A new Constitution of Kenya approved by referendum on August 4, 2010 established the Kadhi court system as a subordinate court under the superior courts of Kenya (Supreme Court, Court of Appeal, and High Court).

The jurisdiction of a Kadhi's court shall be

1. limited to the determination of questions of Muslim law relating to personal status, marriage, divorce or inheritance

2. In proceedings in which all the parties profess the Muslim religion and

3. Submit to the jurisdiction of the Kadhi's courts.

As a Christian, I see no harm in that. However, unlike in Kenya where the Kadhi courts are funded by taxpayer money under the judiciary, here in Tanzania they should be funded by the official body representing Muslims in the country (BAKWATA). Also, no to the OIC. That way, everyone goes home semi-happy!

Well said. No christian or for that matter any tanzanian is against the establishment of Kadhi's courts. The question is, who will fund these courts? Tanzania being a circular state, this might be a problem. Let the muslims manage their sharia affairs within the prescribed/agreed jurisdiction.
