Kilichofanyika ZAIN ni kinyume cha sheria za kazi!!


Jamani hiyo minimum standard ndio SHERIA! ndo maana halisi ya sheria ni minimum standards, kama kulikuwa na Collective Agreement naomba muibandike humu, otherwise ni hadithi hizo.

42(1) For the purposes of this section, ''severance pay'' means an
amount at least equal to 7 days' basic wage for each completed year of
continuous service with that employer up to a maximum of ten years.
Kwa hiyo mtu aliyefanya kazi mwaka mmoja anahitaji apate malipo ya siku saba.

Aliyefanya kazi miaka miwili siku 14 and so on...

Zain wamekamilisha hili, na zaidi. Wangeamua kufuata sheria watu wangechanganyikiwa nadhani.

(2) An employer shall pay severance pay on termination of emplo-
ent if-
(a) the employee has completed 12 months continuous service
with an employer; and

(b) subject to the provisions of subsection (3), the employer ter-
minates the employment
(a)Wamewalipa severance pay wote walifanya kazi zaidi ya mwaka, so wamekamilisha hili.

(b) Wameterminate employment based on operation requirements, wamekamilisha hili.

Sasa sijui unataka walipwe nini tena? Au labda utueleze ni wapi Zain wamevivunja hivo vifungu vya sheria?

Kama hao wafanyakazi walikuwa na chama cha wafanyakazi na Zain walikuwa na makubaliano tofauti na hicho chama basi mtuwekee humu hayo makubaliano, otherwise sioni ubishi uko wapi.

Tukumbuke kuwa uwezo wa kuwaajiri na kuwafukuza wafanyakazi ni muhimu sana kwenye dunia yenye ushindani mkali, kampuni lazima iwe "flexible".
 

Kwa kifupi Retrenchment ni sababu mojawapo au mazingira yanayoweza kupelekea mwajiri akakatiza (terminate) mkataba wa ajira. na ili kuyaweka mambo vizuri, huwezi kufanya retrenchment bila kuterminate mkataba, yaani ndani ya retrenchment kuna termination of contract. Na ndio maana mada kuu hapa ni fairness ya termination of contract tukiachilia mbali sababu au mazingira (retrenchment). Hii inamaana tunapozungumzia termination it can be anything that brings the contract of employment to an end. Be it my misconduct, inefficiency, etc.

Kuhusu severance (Section 42 of ELRA, 2004), severance ifahamike kwamba ni entitlement pale mkataba wa kazi unapokuwa brought to an end. Kwahiyo severance haihusiani na procedural aspects za contract termination. Afterall hatujaambiwa kwamba wamenyimwa severance payment. Na hatakama hawajalipwa procedure ni kwamba kila mwajiriwa aliyeachishwa kazi anatakiwa kuandika barua kuomba alipwe na sio kesi. Kwa kifupi formula ya severance ni (1/4 * salary*No. of years worked) na inaapply kwa yeyote aliyefanya kazi kwa mwaajiri huyo kwamwaka mmoja au zaidi na si chini ya hapo.

Wafanyakazi wa TTCL haswa kina Ndaro na wenziwe waliwachukulia wale wa iliyokuwa Celtel (Zain),kama vibaraka kumbuka Celtel ilikuwa kampuni ya TTCL (Kina-dharia) sasa sijui kama wataweza kwenda TEWUTA ... Kwanza sio wanachama,pili wakati ule hawakuona kuna umuhimu wa kujiunga...kwa nini iwe sasa??? Nawasilisha
