MAJOR BILL HIGHLIGHTS


  1. Clause 4 grants exclusivity to the National Land Commission (NLC). Defines the specific roles of National Government and the NLC in managing land registries, processes and dispositions.
  2. Clause 5 gives rights to communities where natural resources are extracted. They should get a share in the income.
  3. Clause 7 wants parties to ascertain contents of elections register and allow omitted individuals to seek redress. Independent Electoral and Boundaries Commission (IEBC) to maintain one single register.
  4. Clause 12 IEBC commissioners be nominated and appointed by political parties based on numerical strength of parties in parliament in previous election results.
  5. Clause 13 wants county governments to file quarterly reports with Senate to show expenditure.
  6. Clause 16 outlines procedures for elections dispute resolution.
  7. Clause 17 outlines procedure for appointing Chief Justice (CJ) and deputy by Judicial Service Commission (JSC). Powers taken away from president and executive.
  8. Clause 19 wants judges to be appointed without executive involvement. This is to maintain JSC independence.
  9. Clause 20 wants minimum allocation of funds to counties enhanced from 15 per cent to 45 per cent.
  10. Clause 23 wants no more than 15 per cent public service appointments to be from one ethnic community. This is to ensure effective ethnic representation.

They are only doing this because they are not in power. There's nothing good in that bill except clause 13. Everything else is political noise. Now worth the political heat that will be generated. We are working towards getting a 10% growth rate. With this political noise, the figures may go to 4%. Just check the country's history on Election.

It looks OK apart from clause 23. You cant regulate creativity/enterprise/innovation. If all the best pilots are from Pokot, we should give them all the damn jobs at KQ, full stop! I definitely wont feel safer if a half baked pilot from my tribe is in charge of my flight. Finally, we need to do away with this notion that you have to be in power to bring change. Thats backward thinking, if the changes are good and will benefit all, lets make them irrespective of who pushes for them.
 

Problem is political rhetorics with which they will use to sell it to mwananchi, that will obviously divide us along those feared lines. But personally, I've no problem with any of the proposals, they sound good.
 
Those changes are useless. What business do political parties have in nominating IEBC Commissioners? Would they say the same thing if Jubilee had 99% of the MPs. These guys don't have anything to offer. Ni tension na relevance wanataka. If they win 2017, well and good. I'll still not want a referendum. It's a waste of time and money.
 

Some people can't think. So what will happen if one tribe accounts for 50% of the population? This is just populist politics with the same old useless Ideas.
 
Look at the issues and ignore the side shows. How hard can that be??

The little that has been mentioned does not guarantee independence of the judiciary. The courts ruled that CDF is not constitutional and Parliament responded by cutting funding to the judiciary when all sectors were getting 20% increase in funding they got a cut from 16bil to 15.7bil.

But chances of this amendment by popular initiative being a rhetoric exercise is quite high otherwise someone would have already ran away with it.
