the onerous burden of implementing the Constitution in full.

It was therefore natural that after election, as reality strikes, the issues of unimplemented pay deal with teachers dating back to 1997 would come in. Doctors and nurses too would follow as civil servants. Note that there is nothing more binding among the working class, far beyond political affiliation, tribe and grade in the employment ladder, than the issues of the stomach.

That is where we are today; with Uhuru and Ruto beset with intricacy of balancing the interests of, or even appeasing the public workforce, while confronting the number one monster Kibaki might never have quite told them he left without slaying.

This monster is called PublicWageBill, and its surname is Runaway, because it is crushing and gulps down Sh485 billion of the Sh700 billion average revenue the national tax collector rakes. It is like running a business where for every Sh700 you make, you are only left with Sh215 to invest in fresh stock, pay salaries and keep yourself and family in comfort - after paying off the recurrent or fixed costs!

The nature of politics is that we are all swept off our feet when a regime we support takes over. But because of high expectations, so too are higher the frustrations when it seems it can't deliver your expectations within your reasonable or unreasonable timings.

Tribal ties

The referendum calls, just like the teachers' strike, will test the metal with which Uhuru and Ruto are made. Yes, the tyranny of numbers can hold sway in an election, but when the stomach rumbles with hunger-pangs, the tribal ties loosen.
The other prediction was that Raila might not be retiring soon, largely because of the ‘unfinished' business with Uhuru and Ruto, but also due to the fact that in moments of crises like these, he thrives.

So predictably, he was bidding his time, and along with his team, he has seen the side o Jubilee soft-belly he can start poking by the tip of a knife, held for him by the Governors, Senators, and the common folk fascinated by the idea of devolution.

You see in these three groups you can be sure issues of tribe and political affiliation may not be that binding when you factor in how their own personal interests are threatened by the puncturing of the tyre of devolution.

So in a nutshell you expect that there are Members of County As-sembly, Governors and Senators who will support Raila's push despite being in Jubilee. This is because a different MOI still rules Kenya, and the abbreviation means: My Own Interest!

Throw into this mix the icing on the political cake we are being asked to taste; the members of the smaller Kenyan tribes, who on the basis of the so-called tyranny of numbers, know that elections is just but a census of Kenyan communities, with the constellation of the bigger tribes for mutual reasons assured a win.

Then the last prediction we made was that as a country we shall soon have another object of hate, to take over from Raila, and that person must be within the proximity of the next presidency, and must be so serious a threat to Uhuru's second term, his horns would have to be trimmed soon.

This is hypothetical, but if you listen to the grapevine, you may hear the squawk in Jubilee kraal; "what shall we do with him?"

Now the point we are making is; however crude the timing is, the next succession battle has started.

This is typical of we Kenyans really, but the question we should be asking is if we are ready for the next divisive referendum under the same IEBC cast, and with TON (tyranny of numbers) intact? What about the cost? I would have told you about the other issue probably at play but it is too hot…and has to do with what will soon happen at The Hague.
