Having made serious accustaions of grand corruption this week, with publications that amount to criminal libel within the penal code of Tanzania if not true, it is worth noting, that Mengi has yet to publish any evidence of his accusations as required under the law.😕


In yesterdays Guardian newspaper, speaking for Mengi his lawyers state of Rostam, that,


'......Rostam fell short of responding convincingly to the charges, only making sweeping defamatory statements against the IPP Executive Chairman. Instead of defending himself, he retaliated by referring to Mengi as to ``corruption whale``.


What is absent in this issue is an apparant understanding of the law by Mengi or his lawyers. When you accuse someone of grand corruption, you are, if you have no evidence of truth, defaming that person.


Under the laws of defamation, it is for the accuser to prove the allegations not for the accused to deny them. Under defamation law, the burden of proof is on the accuser.


I think all engaged in the heated debate might do well to appreciate who actually started this recent Kalali and whether or not any attempt has been made to comply with the law and publish evidence of truth!!!🙄
