Absalom Kibanda
The Kisutu Resident Magistrates Court yesterday adjourned the hearing of a sedition case facing Mwananchi Communications Limited (MCL) Group Managing Editor, Theophil Makunga, former Tanzania Daima Managing Editor, Absalom Kibanda and columnist, Samson Mwigamba to April 29, this year.
The prosecution led by State Attorney Emma Msofe informed the court that as the case came for another hearing yesterday, they received information that Kibanda (one of the accused) is still sick and waiting for surgery to be carried out in four weeks in South Africa, while Mwigamba is also sick in Arusha.
Makunga is charged with printing a seditious article, while Kibanda and Mwigamba are charged with publishing the seditious article in the column.
The accused are now charged under Section 32(1) (a) of the Newspapers Act (as amended in 2002) though they were previously charged under Sections 46(b), 55(10) (a) and 35 of the Penal Code (as amended in 2002).
According to the public prosecutor, Kibanda and Mwigamba allegedly published the article in Tanzania Daima (Issue No. 2553 of November 30, 2011) under the headline Waraka maalum kwa askari wote (meaning A special letter to all security forces) intending to cause disaffection against the lawful authority through the Kalamu ya Mwigamba column.
Meanwhile, a British national, Emma Donovan (40), a cabin crew member of fastjet, who resides at Matata Street in Upanga, Dar es Salaam, yesterday appeared before the Ilala District court charged with using abusive language.
The prosecution led by State Attorney, Nassoro Katuga claimed before Resident Magistrate, Joyce Minde that on March 19, this year at Julius Nyerere International Airport, the accused used abusive language towards Samson Itembe in a manner likely to cause a breach of peace.
The accused pleaded not guilty to the charge and is out on bail after having met bail conditions. The court ordered him to deposit five million and to secure two reliable sureties from Tanzania.
The case was adjourned until April 9, this year when it comes up for preliminary hearing when investigation is complete.
