One government vehicle was reduced to a shell as Police engaged riotous youth in running battles in Mombasa town following the murder of Al-Shabaab suspect Sheikh Aboud Rogo.

Chaos erupted during the burial prayers for Sheikh Rogo at the Majengo mosque after the youth barricaded Majengo road and lit a borne fire.

Business premises in Mombasa's central business area closed as panicky owners feared an escalation of the chaos.

Sheikh Rogo was killed on Monday in a drive-by shooting in Bamburi area, Mombasa, while taking his sick wife to hospital.

The deceased was facing charges of illegal possession of weapons. In the case, police said Mr Rogo was plotting attacks at a Catholic church, the Likoni Ferry and Nyali Bridge.

Mr Rogo was shot near the Pirates beach while driving a van that had six other passengers.

According to his wife, Haniya Said Saval, their van had been trailed by another car for a while. The car overtook them and in the process 18 bullets sprayed on Mr Rogo.

Mr Rogo's van swerved off the road where died on the spot. His father in-law was also hurt in the hand.

Police raided the home of an Islamic preacher after a tip-off that it had weapons that were to be used to attack various public places in Mombasa, a court was told on Tuesday.

MHRF STATEMENT ON THE EXTRA-JUDICIAL KILLING OF MOMBASA MUSLIM CLERIC SHEIKH ABOUD ROGO

The Muslim Human Rights Forum (MHRF) strongly condemns the extra-judicial killing of Sheikh Aboud Rogo in Mombasa this morning and calls for an end to targeted killings and enforced disappearances of terrorism suspects.

Sh. Rogo was assassinated this morning in the Bamburi area in an incident that mirrors recent others targeting people who were on the country's terrorism watch list and who have either been killed or mysteriously disappeared after being waylaid by gunmen. and pulled out of vehicles they were travelling in. In this mornings incident Rogo was killed when the van he was travelling in from Mtwapa towards Mombasa with three other people on board was sprayed with bullets near Pirates Beach. His wife Ms. Haniya Sayyed Saggar who was with him was grievously injured and is undergoing treatment at the Mewa Hospital where she was admitted following the shooting.

Only a month ago Rogo and his co-accused in a case still pending in a Nairobi court Abubakar Shariff Ahmed survived an abduction attempt by gunmen they claimed were state agents who accosted them as they arrived in the city for a hearing of the case forcing them to seek an adjournment and a transfer of the case from Nairobi as they feared for their lives and security. The early morning abduction was foiled by members of the public who came to their aid as the two shouted for help as they resisted the heavily armed men. Both Rogo and Shariff recorded statements about the incident at the Kamukunji Police Station, Nairobi in which they expressed fears for their lives.

In April this year another Mombasa-based Muslim activist and preacher Samir Hashim Khan together with a blind colleague Mohamed Bekhit Kassim were pulled out of a matatu they were travelling in near the Nakumatt Likoni Branch just for Khan's badly mutilated body to be found dumped on the wayside in the Tsavo National park along the Mombasa- Nairobi highway two days later. Kassim has never been found nor been heard of to date and is feared dead. Like Rogo, Khan had cases of alleged terrorism pending in court in Nairobi and Mombasa.

And in May this year another suspect Sylvester Opiyo a/k/a Musa Osodo and a friend Jacob Musyoka a/k/a Yaqub Musyoka were abducted near Molo from a vehicle they were travelling in to Kisumu; never to be heard of or seen since then. Opiyo too had a case pending in a Nairobi court when he disappeared. According to eyewitnesses his abductors questioned him about his presence in the area where the vehicle he was travelling in had broken down before they took him away.

In June, two of Opyo's co-accused in the same case Jeremiah Onyango Okumu a/k/a Mohamed Jaffar and Stephen Mwanzia Osaka a/k/a SalimAbbas together with two other people Omar Shwaib and Salim Abubakar were abducted in Kisauni, Mombasa as they were heading towards Likoni and also disappeared without trace. All disappearances were reported to the police but no news about outcomes of any investigations has been given to their kin.

Three weeks before he disappeared, Mr. Kassim, a blind man from Kibera in Nairobi, had been abducted from outside Nairobi's Jamia Mosque by men who manhandled him into a waiting car and drove him around the city questioning him for alleged motor vehicle theft and who later dumped him in the outskirts of the city with warnings that they were "not through with him."

After Mr Kassim-Bakhit's first abduction his lawyer Mr. Mbugua Mureithi, who was also the lawyer for the other disappeared accused persons had complained in a letter to the commissioner of police about threats to the life of his blind client warning that the abduction could be a prelude to an enforced disappearance or an extra-judicial killing. He demanded an explanation about the illegal arrest and an assurance about Mr. Kassim-Bakhit's safety from the police boss. There was no response to the letter.

Once again we at the MHRF demand that the government institutes an independent probe into these abductions and killings and bring the officers found culpable to book. We also demand an explanation by the commissioner of police and the commandant of the anti-terrorism police unit as to the circumstances that led to the killing of Mr. Rogo and the mysterious disappearance of all the suspects named here and the steps being taken to apprehend the culprits since they are known, whether they were acting on orders or not. The government must denounce this dangerous policy and assure the nation that extra-judicial killings and illegal abductions will not continue to be employed in police operations. Due process must be left to take its course once suspects are arraigned in court while investigations must be carried out strictly in accordance with the law.

We are shocked that the so called war on terror has gained this frightening dimension above the usually heavy handed methods employed by the anti-terrorism agencies in the past. It is no doubt a very frightening and dangerous trend which if unchecked is bound to fan extremism rather than curtail it. Extra-judicial extermination of suspects is an anarchic policing method that is as illegal as it is barbaric, heinous and grossly dehumanizing and cannot be condoned in a society that claims to uphold human rights and the rule of law.

We call on Kenyans to see this killing and the as a throwback to a few years gone by when the preferred method of dealing with suspected members of criminal gangs was extermination by killer squads which wiped out hundreds of youth in Nairobi and Central provinces. Extending extra-judicial killings to counter-terrorism operations will be opening another dangerous front right inside the country even as the recent spate of grenade attacks remains a mystery while the war against the Al-Shabaab is far from being won.

The government has to demonstrate its commitment to human rights by coming clean on these abductions and taking firm measures to stop these dangerous extra-judicial policing methods.

Where were the MHRF when 17 Christians were massacred inside a church on Sunday by a group which was being assisted by this gentleman? Where were the people expressing outrage now because I sure didn't hear them say anything!

MHRF is speaking on behalf of Muslims who are also Kenyan citizens the last time I checked.

Christians have their own organizations that should make noise when Christians are massacred. They even have
the damn President with the whole security apparatus to back them up!!! Those are people to ask that question of
'where were they'.

But why only speak on behalf of Muslims...doesn't the KNHCR speak out on behalf of all Kenyans? Kenya is a secular state, Kibaki is not the president of christians and the security apparatus is not there for christians but for Kenyans.

So you think that Muslims should not care when their fellow citiens are massacred by people claiming to do it in their name?

The most interesting question is, why does MHRF only pipe up when something happens to this terrorism suspects?

statement did I say they should not care about fellow citizens being massacred. Hio umeleta weye! When Kenyans were
renditioned to Uganda under the cover of darkness on some fake charges, did the Christians condemn that act by that
legal government ama there was deafening silence? I don't remember seeing anything to that effect but I might be wrong.

You mention well that the security apparatus is there for Kenyans...very laughable statement when looking
at it in reality. That's the exact question everybody is asking ever since time begun for that nation. Where
were the security when more than 40 people got murdered in Tana River? Where was that security apparatus
for all Kenyans when extra-judicial killings were happening central Kenya? Where was that same security apparatus
during the post election violence of '07?....the list is endless.

Everybody in their right mind knows that Kenya's security apparatus is controlled by the President and his
handlers...thats why they don't arrest people even when crimes are committed in their face. Good example
thats still fresh is the Miguna Miguna debacle in Mombasa. Those hooligans are walking the streets of Mombasa free!
That security apparatus has been used since the Kenyatta days to murder dissenting voices. A culture which Moi
perfected and Kibaki inherited.

Based on this I cannot put it past that same security apparatus, to have been used to kill this guy.

Finally I believe in the dictum that all persons are innocent till proven guilty by a court of law. We need
to uphold due process instead of these selective police orchestrated killings.

TUJIKUMBUSHE...There was the murder of Samir Khan before this one. That hasnt been solved yet and so will this

Muslim activist Samir Khan was strangled and his private parts chopped off according to an external examination conducted by a doctor before he was buried.

A senior police officer familiar with the investigation but who requested anonymity due to the sensitive nature of the case said the family wanted to confirm whether the activist was a victim of extra-judicial killing.

The family declined to allow a full post-mortem on the basis it was against their traditions and religious beliefs.

"They told us that according to Muslim religious belief, they could not allow any cutting on the dead body and signed that they were satisfied with the visible evidence," the source said.

The investigation, the source said, will begin in Tsavo East National Park where the body was dumped the night of April 12 at Man-eaters before considering the marks found on the body.

Mr Khan was facing illegal possession of weapons charges.

"Since we have agreed with the family members present at the hospital where the examination was conducted, investigation will be based on the evidence we have collected," said the source.

The police said the investigation would focus on people who claimed the deceased was abducted at Nakumatt in Mombasa and bundled into a Toyota Probox at around 11 am.

They said since these people appeared to know something but had not reported anything to them, they could have information that could help in the investigation and ultimately lead to the arrest of the killers.

Police said the body was seen by a truck driver who reported to Mtito Andei police station about 70km away before the same report was transmitted to Voi police station for action.

In a telephone interview, Coast Provincial Police Officer Aggrey Adoli said the partial post-mortem was done according to the family's wishes after the body was found and would be sufficient to enable his officers to proceed with their investigation.

According to the police boss, a doctor conducted a physical check of the body and made a preliminary report on his findings. He said a post-mortem does not necessarily require the actual dissection of the body but could be done through a physical inspection.

"We are investigating to establish how the body was found and to discover the cause of the death," he said.

Boss, wacha presha. The man was a leader of an organisation (AL-Hijrah) which has declared war on Kenyans because they happen not to share the same faith. They've been uttering threats for years and even now are all over the internet uttering threats against Kenya. The man was caught on tape just a few weeks ago celebrating the fact that a Christian church had been attacked and 17 christians massacred for christ sake...if these are the kind of people you sympathise with just because they happen to share your faith, then people like you are the probblem with your faith and with humanity in general. Surely you cannot declare war on a people and act on that declaration and then start crying and complaining when they fight back with extreme prejudice.

P.S. The KNHCR, which by your logic is a "christian" organisation was at the forefront of fighting against the renditions and defending the people subjected to it.

This is the 2nd riot by some muslims in Kenya in defence of a terrorist (let's drop the pretence of calling him a suspect, his own words and actions condemn him). more than 50 christians have been massacred in Kenya by Muslim extremists over the last few months and hundreds more over the last decade and a half...have you seen any riots or blanket condemnation of Muslims or attacks on their places of worship by christians as is happening now in Mombasa? What have christian churches and properties belonging to christians have to to with this shooting?
