One of my colleague is complaining that Tanzania Cigarette Company, where he worked in the 2004-2009 has never submitted NSSF Contribution for 2006/2007. He has notified HR Office for that matter bu there is no respond, Nssf has shown interests of claiming that amount though not formally. Looks like TCC HR and NSSF Officers were eating employees money. What can be done legally to solve this matter once and for all.

Section 14 of the National Social Security Fund Act states as follows:-

''14.
(1) A contributing employer shall pay contributions to the Fund in the manner prescribed under this Act, within one month after the end of the month in respect of which the contributions are due and payable.
(2) An employer shall submit with the payment all prescribed supporting particulars concerning the identity, period of employment and earnings of the insured person to whom the contributions relate.
(3) If any contribution is not paid within the period stated under subsection (1) a sum equal to five per centum of the amount unpaid shall be added as penalty for each month or a part of a month after the date when payment should have been made and the amount of the penalty shall be recovered as a debt owing to the Fund by the employer:
Provided that the Board may, if it thinks fit, remit in whole or in part any penalty imposed by this subsection.''

In a country like ours (Tanzania) where corruption is at a higher level, informal claims are treated informally, that is why he/she has not seen any response. Therefore it is your fiend's duty to enforce his/her legal rights by making his/her claims formal.
