Learned brothers and sisters, kuna scenario nimeipata sehemu nahtaji michango yenu; Kuna bwana mmoja say "X" alikuwa na rafiki yake wa muda mrefu say "Y" waliokuwa wakisaidiana katika shida na raha. X alipata uhamisho kwenda kufanya kazi ubalozini marekani na alipokuwa marekani alihitaji rafikiye amnunulie kiwanja chenye gharama ya million 100 na kutokana na urafiki wa siku nyingi kati yao, X alitanguliza million 90 ili rafikiye afanye malipo ya kiwanja kwa ahadi ya kumalizia million 10 baada ya siku chache. Huyu Y alichofanya ni kwamba alilipa hyo million 100 kwani million 10 aliongezea mwenyewe na katika maandikiano akaweka jina lake na X alipomalizia million 10 Yule Y aliitumia kuweka msingi wa nyumba anayotaka kujenga. X aliporudi nchini katika kuulizia kiwanja chake kwa rafikiye alikana kupokea pesa kwa ajili ya kununulia kiwanja ukizingatia katika bank transactions zake amekuwa akitumiana pesa na huyo rafikiye mara kwa mara. X amekana kabisa kurudisha kiwanja. In a laymans view X ndio mwenye haki lakini how do u prove t legally in court?!
 
M not a learned brother but seasoned Real estate consultant m I allowed to chip in? Hope YES. I had a case some two years back where a one guy had a girlfriend and used to send her money to buy a plot. Unfortunately the lady bought for herself and constructed. Later she got married to a different person denying the old BF rights to the land. Evidence came from the transactions made to the account of the lady and those were related to purchase agreement of the land. Later it was proved that the very same money was used to buy and construct the building. There justice could be made and the girl agreed. So I think you didn't rain the money to your friend but used formal ways of transferring money with instructions. These will assist you. Up to here I end for now.
 
Actually thank u fisi 2 for ur advice i shouldnt direct only to learned'...ni kweli u may consider the formal ways of trnsfering money but what about transactions za mara kwa mara (not for buying of the plot) radher for other purposes haziezi kupoteza ushahidi wa utumaji wa hizi pesa?
 
kwa mjibu wa sheria "Y"ndo ataonekana mmiliki kamili wa hicho kiwanja kwa sababu yy ndo aliingia mkataba katika kununua kiwanja na documents zote za iyo transactions zimeandikwa jina lake so itakuwa ngumu kwa huyo X kuithibitishia mahakama kuwa yy ndo alinunua hicho kiwanja.

hivyo basi huyo X apambane tu arudishiwe hela yake na uyo y kwa kumfungulia kesi ya utapeli uyo Y, so inabidi aandae zile risiti zote ambazo alikuwa anamtumia hela ambazo zitakuwa kama ni ushahidi kwake yani huyo X.
