Former President Daniel Arap Moi will yet again face the courts over human rights abuses meted on politicians during his tenure.

Veteran multi-party crusader Charles Rubia intends file a case against Mr Moi on Monday to demand compensation for alleged torture and mistreatment.

In a suit by lawyer Irungu Kang'ata, the former Starehe MP says he was arrested on July 4, 1990 by special branch officers acting on instructions from Mr Moi, tortured and exposed to inhuman conditions.

Mr Rubia wants the court to declare that his rights and freedom were violated by police officers and, therefore, entitled to compensation.

The politician also wants Mr Moi and the government to refund all the medical expenses he has incurred as a result of the torture. However, he does not ask for a specific amount.

Saturday Nation had earlier learnt that former Cabinet minister Kenneth Matiba will be enjoined in the case, but the suit papers did not contain his grievances.

The suit will come five months after former Alego Usonga MP Otieno Mak'Onyango was awarded Sh20 million after he sued Mr Moi for similar grievances.

guy is untouchable. Arrest him at your own peril, the police wont dare mule about such a thought even if justification suffices. His son was never arrested, you wonder why? He was was the C-i-C for 24 years. The military per se' accords this man alot of respect. For instance during '02 elections, the military was ready to stand by the man notwithstanding the losing margins. By choice, the ageing president did the honorable thing and handed over power bloodlessly. And btw he is accorded same privilledges still.

Moi is a man amongo the men. Hawa wanaojidai viongozi sasa hivi na presidential hopefuls walikuwa wanamuabudu na kumnyenyekea ki -omba omba style, ati prince of peace, mtukufu, nk, ndio sabab wanangangania hicho kiti wakidhani itakuwa hivyo tena. Hakusubutu kusema yeyote licha Raila, ndiye mwanaume aliye baki pekee.

As they say siasa ni kama mawindo, if you fight to hunt for a cake you should focus until the end and not lose focus or you will hunt for others to chew, i am against impunity and any other bad vices, otherwise I know Moi did a good thing to stifle matiba and rubia though the tactics were not good;
I even praise moi bcoz he prevented raila from staging a coup attempt, though the detention thing is unacceptible.

I would rather those you are calling dictators than Moi, give the old man respect but the old man believed in himself too much. He is a stark contrast with Kibaki who believes in delegating and delegates to the point of mistaking him for having no concern but think of all the civil liberties Kenyans have had under Kibaki and we would not have gotten half of them if Moi was succeeded by a domineering president.

Calm down, I do not support what moi did during his 24 year reign that is off the book with respect to leadership. I respect moi because he was able to keep polarized politics at the edges until kibaki took power, after which the horns of tribal bastions dangerously found freedom to aim..
 
Headline is misleading for the head of state is NOT RAIS MOI but FORMER PRESIDENT, let bygone be bygone Mr Rabia. Just forgive and forget. Please stay away from the courts' doors. Wote ni wazee sasa, visasi vya ujanani na vikome.
