Since the coming of the 'multi-partism', this is what we have been experiencing.

You never know who is lying and who is telling the truth,,,very few who
have the capability to tell,,black from white and some can see but will
never tell,,people,,,what is the truth.

So,,majority of Kenyans,,will just follow the wind without asking common
questions.

I ask,,,,why all this allegations,,of Mutunga this,,Ahmed Nasir that after
registrar general ,,mrs Shollei,,,have been accused of many,,not good
things.

If the group supporting mrs Shollei are sincere,,why this time and
not before.

Are they doing any good to the reputation of mrs Shollei???Or are they
telling us that,,,CJ Mutunga and Nassir,,are equally guilty as
mrs Shollei????

If you slap me and i go to report to the police,,and you're arrested,,then
tell the police that,,,i'm the one who started,,,by slapping you first.

Something like this has happened many times,,,,but what i know,,,is that the police
will say,,,'but you never reported it,,,so we are going to deal with the one
which has been reported'.

Because Kenyans,,some,,loves going round and round without wanting to get to the
bottom of anything,,,or try to hide behind some very foolish reasons,,,,,now people
have,,veryeasily,,jump into another,,completely new matter,,without,,first,,dealing
with the one which came first.

We all shout loudest,,that corruption is killing us.

But when mrs Shollei is accused of having participated in some kind of corruptions
and so,,dismissed,,,a group emerges,,,accusing the chief justice,,with all kind
of very funny accusations,,,accusing Ahmed Nassir that he does not have
certificates to practice law.

Why now,,why,,,is my biggest question.

Why not first deal with mrs Shollei,,then come to Dr Mutunga and Ahmed Nassir,,
later,,if people are serious and not playing with their own lives.

During the vetting of Dr Willy Mutunga,,,it is the ODM which stood
by him and openly,,supported him as the right man to become the
next CJ.

The PNU side had the feelings that,,Kenya's NGO's and opposition
were bringing in Mutunga,,so as to be of help,,,when needed.

I remember,, i in Mashada,,,switching side and supporting Willy
Mutunga with the ODM members,,at that time.

The only sin,,CJ Mutunga,,commited and became a devil to ODM,
is when he did not rule the presidential case,,in favor of them.

There was apprehension,,on the side of Jubilee,,,,during that presidential
case in the supreme court,,,that Mutunga would help Raila Odinga,,
ascend to power.

It has been known,,that Mutunga and Raila had a kind of friendship,,,
for even before the general elections,,Mutunga would always appear in
Raila's many functions.

So it was a forgone conclusion,,,to many,,that,,Mutunga being a Mkamba,
from the same tribe as the former VP mr Kalonzo,,one of the pricipal in CORD,,
and also a friend to Raila Odinga,,men who had shared cells during detention,,,
he,,then Mutunga was going to help Raila Odinga..

This kind of talk was all over,,in all Kikuyu vernacular radio stations and so,
in offices,,markets and the street.

There is a woman,,who like coming to me,,looking for my opinion whenever
there is a big political issue in Kenya,,and so she came and told me,,,,,,,

'we are all finished,,,' meaning,,,the side of the jubilee,, ' if it is Mutunga
who is going to make the ruling'.

'Look,,he is a mkamba and the best friend to Raila Odinga'.

She could not believe what i was telling her.

That,,Willy Mutunga was a person,,beyond tribalism and friendship.

I said to her,,that Mutunga would follow the law and make the right
decision and i told her that Uhuru Kenyatta was still going to be sworn in.

Until now,,no one in the CORD,,,,almost four, five months,,,how Raila won
and Mutunga overruled,,it.

If,,,really,,,Raila had won,,,,and some one stole it from him,,,then,,the 2007
chaos would have been,,a child play,,,,he could not accept anything less
than the state house,,no matter what the diplomats said.

But he had to tell a true story,,to his poor supporters,,,that,,,,,

"you know that i'm unbwogable,,and that nobody can defeat me,,,so,,,
Jubilee stole it from me,,,through Mutunga"

And so,,,poor Willy Mutunga changed,,withing seconds,,,from a saint
into the greatest devil,,,ever living. for no one can take it from Raila Odinga.

The next day,,we saw Raila Odinga at state house,,,paying this bad Uhuru
Kenyatta,,,a visit.

So,,,,be very careful when looking things in Kenya,,,,,the snake you many
are pointing at,,may not be a snake,,,,,,,the angel you see may be,, the worst
,,,,bin Laden around.

want to punish JSC for removing mrs Shollei.

CORD are very excited to see people taking on the Chief justice and so,,are applauding
to see him,,,,crucified.

Does it mean,,,that CORD and JUBILEE will,,after all,,meet at some point.

Corruption fighting back??????? and here you do not see the difference
between cord or jubilee,,,,very bad.

Let,,first deal with Shollei case,,then we can listen to them,,, tell us why
Mutunga and AhmedNassir are bad.

But we should not allow a group to come and shield mrs Shollei.

She should carry her own,,cross.

THE Judicial Service Commission (JSC) Ahmednasir Abdullahi has accused the Chief Justice Willy Mutunga of wasting taxpayers' money on "nonsensical" foreign trips. In an email obtained by the Star Ahmednasir accuses the CJ of "spending public money like you will do with your private money".

And as prove of where the power in the Judiciary lies, Ahmednasir tells the CJ that as the chairman of the finance and administration sub-committee of the JSC he has the final say on finance issues at the judiciary.

The emails leave no doubt on where the power in the judiciary lies and casts Mutunga as a hapless leader of judiciary who is just a victim of powerful forces.

According to the emails, Mutunga had written to members of the JSC informing them of planned "benchmarking tour of the US and Canada" in late September and early October 2013.

However, in what amounts to a caustic reply to the CJ, Ahmednasir dismisses the planned trip, questioning its rationale and describing it is "total nonsense" and "waste of taxpayers' money".

The July 17, 2013 email is copied to all members of the JSC. "Also fundamentally have (sic) not approved these two visits (and don't ask me whether I have these residual powers as the chair of the finance committee to cancel wasteful trips…I have!!! Arusha and Bosnia are the only trips on the cards," Ahmednasir wrote to the CJ.

He goes on: "According to my books you spend public money like you will spend private money. Thus America and Canada are out. We have done enough benchmarking after all…benchmarking is not an endless trip to visit as many countries as we wish."

The revelation are particularly damaging coming just days after the parliamentary Committee on the Budget was last week told that JSC commissioners have earned Sh128 million in sitting allowances over the last three years.

Gladys Shollei, who until her sacking last Friday was the Chief Registrar of the Judiciary, told the committee that JSC had scheduled so many meetings ostensibly to make money.

Shollei had told the Committee that Finance and Administration sub-committee of the JSC has perpetuated profligacy by approving monies from the Judiciary Fund even though it had no powers to do so.

In his reply Mutunga seeks to agree with Ahmednasir position, who he refers to as the "Grand Mullah". "I am asking for a discussion on these benchmarking tours. We have not actually sat down and rationalised them. I now add my voice to that of the Grand Mullah (and sometimes the AG) that we think through proper criteria for justifying them."

The revelations emerged even as the Justice and Legal Affairs committee of the national assembly meets this morning to consider a petition that seeks to disband the JSC.

Nicholas Riungu Mugambi who has filed the petition wants six members of the JSC removed from office for having contravened and violated the constitution.

A source at the committee, chaired by Ainabkoi Samuel Chepkonga, told the Star yesterday that the committee has invited Riungu to hear him, even though the "petition in itself is well crafted".

Riungu wants commissioners Ahmednasir Abdullahi, Emily Ominde, Samuel Kobia, Christine Mango, Mohammed Warsame and Florence Mwangangi sacked for gross misconduct, incompetence.

Riungu states in the petition that the six have gotten actively involved in the financial and procurement day to day operations of the Judiciary, exercising veto powers regarding expenditure and abrogating themselves extensive oversight powers over fiscal management of the judiciary under the guise of being members of the finance committee.

The constitution designates the CRJ as the accounting officer of the judiciary and Riungu argues that by purporting to approve and disapprove expenditure of monies allocated to the judiciary has caused inordinate delay in the processing of salaries of judicial staff.

Article 173(1) (3) of the constitution designates the CRJ as the administrator of the judiciary fund and Riungu argues that the six "increased the vulnerability" of the judiciary when without authority approved expenditure.

The petitioner also wants the six commissioners removed from office on the ground that they "obstructed" justice by issuing directives to the Inspector general of police David Kimaiyo asking not to arrest some judiciary staff who were alleged to have stolen Sh80 million from the judiciary.

Four junior Judiciary members of staff, Ruth Wanjiku, Joab Ooko, Boru Mole and Benjamin Mutuku were later arrested and charged with conspiring to steal Sh80,013,302 from their employer on September 14.
