Moshi Urban MP accused of election graft

AN election petition, in which the victory of Moshi Urban legislator Philemon Ndesamburo (CHADEMA) is being challenged, came for mention at the High Court here on Thursday.
Before Acting Registrar, Ms Lugano Rechu Kasebele, the first and the second respondents, Mr Ndesamburo and the Attorney General, respectively, were required to file their reply to the petitioner's plaint on February 14.
In his plaint, Mr Justin Salakana, who was running on CCM ticket, said there were rampant corrupt practices, threats and illegal campaigns before the election day - October 31.
Mr Salakana want the court to nullify results of the parliamentary election and bar Mr Ndesamburo from participating as a candidate in subsequent elections in the next five years.
The petitioner alleged in his plaint that CHADEMA agents bought voting cards from voters by paying 5,000/- or more so as to reduce CCM votes and allow the chance to use fake voting cards.
He cited an incident in which a police officer and an agent of CHADEMA named Sgt Marystella who was, on the eve of the polling day, caught red-handed with several voting cards at Mlandege, Pasua which were to be used by CHADEMA agents to vote for their candidates.
The election of Mr Ndesamburo is also being challenged by another petitioner, Mr Faustine Sungura (NCCR-Mageuzi).
Giving particulars of illegal acts committed, he claims that there were election irregularities in the nomination of Ndesamburo (CHADEMA), Salakana (CCM), Reverend Godfrey Malisa (TLP), Seif Madongo (CUF), God listen Ndesanjo (UDP) AND Isaac Kireti Kamacho (SAU), all sponsored by their respective political parties as contestants in Moshi urban constituency was invalid.
He is therefore praying the court to declare that the election of Mr Ndesamburo was null and void and that the petitioner was the only qualified candidate to be declared elected legislator for the constituency.)
