The Supreme Court in rejecting the 900 page affidavit and annexes of 6 affidavits, clearly indicated that it had the discretion to admit any complementary evidence if it was reasonably small on its own merit. However, the court found it unreasonable to admit such a massive affidavit being filed without it's leave and out of time and allowing respondents no time at all to review and respond. What my LSK Chair is not kind enough to disclose is that this affidavit was technically introducing additional new evidence by way of affidavits covering 122 electoral areas and quite importantly, the leave of the court was being sought after the fact and reluctantly. It's that level of arrogance and disrespect that agitated both the bar and the bench, such that the evidence was expunged from court records. Had this evidence been so critical to CORD's cause, it should have been filed on time.
