ndugu wana jf;

naombeni msaada wa kisheria kuhusu kujiunga na vyama vya wafanyakazi katika haya yafuatayo:

1.kujiunga na vyama vya wafanyakaz n lazma au hiari?

2.kukatwa mshahara kwa ajili ya kuchangia vyama vya wafanyakazi eg CWT kabla ya kujaza fomu{kusaini contract}/kujiunga na chama husika ni halali au ni wizi?

3.kama nakatwa mshahara kwa ajili ya kuchangia chama husika kabla ya kuingia mkataba/kujiunga na chama nifanyeje kisheria ili nipate haki yangu yani hela nilizokatwa kabla sijawa mwanachama?

4.je naweza kujitoa kwenye chama nilichopo? kama ndio je nifate taratibu zipi ili niweze kujitoa?

NB: Walimu wengi wamekua wakikatwa mishahara yao na CWT kabla hata ya kuingia mkataba na chama hicho, lakini wanashindwa kuchukua hatua kwa kutojua haki zao za kisheria za kazi na hii pia ipo hata kwenye mifuko ya pensheni, naomba wataalam wa sheria mliopo jamvini mtupe elimu juu ya maswala nilouliza hapo juu.

61.-(1) An employer shall deduct dues of a registered trade union Deductifrom
an employee's wages if that employee has authorised the
employer to do so in the prescribed form.

(2) The employer shall remit the deductions to the trade union
within seven days after the end of the month in which the deductions
are made.
(3) Where the employer fails to remit the union dues within the time
specified in subsection (2), without reasonable grounds, the employer
shall be liable to pay the union the equivalent of five percent of the
total amount due for each day the dues remain un-remitted.
(4) An employee may revoke an authorisation by giving one month's
written notice to the employer and the trade union.
(5) Where an employee revokes any authorization under subsection
(3), the employer shall cease to make any deductions after the expiry
of the notice.
(6) With each monthly remittance, the employer shall give a
registered trade union

Safi sana mkuu. Umetufumbua macho wengi, hasa walimu tunaokatwa fedha bila ridhaa yetu.
 
Soma sheria ya ajira na mahusiano kazini namba 6 ya mwaka 2004. Kifungu cha 72 kifungu kidogo cha 4. Wapinga trade union wengi hawakipendi hiki na hawakigusi kwa kuwaambia watu ukweli
