After the day’s hustles and bustles, Nairobi Resident Magistrate Rogers Fundi walked into his neighbourhood bar to unwind. After having one too many, the Traffic Court magistrate decided to head home and join his family. Little did he know his final moments were beckoning in a very strange way.

Outside the bar in Tasia Estate in Nairobi, Fundi mistook a fellow patron’s vehicle for his. The magistrate was desperately trying to unlock the car’s door when the owner spotted him.

Alarm was raised and the patrons, barmaids, hawkers and security guards pounced on Fundi, 33, and left him for dead.

He was a victim of mob lynch in a case of mistaken identity.
Witnesses said the father of two was too drunk and had forgotten that a taxi driver had dropped him at the bar and was to pick him up later.
As the crowd descended on him with clubs and whips, a barmaid, who was curious to see who the thief was, tried to stop them.

"She shouted that the man being beaten was a magistrate and he had been in a bar she serves. Instead, the mob turned on her and chased her away for trying to save a ‘thief’," said a witness.

Taxi drivers say Fundi was also robbed of his mobile phones and money.
"He struggled to his feet and asked one of us to drop him outside another bar along North Airport Road. This is where he was found dead," said a taxi driver.

According to traders, he was dropped there and stood momentarily before sitting down.
Embakasi OCPD Rono Bunei confirmed to The Standard on Saturday the magistrate was killed by a mob .He said police are holding more than 20 suspects.

Police say some suspects have confessed participation and have surrendered the two mobile phones.

"Mob justice is criminal. It can happen to you or someone you know but let those in custody serve as an example," said Bunei.
Fundi will be buried today at his father’s home in Cheptais, Mt Elgon District.
Police Spokesman Eric Kiraithe warned that anyone who participates in mob justice is likely to be arrested and charged with murder.

"It is criminal for anyone to lynch a person on suspicion of something. Let the public call police whenever they arrest a suspect," he says.
