Msaada kuhusu sheria za kazi




Naona kama mambo yanachanganywa. Kuna waajiri wanaolipa mshahara wa mwezi mmoja mtumishi anapokwenda likizo, wengine wanalipia nauli n.k.

Ila suala ni palae mtu anapokuwa analipia nauli halafu mtu analala njiani siku tatu. Anastahili posho ya kula/kulala?
 
Kama mwajiri wako yuko fair na anajua kuwa unatakiwa kulala siku 3 njiani ni lazima akulipie. Kila baada ya saa 6 unatakiwa kulipwa transit allowance ambayo ni nusu night. Inalipwa kwa kila mtu awe Mke/Mume/ mtoto au mtegemezi wote wanastahili kuwa paid
 

Kwa nini ni lazima akulipie wakati uko kwenye safari isiyo ya kikazi? Na kazi ya mshahara wako ni nini sasa kama hadi safari za mambo yako binafsi zitalipiwa na mwajiri wako?
 
Hivi kila ajira bongo ni ya mkataba?

Sheria inamtambua mfanyakazi hata asiye na mkataba wa maandishi....mfano wale waliokuwa wanaitwa casual labourers ambao sasa wanaitwa special task kama sikosei,wengi hawana mikataba lakini serikali inawatambua na wao wana haki kama wafanyakazi wengine wowote.....nakumbuka kuwa na kesi ambayo mfanyakazi hakuwa na barua ya mwajiri wala mkataba wa kazi lakini akawa anadai mafao yake(excluding NSSF),tofauti na matarajio ya wengi hata makubaliano ya mdomo(ambayo ni ngumu kuthibitishwa yana maana kubwa kisheria)....at last ilibidi alipwe kama mfanyakazi mwingine...severence pay,nauli yake na wale wanaomtegemea,mshahara wa mwezi,unapaid leave na mwisho certificate....alikosa NSSF kwa kuwa hakuwa registered huko(kosa la employer) na hakuwahi kupewa barua ya mwajiri!!! Nachukia sana Employment and Labour Relation Act,inasumbua!
 
Mkuu nirudi hapo kwenye kifungu cha 43 ya ELRA, bado mwajiri anatakiwa kisheria kutekeleza kati ya hizo options tatu kama amekatisha makataba na mwajiriwa for gross misconduct?

NDIO,asicholipwa kwa case ya misconduct ni severence(kiinua mgongo),mengine yote ni haki yake.
 

Ndoa kuna vyeti....kama huna cheti ni ngumu....Leave ziko kila mwaka,so kama kalipwa ya mwaka huu,hatalipwa tena ya mwaka huu labda ya mwakani kama bado atakuwa mwajiriwa....kuhusu posho ya kujikimu,sijaona sehemu sheria inataka iwe hivyo,anacholipwa ni nauli ambayo ina utata....kuna wengine wanalipwa kutokana na place of domicile,wengine walipokuwa recruited na wengine ambapo wamekuwa wakienda leave/vacation mara kwa mara....!
