Significance of using professional Language.

Good morning My Learned sisters and brothers. Hopefully, you are all doing great. Actually, we have to thank our almighty God for that.

Learned sisters and brothers, I would like to remind you on the significance of using archaic legal language rather than Plain legal language. As you know, LAW is a noble profession so we have to make sure we maintain it. Being a noble profession, we are required to make it to be different from other field. The very important to note is that there are only two professions in the world, to wit, LAW & UDAKTARI. So, we have to be proud of being in this legal fraternity.

SO WHY SHOULD WE UPHOLD OUR ARCHAIC LEGAL LANGUAGE?
•First of all, it will maintain our status since no one will take it for granted. So our clients will need more clarifications on it when they need legal services.

•To rise our income since it wil be difficult for a layman to fathom our language. Thus, it will behove/behoove them to look for more clarifications.

• We have to be more lucid and precise.

• We have to be more unique in writing, drafting etc.

As highlighted hereinabove, we have to work on it ASAP so as to make sure Judgment, Ruling, submissions are in jargon and not in Plain language which is so easier for laymen to
understand.

Learned sisters and brothers, you have to understand that we are not doing business but helping the community in legal matters as it is our primary objective. That is why we have pro bono work( free legal aid) This is mostly considered to those paupers who cannot access legal assistance. Frankly speaking, this is one of the reasons that differentiate us from other fields.In implementing pro bono works we have to make sure we don't demoralize our noble profession. Hence, We should strictly observe our ethics and not be alluded by client's wishes.

Lastly, LAW is a noble profession not business. Let us unite together to uphold our profession and helping our community.

Being a noble proffesion does not mean that we have to use a proffesional language which is not easily understood by the majority.

Lawyers are representatives of the people,that means its their duty to be understood by those they represent.

Its quite old fashioned to think that the integrity of lawyers depends on using complex proffesional language.
 
you have missed the point . I'm talking about Language not integrity brother. Hopefully, you know the difference between integrity and professional language.

we are representatives in the courts of law because it is very difficult for the laymen to understand our language that is why most of them always seek legal representation from us. But if the language would not comprised of jargon, We couldn't represent them before the courts of law since they could know each and everything.

That apart, the courts of law are mandated to interpret the law so let us continue to use jargon in our profession.

Huhuhuhuhhh. Muda mrefu nilitoka Law School. ukitaka Roll number njoo PM.

Kuhusu kusumbua na vi- language siyo kweli sema huenda ni kutokana na profession yangu. Japokuwa hata hiyo MOOT COURT ilinisaidia kujenga confidence yangu katika kufanya Examination kwa shahidi etc.
 
Sidhani kama kuna lugha inaitwa lugha ya wakili brother. Pia sijui ni kipimo gani unatumia kutambua kuwa huyu ni wakili au siyo. Ila hongera kwa komenti yako.

so you are telling me that the difference between lawyers and laymen is the use and understanding of proffesional language?

seriously, thats not the case, lawyers spend hours,days, years to be trained and nourished on the complex common law system which can not be understood by a mere understanding of plain language.

Lawyers are more than that brother.
 
Courts of law inteprete the law, this does not mean or signify that the language used has to be difficult to the lay community.The fact that advocates represent the people means they should use a language which is easily understood by the laymen. Just Imagine a contractual agreement drafted in proffesional language, how do you think the parties are going to fulfill their contractual obligations with that kind of contract?

I think plain language serves the utmost purpose of representing the people.
