Nina kesi ya ardhi ambayo imekuwa under litigation for 24 years. In the primary court, I won. On appeal, I lost and at the High Court, I won my appeal. My opponent on application for leave to appeal to the Court of appeal on point of law the high Court certified on point of law and his application was granted.

My concern: Now it is one years since he was granted leave to appeal to the CA and no notice of appeal has been lodged to the High court or any proceedings as required by law.

I want this litigation to come to an end since the CA is the final court.

Please advise how can I push for this delay on the other party to?
 
Kama alishapata leave kwenda CA na haja-lodge Notice of Appeal and you are certain that he is out of time, may be he has lost interest to persue the matter baada ya kuona bado safari ni ndefu. so you write a letter to the Registrar of the High court( CC huko primary court) ukiomba remittance of the case file to Primary court for execution purposes. Hakikisha unnafuatilia kwa karibu i mean unavyopeleka hiyo nakla ya barua P/court make sure unamuona mhe. Hakimu mfawidhi ili kupe maelekezo maana process ya execution huko primary court mpaka iwe issued na mkuu wa Wilaya akimuelekeza afisa mtendaji wa kijiji sijui/kata akabidhi eneo, ni kama kuna siasa flani hapo depending on who are the parties to the case.
 


Duh! Nimetoka kapa hapo....Kizungu kigumu kweli! Jaribu kurahisisha kidogo basi na sie ambao si wasomi tukuelewe.
 
Nashukuru kwa ushauri. Shamba bishaniwa nalikalia mimi baada ya kushinda High court. Nina wasiwasi ataomba extension of time to lodge notice of appeal out of time, ambayo itampa kibali cha kuomba leave of the court to lodge an appeal. Sijui atatoa sufficient reasons zipi lakini kuna uwezekano wakamkubalia. Kama anadelay hivyo, nitamzuiaje asifanye haya hapa juu.
 

shamba husika unalikalia wewe. je ulikabidhiwa kwa kufuata utaratibu? kama hukufuata utaratibu ni vema ukafuata execution procedures ili iwe on record that handing over of the property in dispute imefanywa na mamlaka husika.
kwanini unakuwa na wasiwasi na mambo ambayo hayajafanyika, either way ni haki yake kisheria huwezi kumzuia and it is untill then utajua cha kufanya.

Na ndio maana nakusisitiza ufanye execution to be on a safe side. Na uwahi kabla yeye hajapeleka maombi ya stay of execution. unajua litigation hapa bongo asilimia kubwa ni kuviziana na wewe ndo unachotaka kufaya badala ya kutumia right procedures available to you.
