President Kibaki and Prime Minister Raila Odinga on Saturday differed over the appointment of three police chiefs.

Mr Odinga rejected the naming of Grace Kaindi and Samuel Arachi as deputy inspectors-general and Ndegwa Muhoro as CID director saying the appointments announced last Friday were unconstitutional.

The PM said the appointees could not reform the police, adding that he and the President had not agreed on the names as he had expressed reservations on the integrity of the officers.

A Gazette notice issued last Friday named Kenya Airports Police Unit Commandant Grace Kaindi the Deputy Inspector General in charge of the Regular Police and Samuel Arachi as the head of Administration Police. Mr Muhoro was confirmed as the new head of the CID.

"I had raised my serious objections to the three names that were presented to me in the consultations that were under way," the Prime Minister said.

He said the Independent Police Oversight Authority (Ipoa) chairman Macharia Njeru had issued a scathing report highlighting serious allegations touching on the integrity of Mr Muhoro.

Mr Njeru had also written to both principals asserting that Mr Muhoro should not be considered for any of the police appointments.

But the Head of Public Service, Mr Francis Kimemia, yesterday said Mr Odinga had been duly consulted before the appointments were gazetted.

Mr Kimemia said the PM had objected to the appointments because his favourite nominee for head of AP was not picked for the job.

In his statement, the PM said the National Accord explicitly indicated that senior appointments must reflect agreement by both sides of the coalition and the appointments needed to be gazetted within five days of parliamentary approval.

"This was not done," he said, adding that such appointments would undermine the confidence of Kenyans in the police.

"The reforms in the police cannot be carried out by the new appointees, all of whom were existing officers in the current force and had blemished records," he said.

Mr Odinga said the rot in the force was on display in the ongoing inquiry into the activities of Mr Joshua Waiganjo, who posed as a senior police officer in the Rift Valley.

The PM had earlier objected to the first list, saying it violated the law on gender balance.

"They then tried to change this law to remove the gender balance provision but, luckily, that went nowhere," he said.

The PM said consultations with the President had been at an advanced stage when they were abruptly discontinued and the appointments announced.

But Mr Kimemia said consultations had been "extremely wide and extensive".

"The candidates appointed are the best. The PM's office wanted Patrick Ochieng to head the AP; this is not possible, the Police Act states otherwise – that a unit can only be headed by one of its own," he said.

Raila is citing Njeru's report and recommendations to both principals.

Civil society groups have vowed to challenge President Mwai Kibaki's appointment of Mr. Ndegwa Muhoro as the Director of the Criminal investigations Department in court.

The Civil society groups also said that Muhoro is not fit to hold the position.

The groups, including the International Commission of Jurists-Kenya, Independent Medico-Legal Unit and the Rights Protection Centre said that President went against a report by the Independent Policing Oversight Authority that recommended that Mr. Muhoro should not be appointed to the position due to integrity issues.

On Friday, the President gazetted Muhoro as CID Director as well as Ms Grace Kaindi and Samuel Arachi as the Deputy Inspector Generals of Police.
Their move comes after Prime Minister Raila Odinga rejected Kibaki's appointments on the three critical positions saying he was not consulted as required by the law. Plans are ongoing today to swear in the three appointees.

"IPOA is an independent body with the mandate to scrutinise information presented to it by concerned citizens and it has raised serious integrity issues against Muhoro. We have no option but to challenge the President's decision in court," said Peter Kiama IMLU Executive Director Tuesday morning in Nairobi.

He called on the President to select another qualified person from those who were shortlisted for the position or allow the interview process to be done afresh.

"We know it is critical to have the positions filled to ensure proper coordination of the security agencies during the electioneering period but we cannot make any compromises on the issues of integrity. We need the right people on those posts," he said.

Executive Co-coordinator at Rights Promotion and Protection Center Odhiambo Oyoko said that it was illegal for the president to ignore the express recommendation of IPOA on the alleged unsuitability of Mr. Muhoro saying the institution has the final say on the matter.

"We demand that Muhoro's appointment be rescinded until all allegations against him are investigated and proper determination be made by competent authorities as to whether he is fit to hold office or not," he said.

Regarding Kaindi and Arachi, the civil society leaders called on IPOA to make public its investigations on the two to enable Kenyans determine whether they are fit to hold office or not. But so far they have not called for their replacement.

Muhoro was the Acting Director of CID before he was confirmed by Kibaki while Ms. Kaindi was the commandant of Kenya Airports Police Unit (KAPU) and Mr. Arachi was the Acting Commandant of the Administration Police.

Coming on the heels of the chaotic nominations by political parties, the unilateral appointment of three persons as Deputy Inspector Generals of the regular and Administration police respectively and a Director of the Criminal Investigation Department was depressing.

President Kibaki has quite rightly received plenty of praise for his record on the economy, particularly infrastructure development.

He has also been lauded for helping push for the enactment of the new Constitution.

As he heads into retirement, one would have hoped the Head of State would avoid making the wrong kind of waves. While we only have Prime Minister Raila Odinga's word that he did not consent to the names, he does have the advantage of history because in past instances where there was a similar standoff, he was proven right.

The other reason why the President is not looking good on this one is the rejection of some of the names by the Independent Police Oversight Authority Chairman Macharia Njeru.

Post-election violence

As the body mandated to oversee reform of the National Police Service, his is a powerful adjunct to the condemnation from the PM's office.

The Office of the President has been on the wrong side of popular opinion, independent commissions and the Judiciary over appointments, the most recent being the unilateral decision to appoint county commissioners.

Clearly, the temptation to roil the Grand Coalition Government one last time was too exciting to resist.

It was important that the two principals agree on this one since police were accused of being partisan during the last presidential contest that left over 1,000 Kenyans dead and hundreds more brutalised or displaced from their homes.

The absence of Parliament is immaterial as the police oversight body must make the final decision.

Now it is up to Njeru and his team to decide how best to deal with the matter, and the law is on their side.

ELECTION RED-FLAG: OP, POLICE & PROVINCIAL ADMINISTRATION

The recent TNA nomination fiasco in Othaya constituency presents a case study of continued direct involvement and meddling of the Office of the President, the Provincial Administration, and Police in electoral processes in Kenya. It is a chilling wake-up call of what possibly awaits the nation come March 4th, 2013.
All evidence indicates that compared to the Office of President PS and Provincial Administration PS, the Inspector General of Police (David Kimaiyo) has little chain-of-command control over what happens at the local OCPD and OCS offices in Othaya. (Read the Daily Nation investigative report below)

This is a fundamental plank in the equation of purported police reforms in Kenya. How come the OCPD and OCS are DIRECTLY answerable to the DC, PC, and PSs in the Office of President and Provincial Administration, AND NOT the Inspector General of Police?

Is this the same security command-structure we are walking into the delicate and sensitive March 4th, 2013 election with?
This matter is very relevant to the ongoing ICC cases where chain-of-command issues regarding security have arisen with regard to Francis Muthaura's case.

As the case in Othaya confirms, not just regular police, but Administration Police (AP) (traditionally aligned to the provincial administration) have both developed a dark reputation with regard to meddling in Kenya's elections.
And all such orders evidently emanate from the Office of the President. In the 2007 elections – APs and GSU overtly involved themselves in poll station interference, having been surreptitiously planted in poll stations across the country – acting as PNU poll agents. This brazen meddling of security in elections culminated in the notorious ambush of former ECK Chairman Samuel Kivuitu during the hostile takeover of the KICC tallying center.

In the last week, a dispute between the Office of the President and Prime Minister over the appointments of the Deputy Inspector General of Police, Head of the Administration Police, and Director of CID has exploded into the public.

A crucial element of the dispute regards leadership of the Administration Police, where a
Mr. Arachi– previously accused of mobilizing APs during the last (rigged) elections – has purportedly been promoted to lead the outfit. Another key player of the PEV, former Nyanza PPO, SSP Grace Kaindi, has also been hand-picked by Kibaki to be the Deputy Inspector General of Police.

Ndegwa Muhoro who has been picked by Kibaki to lead the CID (in replacement of an earlier appointment ofMs. Mary Oyugi Kaol), was literally blacklisted by the Police Oversight Authority for lacking the integrity required of such office as mandated by the Constitution. Ms. Kaindi is among persons of interest by the Office of the Prosecutor of the ICC who are currently being shielded (by Kibaki's section of the Kenya government) against giving testimony to the ICC chief prosecutorFatou Bensouda.

It is against this backdrop that we need to interrogate the ominous role of the Office of the President (led by PS Francis Kimemia and PS Mutea Iringo) in the upcoming elections. All indications suggest possibility of yet another audacious assault on the democratic rights of Kenyan citizens by the Office of the President, Provincial Administration, and highly vested interests within the Police and AP.

We clearly have a situation where certain senior police officials (Muhoro, Kaindi, Ndegwa, Arachi) all have vested interest in the outcome of the 2013 elections. Should CORD come to power, all four fear facing possible questioning over integrity issues, with some fearing having to answer PEV related questions with ICC's Office of the Prosecutor. It can be argued that all four may therefore "do all they can" to ensure the CORD presidential candidate is not sworn in after the next elections.

Now to the evidence of current and sustained electoral meddling from the Office of the President (OP)- For a glance on whether the OP, Provincial Administration and Police are still meddling in electoral processes in this day and age (2013), pay close attention to this Daily Nation report (below) which details direct involvement of the head of the civil service and PS in the Office of the President,
Francis Kimemia, PS in charge of Provincial Administration, Mutea Iringo, and the politically-motivated instructions they issue to both provincial administrators and police officers like PC Jaspher Rugut, DCDavid Koskei, DO Ms. Chege, and local Othaya police heads (OCPD and OCS). The DC, DO, OCPD and OCS have all become casualties of punitive transfers for not meddling sufficiently enough. [ NB: The nexus between the head of civil service and chain-of-security-command from Kimemia to the OCPD and OCS will likely be of interest to ICC's OTP where former civil service boss Francis Muthaura is facing serious charges - I will email this piece of information and the news report to the OTP shortly]

Something had to be done to secure Mr Mugambi's victory. It was at this point that Head of Civil Service Francis Kimemia and PS in charge of provincial administration Mutea Iringo were brought in.

On Friday, January 11, a twin effort was launched with Central PC Japhter Rugut and Othaya DC Koskei being summoned by Mr Kimemia to his office to discuss the matter.

Although they had arrived in the morning, they were kept waiting until 4 pm when the meeting started. Mr Iringo attended the meeting, which explored all the options available on how to secure Mr Mugambi's victory, but by the time it ended at 10 pm, no solution had been found.

The PC and the DC are said to have put it categorically that Ms Wambui was too strong on the ground and, barring any surprises, she would cruise to victory easily.

Again, the DC, Mr Koskei, was summoned back to Nairobi by Mr Kimemia on Monday, this time without the PC, where the matter was again discussed in the presence of PS Iringo.

After the deliberations, the only option available was to approach TNA with a request that the certificate be given to Mr Mugambi irrespective of who wins the race.

But when he spoke to the Sunday Nation yesterday, Mr Kimemia laughed off suggestions that government officials took more than necessary interest in the Othaya nominations.

"We were monitoring nominations by all parties in all parts of the country for security reasons. It's preposterous for anyone to imagine that anyone in the Civil Service took any more interest than was required by the call of duty in the nominations," Mr Kimemia said.

"There was tension on the ground because of delayed materials and we were trying to do whatever it takes to calm the situation. Our focus was not on Othaya. The nomination process helped us to know the potential hotspots," he added.

Ab-Titchaz from those articles I see raila has made those allegations "his own personal -war" having identified the "loopholes" correctly! Hope he has enough ammo to succeed in this latest attempted overkill. Though I must say it is equally tough for him since he is seeking to muscle his way against equally shrewd fellas!
