Mahakama yawapiga ‘stop’ Azam TV kuonesha ligi kuu Uganda

Ule mgogoro wa Azam TV na SuperSport kuhusu haki za matangazo ya televisheni ya Ligi Kuu ya Uganda (UPL), bado unaendelea na safari hii umetinga mahakamani.

Amri ya mahakama kusitisha matangazo yoyote ya moja kwa moja na kurekodi kwa televisheni ya UPL imetoka ikiwahusu Azam TV walionunua haki za matangazo ya ligi hiyo wiki iliyopita.

Taarifa iliyochapwa kwenye mtandao rasmi wa Shirikisho la Soka la Uganda (FUFA) imeeleza kuwa hatua hiyo ni kutokana na amri ya Mahakama Kuu ya Uganda iliyotolewa Ijumaa 13 Februari 2015 ikieleza kuwa ligi hiyo haipaswi kutangazwa moja kwa moja wala kurekodiwa na kituo chochote cha Tv hadi Jumanne 3 Machi 2015.

HAKUNA TV KUREKODI

Ili kutomaliza utamu, soma mwenye taarifa hiyo hapo chini ya FUFA:-

"On 13th February and 16th February 2015, the matter came before civil court and the decision has been made to extend the hearing and subsequent restrictive order to Tuesday, 3rd March 2015. Basing on that, and in consideration of the consequences that may arise, all stake holders are hereby informed that no Television recording and relaying of live match broadcast should be made during the period up to 3rd March 2015 when a court decision is made on the matter,


The UPL secretariat, UPL Clubs and match officials are instructed NOT to allow Television recording and broadcast. However, the fixture and matches will be played as scheduled, since the court order does not stop in any way the playing of these matches accordingly."

Taarifa hiyo imesainiwa na Ofisa Mtendaji Mkuu (CEO) wa FUFA, Edgar Watson.

Mzunguko wa pili wa UPL ulianza jana Jumanne 17 Februari 2015 bila ligi hiyo kuonekana kwenye Tv na kusikika moja kwa moja kwenye redio.

Azam TV walionunua haki za matangazo ya TV ya Ligi Kuu Tanzania Bara kwa Sh. bilioni 5.5, waliinunua pia UPL kwa mabilioni ya fedha siku chache zilizopita.

Azam TV gets clearance to broadcast UPL games

KAMPALA. Tanzania-based pay television company, Azam, in conjunction with Fufa, is now at liberty to commence telecasting the Uganda Premier League (UPL) football matches.

This follows yesterday's High Court ruling that threw out an application filed by Uganda Super League (USL) in which it had sought for a protection order from court while it pursued an arbitration process as a remedy to a broadcast rights dispute.

Azam have been fighting to wrestle the soccer league broadcast rights from South African company, SuperSport, who signed a contract with USL in 2011.

In his one hour ruling, presiding judge Yasin Nyanzi held that since Fufa had already terminated the contract it had with USL that mandated SuperSport to telecast the local matches, there was no status quo for court to preserve by granting a protection order as prayed for by USL.



"The applicant (USL) seeks an order of this court to stop the termination of the contract; the termination which has already occurred…" ruled Justice Nyanzi, adding: "a protection order in this case serves no purpose because the applicant has failed to establish his case in the first and most important test."

"To issue an interim order, there must be a status-quo to protect and here there is none. In the result, I dismiss the application and I award costs to the respondent."

Alternatively, Justice Nyanzi in his ruling, suggested to USL to pursue arbitration mechanisms in resolving this impasse since their prayer for the protection order they had sought had failed as there was nothing to preserve.



Pay damages
The court also ordered USL to foot all the legal costs that Fufa incurred in defending this case. Fufa legal counsel Alex Luganda was a relieved man after the ruling.

"Azam can go ahead to televise the Uganda Premier League matches after the interim court injunction was lifted," he told the Fufa website.

Express versus SC Villa will be the first match to be televised at Wankulukuku tomorrow.

USL board chairman Kavuma Kabenge said they are filing the main suit. "We are filing a fully-fledged suit tomorrow (today) as advised by the Judge who - in his wisdom - has ruled that the status quo has since changed, thus dismissing our application seeking protection of our partner's (SuperSport) rights.

"Since the respondent has voluntarily failed to submit to arbitration, we are now filing a suit asking court to compel them to submit."
The never-ending woes between USL and Fufa resumed early this year when the former dragged the latter to court for terminating a contract, on grounds that SuperSport had failed to telecast football matches.

To that effect, the termination of the MoU that Fufa had with USL saw the unveiling of Azam TV to telecast the matches, a move that did not go well with SuperSport, who argued that its contract was still on until the end of 2016.

The same court had earlier granted USL an interim order blocking Azam TV from commencing the telecast but the grace period of 30 days elapsed.
