New administration under Samia Suluhu gives hope after 5 years of hopelessness

Hawa wanapanga bei ya kutuumiza hakuna ushindani. Vinginevyo timuatimua EWURA ifanyike mara moja maana tusipojipanga kwenye hili vurugu zinanukia kutokana na ugumu wa maisha.


Kama wachina na wahindi wananunua mafuta direct kutoka urusi sisi tunashindwa nini?

Wao tena wamepewa punguzo la $30 kwa kila pipa kutoka kwenye bei ya mafuta ya soko la dunia.

Punguzo la $30 tajwa ni ahueni tosha kama waziri husika hawezi hili atupiwe virago vyake chapuchapu ili apate muda tosha wa kugombania tiketi ya CCM 2030....

This decision is controversial because nowhere in precedents urge Magistrates to apply them before making decisions in criminal cases.

Does it make sense for the High Court to overlook the evidence deponed by the victims and channel their grievances to the Magistrates? Is that real justice or abdication of the rule of law and jurisprudence as we know it?


Our beef is in absence of superior court precedents should the lower courts Magistrates acquit guilty verdicts solely on its wanting despite overwhelming evidence to the contrary?


Another legal landmine is where in precedents lower courts are required to seek guidance from superior court decisions?

What are subsequent ramifications?


OUR TAKE

The High Court reasoning is absolutely egregious and has no basis in law and the DPP office ought to appeal even if it means for future direction on similar judicial quagmire lest this decision prompt a manoeuvre for lower courts to deliberately abstain from citing precedents in order to get potentially convicted criminals off the hook unleashing injustices on the victims and the trust of the society to the judiciary.

The consequences of accepting this decision are to say the least grave with long-term costs to he rule of law...

What we now see is a rampant abuse of public office nowhere else but in parliament, of all institutions of governance! Shameful!


OUR TAKE

Wherever and whenever Parliament encroaches on the jurisdiction of the High Court it is violations of the doctrine of separation of powers between the Bench and the House.

If CDM are an aggrieved party to how the Covid-19 got their parliamentary windfalls they must lodge their complaint with the High Court and stop seeking the intervention of the Parliament which has no such a jurisdiction.
 
The decision of quasi judicial bodies such as political parties have no legal authority to upend constitutional articles such election of MPs until those decisions are registered in a court of law.

So, taking decisions of CDM and expect them to be treated as court orders are to say the least looney.
