Kenya's ruling party to finally control Nairobi county
Kenya's ruling party Jubilee now has full control of the capital Nairobi after its candidate Mike Mbuvi Sonko won the race for governor.

Mr Sonko, who was the Nairobi senator, beat incumbent Evans Kidero in the elections. The win for the ruling party means it will now fully control the seat of central government, and the industrial and commercial capital city.

The Jubilee administration had established the Nairobi Metropolitan Area Transport Authority, whose mandate will be to ease traffic jams in Nairobi and the satellite towns. The authority, which will be under the central government, seeks to perform some of the core functions of the Nairobi County.

“The authority will be tasked with establishing a mass transport system, commuter services and the public transport within Nairobi metropolis,” former Transport Principal Secretary Irungu Nyakera said.

In February, President Uhuru Kenyatta accused Nairobi governor Evans Kidero of failing to work for the city residents and frustrating his government’s efforts to improve the city’s infrastructure.

“Kidero has failed Nairobi residents. Jubilee has many qualified leaders to replace him. Governors control enormous resources but Nairobi has little to show for it. You know the Nairobi government you elected. What has it done? Tell me,” Mr Kenyatta posed.

Mr Sonko’s deputy governor-elect, Polycarp Igathe, a former chairman of the Kenya Private Sector Alliance, will be keenly watched as he was touted to be the ultimate chief executive of the city, as the governor plays a political role.

The private sector players, who had complained during Dr Kidero’s term of inefficiencies in doing business within Nairobi, will now hope that they have a man who intimately understands their concerns and will address them.

The proposed Constitution of Kenya (Amendment) Bill authored by outgoing deputy Senate Speaker Kembi Gitura vouched for the creation of a national capital city known as Nairobi, to be the seat of the national government.

“The president will be empowered by law to nominate a Cabinet Secretary, with the approval of the National Assembly, to head the city. The CS will be in charge of the affairs of the city and report to the president.”

Amend Constitution

In December last year, the Jubilee administration proposed amending the Constitution to have the capital city run like Kampala, which was taken over by the central government six years ago.

The proposed law would have effectively knocked out the current devolved system, which has a Country Assembly. Instead, the city’s residents will be represented in the National Assembly through their constituencies.

While defending the bill, Mr Gitura told The EastAfrican that the proposal was alive to the power of the people and their right to representation.

Outside of the city, the Jubilee administration will also boast control of the Council of Governors after its party won 25 seats in the county leadership table out of the 47 seats.

The Opposition will take 18 counties, while two are in independent candidates’ hands.

It is also interesting that out of the 47 governors during the first term, only 22 are set to retain their seats after this year’s elections.

Kenya's Jubilee Party will have unfettered control over both the National Assembly and Senate, which will see it push through its legislative agenda, including amendments to sections of the Constitution that require a two-thirds majority.

As of Friday, Jubilee had 194 MPs out of 337 in the National Assembly and the number could rise as the country awaits the Independent Electoral and Boundaries Commission (IEBC) to gazette the names of nominated MPs, where Jubilee will claim the lion’s share of the available 12 slots.

In addition, the party will also enjoy the support of independent MPs, who insiders say, could be offered slots in parliamentary committees to entice them to back Jubilee.

In the Senate, Jubilee claimed 27 out of 47 available and is assured of more nominated senator slots, based on its performance in this election.

Political Parties Fund

Combined with the privileges it will enjoy from the State as the ruling party, Jubilee Party will also get the lion’s share of the Political Parties Fund, which is usually allocated based on parties’ strength in parliament.

The law requires the government to allocate at least 0.3 per cent of the national budget every financial year to the Political Parties Fund. Parties must have 20 elected members of the National Assembly, three elected senators, three elected governors and 40 members of County Assemblies to qualify for funding.

The first agenda in the Houses will be election of speakers, a fight Jubilee will engage in with an upper hand, though if need be, will have to lobby a few Members of Parliament to get a two-thirds majority win in the first round, if its numbers are below 232.

Gender rule

This means that getting a two-thirds majority in passing crucial Bills that could change the Constitution will be an easy task when the 12th Parliament convenes.

Its inability to marshal two-thirds majority in the last parliament made it difficult for the ruling party to pass a gender rule, which could have seen the next parliament strike a deal to see more women in parliament.

While President Kenyatta controlled the majority in the National Assembly with a combined force of 167 MPs, the opposition had 130 MPs, with the rest going to small parties that later teamed up with the ruling party.

This “tyranny of numbers” helped the Jubilee government push through its agenda in the 11th Parliament, including amendments to crucial electoral laws despite protests from a numerically weak opposition. Some of the laws, however, were declared by the courts to be unconstitutional.

However, in the just-concluded elections, the number of opposition MPs has dropped significantly. It is also likely that Jubilee will work with those elected on friendly parties like Maendeleo Chap Chap and the independents.

Jubilee trounced the opposition parties in regions where internal competition among affiliates of the National Super Alliance (Nasa) split the votes.

For instance, Jubilee Party won nine seats in western Kenya, perceived to be an opposition stronghold due to internal competition between affiliates Orange Democratic Movement, Amani National Congress and Ford Kenya.

Jubilee increased its numbers in parliament courtesy of the inroads it made in Nasa’s strongholds like Kakamega (four), Bungoma (four), Kisii (two), Nyamira (two) and Migori (two).

The ruling party campaigns in Machakos and Kitui counties, the strongholds of Wiper Democratic Movement, headed by Kalonzo Musyoka, Mr Raila Odinga’s running mate bore fruit after winning three seats — Machakos Town, Kitui East and Kitui South constituencies.

A weak opposition in parliament will expose the country to bogus laws and skewed appointment of key government officials who only need endorsement by MPs in order to assume office.

According to the Constitution, parliament vets senior government officials, among them Cabinet Secretaries, Principal Secretaries and members of various constitutional commissions.

Once sworn into office, President Kenyatta and his Deputy William Ruto will embark on constituting a government, which will see some fresh faces joining as Cabinet Secretaries and heads of constitutional commissions, whose terms in office are almost coming to end.

For instance, the term of the Salaries and Remuneration Commission commissioners ends in November this year, and parliament will vet new appointees before formal appointment by the president.

Successors

Other senior government officials whose terms will come to an end next year are Attorney-General Prof Githu Muigai and Director of Public Prosecutions Keriako Tobiko, whose successors will have to pass through Members of Parliament before President Kenyatta makes the formal appointments.

Committees, where most parliamentary work is done will also be dominated by Jubilee MPs and their numbers will rise if independent MPs and other parties are co-opted to elbow out the opposition.

Nairobi is a cosmopolitan city kama Dar....hapa wengi wao naamini walipiga kura kwa kutazama sera za wagombea...huyu Kidero hata sijui 2013 alipata aje..naamini jina la Odinga lilimbeba back then...ukibebwa basi ubebeke huyu Kidero kwa hio miaka minne Nairobi imekua hovyo kuliko alivyoikuta...wapiha kura wengi hawakumhitaji tena maana the city is stinking and mismanaged chini yake....

Uhuru won in more than 34 counties taking control of the counties that were initially perceived as ODM stronghold. look at kwale ,mvuria winning on jubilee ticket ,Lamu,narok kajiado,wajir ,marsabit ,nyamira and garisa odm controlled those counties in 2013 ,and the governors were odm ,but now the story is different. Accept the defeat and move on. kuja jubilee tufanye kazi ,I know you are now orphan Jubilee's house is big will accommodate you.TUKOPAMOJA.

What am sayin is that odinga is not finished politically as the motion is stressing.... simply because he was just beaten by 1 million votes now did 34 counties produce just a 1 million gap??? Is that something to celebrate??? Funny thing is that jubilee has only clinched half of the gubernatorial and senatorial seats how does it make jubilee a powerful party at the same time NASA a loser???

An incumbent president to only have simple majority win and u call NASA orphans??? Anyway congrats to jubilee and best of luck to all kenyans
 
Raila is not a man of principle. A reason he went against party agreements n support Magufuli though he comes from a party that has no formal relation with ODM. And when asked he said Magufuli is anointed n Lowassa should learn from all seasonal revolutionary like him.

I see he got 44% while Uhuru 55% (mind u Raila got 48% in 2013). While Lowassa got 40% against 58% of Magufuli. On my plain opinion, he acted varrogantly on Lowassa's loss.

Yes it his a time for him to retire active politics and stay as advisor for his Party. this will make him more Valued rather than involving direct onto presidency race.
