Spika wa Bunge apitisha hoja ya Kumtoa madarakani Naibu Rais kujadiliwa Bungeni

Baada ya wabunge 291 kuunga mkono hoja ya Makamu wa Rais nchini Kenya Rigathi Gachagua kuondelewa madarakani, Spika wa Bunge la Jamhuri ya Kenya, Moses Wetang'ula ameidhinisha hoja hiyo kujadiliwa akisema sababu zote 11 zinakidhi vigezo vya kikatiba.

Hoja hiyo imewasilishwa bungeni jioni hii na Mbunge wa Kibwezi Magharibi, Mwengi Mutuse.

Gachagua analalamokiwa kwa madai ya kuhusika na maandamano ya vurugu yaliyotokea nchini Kenya miezi mitatu iliyopita.

Anadaiwa pia kuhusika na ufisadi, kudhoofisha serikali na kukuza siasa za mgawanyiko wa kikabila.

Katika hoja yake, Mutuse anamtuhumu Gachagua kwa ukiukaji wa vifungu vya 10, 27, 73, 75 na 129 vya Katiba ya Kenya kwa kueneza ukabila, ubaguzi na kusababisha migawanyiko kitaifa.

“Kwa mfano wakati mmoja mnamo 2023 katika mkutano wa hadhara katika kaunti ya Kajiado, Naibu Rais alitoa matamshi ya kuchochezi kwamba Serikali ya Kenya ni Kampuni na kwamba ugavi wa miradi ya maendeleo na rasilimali ya umma inapasa kufanywa kwa misingi ya ‘hisa’ inayokadiriwa kutokana na jinsi watu kutoka jamii mbalimbali walipiga kura katika uchaguzi mkuu wa 2022. Kauli kama hii inaendeleza ukabila, ubaguzi na kuvunja utaifa,” anasema katika hoja hiyo.

Rais William Ruto alimteua Gachagua kama mgombea mwenza wake katika uchaguzi wa mwaka 2022, ambapo alimshinda Waziri Mkuu wa zamani, Raila Odinga katika uchaguzi uliokuwa na ushindani mkali.

Gachagua anatoka katika eneo la Mlima Kenya ambako kura ni nyingi zilitoka, na alisaidia kwa kiwango kikubwa kumfanya Ruto kupata uungwaji mkono huko.

Lakini baada ya wanachama wa chama cha Odinga kujiunga na serikali kufuatia maandamano yaliyoandaliwa na vijana (Gen Z), ambayo yalimlazimisha Ruto kusitisha ongezeko la kodi, hali ya kisiasa nchini imebadilika. Makamu hiyo wa Rais ameonekana kujitenga zaidi huku yeye akidai anatengwa na watu wa Ruto.

Kwa mujibu wa kifungu cha 150 cha Katiba, hoja ya kumwondoa Makamu wa Rais inapasa kuungwa mkono na angalau thuluthi moja ya wabunge wote, kabla ya Spika wa Bunge la Kitaifa kuruhusu ijadiliwe. Hiyo ni sawa na wabunge 117 kati ya 349.

MP Mwengi Mutuse formally tables 100-page impeachment motion against DP Gachagua

Deputy President Rigathi Gachagua's days could be numbered after Kibwezi West MP Mwengi Mutuse formally tabled his impeachment motion in Parliament, citing that the grounds are concrete enough to kick him out of office.

On Tuesday afternoon, National Assembly Speaker Moses Wetangula read out the impeachment motion against the DP after confirming that 291 MPs had supported it hence surpassing the threshold. For any motion to be tabled, it requires the support of at least 117 lawmakers.

The lawmaker tabled a 100-page document, indicating that he had satisfactory evidence to support his grounds and prove that Gachagua is not suitable to remain in office

"Article 145 (1) of the Constitution provides that a member of the National Assembly supported by at least a third of all the members may move a motion for impeachment of the president or deputy on the grounds of gross violation of the Constitution," Speaker Wetangula stated.


"Having examined the special motion by Kibwezi West MP, I find that the special motion meets the requirement relating to threshold set out in the Constitution."

He added: "I have also satisfied myself that the number of members who have appended their signatures in support of the special motion exceed the minimum threshold of 117 members in this House."

While tabling the motion, MP Mutuse noted that the DP's conduct in the past two years violated the oath he took to assume office.

"The motion contains 11 grounds for impeachment. In compliance with the law, the grounds are concise, precise are particularized in the motion and are supported by convincing, persuasive materials in the nature of documents, affidavits and electronic evidence," the MP said.

"I will also be presenting live witnesses who will testify to corroborate the evidence that we have adduced in support of the grounds of impeachments."

Some of the grounds that he tabled include dividing Kenyans on ethnic lines, undermining the presidency, violating the oath of office and contradicting the National Cohesion and Integration Act.

Others include allegedly amassing Ksh.5.2 billion property through corrupt means, inciting the public against the Nairobi County governments' directives, gross misconduct and bullying.
