mimi naomba kuuliza kama kuna applicability ya 'Double Jeopardy' kwa sheria za nchi yetu. Yaani kwa mfano,lets say mtu alikutwa na hatia katika kesi ya mauaji na kuhukumiwa maisha ( in real sense the evidence was fabricated, therefore he is innocent). mtu huyo akaserve sentence yake kwa miaka kadhaa na akabahatika kupunguziwa kifungo hatimaye kutoka kwa msamaha wa rais. Je, kama ikatokea akakutana tena na huyo mtu aliyezushiwa kumuua, na kwa sasa akacommit murder kiukweli je atahukumiwa tena kwa kosa ambalo alisha serve sentence? As per US fifth ammendment of constitution, this is what it says:
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of aGrand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
