Professor Makau Mutua has resigned as university dean at Buffalo Law School, months after he was accused of lying in a US court.
Mutua's resignation is effective December 19, after a seven-year tenure at the law school, UB reporter posted on the university's website.
He served as the schools 19th dean and will return to the law school faculty as SUNY Distinguished Professor and Floyd H. and Hilda L. Hurst Faculty Scholar.
Dean Mutua has provided outstanding service to the university. He has led the school through a nationally challenging time for legal education while strengthening the schools programs and faculty, and advancing UBs teaching, research and engagement missions," Provost Charles F. Zukoski said.
The US based law professor US has been accused of committing perjury in an American court.
A human and civil rights activist, Mutua is a strong proponent of the ICC and has insisted that President Uhuru Kenyatta should face the court.
He was sued for allegedly irregularly laying off Jeffrey Malkan, a lecturer at Buffalo Law School.
Malkan claims that Mutua lied under oath during his PERB testimony, about the events leading up to his (Malkan's) removal as director of LRW.
"Makau Mutua testified to the promotion of tenure committee, which is the entire tenured faculty, that back when I was promoted to full clinical professor on April 28, 2006, that they voted to terminate my employment on one year's notice, and that was a lie.
"He gave his testimony on March 31, and on cross examination by the union attorney on April 1. This is a prepared, premeditated testimony. The dean of the law school went into court and committed perjury," Malkan said.
In a letter, Malkan alleged: Makau Mutua gave false testimony under oath pertaining to a material fact in the case, specifically, the facultys approval of my reappointment to . .. the rank of full clinical professor.
Mutua testified: I remember this very clearly. (Exhibit I: Mutua Dep. 43).
This seems to contradict Mutuas theory in the litigation that he has the right, absent recommendation from the CCPR, to non-renew Malkans appointment.
To date, no one else who was present at the meeting recalls what Mutua claims to remember very clearly.
The case is before the United States District Court in the Western District of New York.
