The chaos in the nominations was on Saturday laid bare when aspirants appeared before the disputes resolution panel of the electoral body.

The aspirants told the panel made up of commissioners from the Independent Electoral and Boundaries Commission, that there was rampant violence, bribery, ballot stuffing, attacks on election officials, and cases where the poll losers were declared winners.

The complaints against election officials of the political parties came from all levels where the party nominations were held. There were those who told the panel that they won the polls, yet when they went to the head office of their respective political parties, the party refused to issue them with a certificate.

"Some people voted multiple times. Because there was no party list and no IEBC list to check who was voting, people voted and went back to the line, to vote again. They voted in circles as many times as possible," said Mr Eric Ochanda, an aspirant for the Makongeni county representative seat in Nairobi.

One governorship aspirant from Elgeyo Marakwet County said that although his party, Kanu, had assured him of a direct nomination, because he was the only candidate, the party short changed him when it issued a certificate to a "defector from United Republican Party", who had come second in the URP primaries.

Immigration minister Otieno Kajwang' yesterday faced off with a voter over his qualification to vie as Senator for Homa Bay County.

The voter, Mr Edward Ochieng', told the dispute resolution panel that Mr Kajwang' had been struck off the advocates' roll in Kenya because of "integrity issues", and therefore, under the Leadership and Integrity chapter in the Constitution, was not fit to run for public office.

Speaking through a lawyer, the voter said the nomination certificate issued to Mr Kajwang' by ODM had to be withdrawn.

However, Mr Kajwang', through his lawyer Assa Nyakundi, told the panel that he had been reinstated in the Law Society of Kenya list of advocates. He said the ban on his legal practice in the country had also been lifted. That was done in July, 2012.

"I have a constitutional right to vote and to offer myself for election. You cannot take away that right, unless you go to the High Court and satisfy that court that I don't meet the requirements of leadership and integrity as prescribed in the Constitution and in the Act of Parliament on that matter," Mr Kajwang' told the panel when he was asked to respond.

"There was an election. I participated in the election. I was declared the winner. The party has the results," the minister told the IEBC panel.

ODM's lawyer Jotham Arwa said while the party's constitution provided for universal suffrage when it comes to picking candidates, it had a right, under the law to select a candidate.

Former permanent secretary James Nyikal had a hard time explaining to the commission how he got ODM's parliamentary nod for Seme constituency, yet the ballot papers were burned, and the results of the nominations were never announced.

Mr Victor Ogenga told the IEBC panel that as at the last count, he was in the lead. He said after the announcement, youths stormed the polling centre and burned the ballot papers to stop any possibility of a recount.

With that, ODM decided to issue the certificate to Dr Nyikal.

The panel chairman, Mr Thomas Letangule, asked Dr Nyikal if he was declared the winner by the returning officers.

"There were no results. I was given the certificate in that election. Nobody knows who caused the violence because it is the crowds that caused the disruption," said Dr Nyikal.

The former PS denied accusations that his supporters had raided the polling station. He said it was impossible to attribute mob violence to one person.

"I had nothing to do with the violence," Dr Nyikal added.

Mr Arwa said the party issued the certificate to Dr Nyikal because it could not determine who had won.

"There were no primaries held and therefore there was no way of knowing who would have won. The matter was referred to the party's National Election Board which undertook a direct nomination. This was a decision which was taken by the party at the highest level," said Mr Arwa.

He said that any queries should be referred to ODM's National Election Board. The IEBC panel comprised commissioners Thomas Letangule, Mr Yusuf Nzibo, Mr Mohammed Alawi, Ms Kule Galma Godhana, and Ms Betty Nyabuto. The hearings took place at the Milimani Law Courts in Nairobi. Yesterday was Day Three of the hearings.

Mr Cyprian Awiti and Mr Philip Okundi, both who wanted the ODM ticket for Homa Bay governor also came before the panel to settle their scores.

Mr Okundi said there were elections, but because of violence in some of the polling stations, the results were cancelled. He added that the returning officer decided to announce him the winner.

"The returning officers from the constituencies met, and by consensus agreed that I should be given the certificate because I had strong support in areas where the election was marred by violence," said Mr Onkundi.

But ODM issued the certificate to Mr Awiti.

"Somehow my name was deleted from the final list of the party," said Mr Okundi.

Mr Awiti, who sat in the courtroom, occasionally patting Mr Okundi's back, said there was a signed sheet of the results, showing that he (Mr Awiti) had won the elections in Homa Bay, and that was why ODM had issued him with the party's certificate.

"Mr Onkundi is a friend of mine. He is a honourable man. He should accept defeat. Even if we go back to the ballot today, and Mr Onkundi knows this very well, he cannot defeat me," Mr Awiti told the IEBC panel.

The IEBC will rule on the petitions on Monday.

Siaya, Kenya: Businessman William Oduol who was disqualified in the ODM nominations for Siaya gubenatorial seat has been granted another party's ticket.

Oduol is among aspirants from Nyanza, locked out by ODM, who have secured the National Agenda Party of Kenya (NAP-K) ticket come March 4 General Elections.

Oduol and Prime Minister Raila Odinga's brother Oburu Oginga were disqualified by ODM Elections Board due to the fiasco that marred their contest during the primaries.

Oburu was later announced winner of the nominations a decision that Oduol contested claiming that he was the winner.

Oduol claimed that he had been robbed victory by the returning officer who announced Oburu as the winner of the nominations.

He questioned why the returning officer disappeared only to resurface in Bondo, Oburu's backyard, to announce the latter as the winner.

Following the controversy in the nominations, the Board's Chairman Franklin Bett disqualified the duo and handed ODM ticket to Colonel Rasanga.

Oduol contested the move but Oburu welcomed it saying he would support the party.

On Sunday, NAP-K national chairman Alfayo Agufana confirmed that he had handed Oduol a direct ticket to contest for the governor seat.

"Oduol has the NAP-K ticket and he is the party's candidate for the Siaya Governor's seat," said Mr Agufana.

Contacted, Oduol confirmed that he was in the race for the governor's seat on the NAP-K ticket.

"I have the NAP-K ticket but I don't want to give further detail about this matter because it is still being handled at the party's level," he added.

He added: "I want to assure my supporters that I have not pulled out of the race. I appreciate the support they gave me although I was robbed victory and plead with them to support me at the ballot".

Agufana said that his party was not supporting any presidential candidate.
He added that candidates who have secured NAP-K tickets were free to support presidential candidates of their choice.

Another aspirant granted the party's ticket is Gilbert Warm who would be challenging Lands Minister James Orengo for the Siaya Senatorial seat.

Agufana noted that NAP-K has fielded 50 parliamentary aspirants, two governor candidates and three women representatives alongside 170 county representatives in the General Elections.

Mr William Oduol has decamped from ODM and gets National Agenda Party of Kenya (Nap-K) ticket to vie for Siaya County Governor seat.Mr Oduol's move follows the botched ODM primaries at the county, which subsequently led to cancellation of the results by the party's National Executive Board.He was the key rival to immediate former Bondo MP Oburu Oginga.

Mr Oduol said he was issued a certificate by Nap-K on January 18, and therefore he did not expect to be disqualified by the Independent Electoral and Boundaries Commission (IEBC).

"I would like to thank the people of Siaya for coming out during the primaries and voting peacefully. I would also like to thank the whole country for staying steadfast with me especially after the primaries. We all saw what happened and Kenyans know my victory was taken away from me, but the good news is that we shall be at the ballot on March 4," he said.

He said he is not bothered by perceptions that ODM was the party to watch in the region, saying that voters in Siaya are well informed and will vote according to what a leader has to offer, rather than according to party affiliations. However, he was quick to add that he still supports Prime Minister Raila Odinga's bid for presidency.

His lawyer, Mr Dismas Odhiambo Wakla, raised concern over his security and that of his client.According to Mr Wakla, he was threatened through a phone call made to him from a concealed number on Saturday.

"A male voice addressed me and said, ‘Wakla, you are our man. Leave Oduol alone or you will not finish his case'," he said, adding that he would report the matter to the police.

He called on security agencies to offer his client and himself maximum security, and the Law Society of Kenya to keep vigil on its members who are representing politicians.

He also said the IEBC has failed to upload Nap-K's nominees list despite fulfilling all requirements, and threatened to take the matter to court on Monday if it will not have been uploaded by 9am.

The party's national chairman Alfayo Alfonze Agufana said Nap-K is not affiliated to any coalition and does not support any presidential candidate.

Mr Agufana said all aspirants vying through the party's ticket are free to campaign for any presidential candidate that they prefer.

ODM heavyweights risk losing tickets

KENYA: Some politicians in Nyanza Province could lose their ODM nomination tickets if Independent Electoral and Boundaries Commission (IEBC) rules against the party for handing them nomination certificates.

Immigration Minister Otieno Kajwang' could lose the ODM Homa Bay senate ticket if the Disputes and Resolution Panel rules against him.

Others whose fate will be determined by the panel's decision today include ODM Chief Whip Jakoyo Midiwo, immediate former Alego Usonga MP Edwin Yinda, former PS James Nyikal, former LSK chairman Okong'o Omogeni and former Marie Stopes Director Cyprian Awiti.

Mr Kajwang' faced a voter at the tribunal who argued the minister was struck off the Law Society of Kenya membership over integrity issues hence ineligible to contest.

Define integrity

The immediate former Mbita MP, however, defended himself stating that he had been reinstated to LSK mid last year, adding that the meaning of integrity should be clearly stated.

Mr Midiwo, the immediate former Gem MP, would lose his certificate to Elisha Odhiambo, who was reportedly declared the winner after the January 17 primaries.
Mr Odhiambo has persistently indicated that he won the contest, although the party's National Election Board decided to give Jakoyo the nomination certificate.

Mr Yinda would lose candidature for Alego Usonga parliamentary seat if his challenger Omondi Mulwan succeeds in his petition.

The former MP reportedly came third in the duel, after Mr Mulwan and businessman Odunga Mamba, but ODM forwarded his name to IEBC.

In the Homa Bay gubernatorial seat, former CCK chairman Philip Okundi challenged the candidature of Owiti.

Mr Okundi said there were no elections in many areas. However, his political foe said he won the primaries. In Nyamira county, Omogeni's senate candidature will be determined today, after long serving Kitutu Masaba MP Abuya Abuya filed a complaint against him.

Mr Abuya said he trounced Omogeni and did not understand why the party gave the ticket to the former LSK chairman.

But NEB chairman Franklin Bett defended the decision.

UDF aspirant plans court case

• A parliamentary aspirant has vowed to move to court to stop IEBC from processing the UDF nomination list
• Geoffrey Obwoge said he was given the nomination certificate for the Rongai parliamentary seat, but the party submitted the details of John Kitilit to IEBC
• Obwoge is a UDF member, number 111179 and was given certificate number 0095.
