Machakos, Kenya: Kibwezi West parliamentary aspirant Kalembe Ndile could be the winner of the March 4 General Election should the court go by the results of the constituency's vote recount.
In his petition against the sitting MP, Ndile said his agents were not allowed to sign any declaration in respect of the election by the presiding officers and did not append their signatures on form 35.
The constituency had 164 polling stations.
The results from the recount indicated that Ndile got 16,891 votes which is higher than Patrick Musimba's 16,773.
The initial election results following the March 4 General Election had indicated that Musimba won with 17,196 while Ndile was second with 16,976 votes.
The recount was supervised by deputy registrar Rose Wakhungu.
The court will Tuesday July 9 give a ruling either calling for a by-election or declare the eventual winner.
High Court Judge Justice D.S Majanja dismissed an application by Musimba seeking a recount of the presidential votes arguing some of his votes where in the president's ballot boxes.
Justice Majanja asked lawyers of the interested parties to make brief submissions before his final judgement on the matters.
