Naombeni ushauri wenu:

Kama mtu bado yuko kwenye probation ( offer Letter inasema six months probation time); na imekuwa 1.5 months of probation mpaka sasa hivi.

Kazi yako ni recruiter; sasa ushawatafuta candidates wote waliokuwa wanahitajika na kampuni inakuambia u have to leave the job in 24 hours time; sasa je swali langu ni kwamba what offenses oblige an employer to make an employee leave the job in 24 hours?

kampuni ipo huru kisheria kwa kuwa offer inasema either part may terminate the contract by giving the other part 24h letter of termination or .....na uka saini kukubali. hapo hata ingekuwa ww ungeweza kuandika barua kuacha kazi in 24h na wasikufanye kitu, ila kwa kuwa wamekuwahi anza kutambaa taratibu.

Kama ulikuwa umepewa barua ya ajira na hukuwa kuitwa au kuonywa kwa namna yoyote, una haki. Suala lako linaweza kushughulikiwa pale CMA-Commission for Mediation and Abitration. Au ni-pm nikupe msaada zaidi.
 
Ahsanteni kwa mchango wenu........ila sababu ya kauchishwa kazi in 24hours is not told; one fine morning one is just called in the MD's office and told 'i do not want to see you here from tommorow' ( haujapewa sababu yeyote!! )

I agree totally agree that either party can terminate the agreement provided you give a valid reason; i believe no one can terminate anyone without any valid reason, ukiuliza reason MD anakuwa kimya!!! hana sababu.!!!

Is this acceptable? Is this what Tanzanians are entitled to?

Jaribu kupitia ibara ya 41 ya sheria ya ajira na kazi ya mwaka 2004. Waweza kutafuta mwanasheria pia akakuongoza kupata haki yako.
 

If your performance does not meet your job requirements and you are still on probation your employment can be terminated without notice. On the other side, employer can also terminate his/her employment during the probation period without any notice to employer. Termination during probation period depend on your performance and not offence

This sounds like unfair termination na ushauri wa kisheria ni kitu kizuri. PM me for guidance and meeting if it really is something that youhave personally experienced. I hate employers of this nature.

Kwa jinsi ilivyo ni unfair termination as per section 37 of Employment and Labour Relation Act, 2004. Ni unfair kwasababu hawajakwambia kwanini wanakusimamisha kazi. Hata kama watakwambia then sababu lazima wathibitishe kwamba ni fair reasons. The issue kwamba ulikuwa kwenye probation its invalid maana pia wana haki ya kujua kwanini wanasimamishwa kazi. Notice si lazima kama utapewa mshahara wa mwezi mmoja badala ya notice kama hukupewa basi ni kosa na unahaki mbele ya sheria ya kazi. Ukipitia mkataba wako wa ajira kama kuna sehemu wameweka duties and responsibilities ni vyema maana ukisimamishwa kazi kutokana na kutotekeleza majukumu ambayo hayapo hapo una haki ya fidia mbele ya sheria pia. Hakikisha kwamba sababu utakayopewa iko hapo na mwajiri ana wajibu wa kuhakikisha anathibitisha kwamba utendaji wako umekuwa chini ya kiwango.
