TNA aspirant Josiah Ole Kores was first turned away after his nomination papers were rejected. He hopped onto a chopper and fetched the right documents. He managed to present these to the IEBC.

In Summary


  • Firm printing ballot papers had not yet started working on Kajiado County.
  • Mr Kores misled the returning officer by presenting a letter dated September 11, 2012 by the CHE which stated that Universidad Impresarial de Costa Rica was an accredited university, but the letter was irrelevant to election issues as it did not deal with recognition matters.
  • It was unethical for IEBC's chief executive James Oswago to write to the returning officer purporting to have clear Mr Kores to be registered to contest the seat.

The electoral commission has said it will enforce a court order that nullified the nomination certificate of a TNA governorship candidate.


IEBC chairman Ahmed Issack Hassan said that the commission had contacted the suppliers of the ballot papers for the March 4 General Election and instructed them to amend the list by deleting Mr Josiah Taraiya ole Kores' name from the Kajiado County gubernatorial race.

"Luckily we found that the contracted company printing the ballot papers had not started working on the ballot papers for Kajiado County. With this we will now be able to enforce the court order firmly," Mr Hassan said.

A three-judge bench of David Majanja, Eric Ogola and George Odunga dealt a blow to TNA after ruling that Mr Kores did not have recognized academic papers to contest the seat.

The judges quashed the IEBC nomination certificate issued to Mr Kores on February 1 and directed the area's returning officer to reconsider whether to accept or reject Mr Kores' TNA nomination papers based on the recommendation of the Commission for Higher Education (CHE).

"Mr Kores failed to disclose to the returning officer a letter from CHE which said it did not recognize his Bachelor of Business Administration degree from Universidad Impresarial de Costa Rica and we therefore quash the certificate issued to him by the returning officer," ruled the judges.

CHE had on January 22 written to Mr Kores saying they did not recognise his degree obtained at the Digital Advisory Learning Centre (DALC) since the commission had not granted authority to the institution to collaborate with Universidad Impresarial de Costa Rica in awarding degree certificates.

The judges ruled that it appeared the returning officer did not have the CHE letter when he made the decision to accept Mr Kores' nomination papers declaring him duly nominated.

The petition was filed by Mr Musa Tipape Naini and the Kajiado County Youth Alliance claiming that he did not have the requisite qualifications to contest the governorship position.

Mr Kores in defence argued that the Elections Act only required a governorship aspirant to have a degree certificate from a recognized institution and the matter of verification of the degree certificate did not apply.

In response, CHE said that they refused to recognize and equate the degree Mr Kores obtained on grounds that they had not approved the collaboration between DALC and the Costa Rican University.

Meanwhile, Kisumu High Court judge Hillary Chemitei dismissed an application seeking to transfer the hearing of a nomination dispute from the local law courts to Nairobi.

The application was made by lawyer Charles Kanjama representing Mr Joseph Maguanga in an ODM Kasipul Constituency nomination dispute filed by Mr Sam Okoth.

Mr Kanjama argued that the case would best be heard by the three-judge bench in Nairobi.

In his ruling, Mr Justice Chemitei said there was little time to transfer the case and he would on Monday next week give directions on five nomination disputes before his court.

He is expected to rule on whether his court has powers to arbitrate over the disputes.

IEBC lawyer Eric Gumbo challenged the eligibility of the court deliberating on the matters, saying only IEBC had constitutional jurisdiction to rule on primaries disputes.
