Nairobi Senator Mike Mbuvi alias Sonko wants senators James Orengo, Johnstone Muthama, Otieno Kajwang, Elizabeth Ongoro and politician Reuben Ndolo cited for contempt of court. Mbuvi accuses the Coalition for Reform and Democracy ( CORD) politicians of disobeying court orders issued on July 4 and 7 this year that required them to maintain peace and refrain from making inflammatory remarks during the Saba Saba rally.

The matter was certified as urgent by High Court Judge Justice Isaac Lenaola who directed that it be heard on Monday. In his suit, Sonko also wants Orengo (Siaya), Muthama (Machakos), Kajwang (Homa Bay), Ongoro (Nominated) and Ndolo committed to prison for a period not exceeding six months for disobeying the said orders. He noted that Justice Lenaola had directed CORD leaders to exercise their rights to assembly peacefully during the Saba Saba rally.

The court, he said, required the politicians to assemble peacefully without being armed and without uttering inciting, inflammatory or defamatory remarks. “They uttered defamatory statements during the public meeting held at Uhuru Park on July 7 in contravention of the court orders. He attached transcripts of alleged defamatory statements made by each politician detailing what each said “to incite the crowd”.

The High Court has directed Nairobi Senator Gideon Mbuvi alias Sonko to personally serve four CORD senators with contempt proceedings he has filed against them.

Justice Isaac Lenaola directed him to do so before further directions in the matter can be given.He ordered Sonko to personally effect service of the suit papers on senators James Orengo, Otieno Kajwang’, Elizabeth Ongoro, Jonhstone Muthama and former Makadara MP Reuben Ndolo.

Lenaola stated that he will hear the contempt proceedings after he delivers a ruling of a case in which the Senator is seeking to set aside consent orders stopping the CORD coalition from holding mass action rallies on August 26.

Sonko wants the four politicians committed to civil jail claiming that they uttered defamatory remarks during the Saba Saba rally at Uhuru Park despite a court order restraining them.

“It is in the interest of justice that I am seeking these orders and on the basis that these politicians wilfully defied court orders,” he stated.

The controversial Nairobi politician claims he has video clips to prove the CORD leaders uttered defamatory rhetoric against President Uhuru Kenyatta and his deputy William Ruto.

The Senator insists that The High Court allowed the CORD leaders to exercise their constitutional right to assemble peacefully without being armed in any manner and without uttering incitement, inflammatory or defamatory remarks. -Capital FM News
