"I am clear, respectful. I know what my job description is and I work very hard at it," she said.

MONOPOLY

On Tuesday, the National Assembly Committee on Justice and Legal Affairs summoned Mrs Shollei, who was sent on compulsory leave on Monday, to appear Wednesday afternoon at 2.30pm "to give us her side of the story".

Chairman Samuel Chepkonga (Ainamoi) said the committee would investigate the process followed by the Commission to determine whether it followed the law in suspending Mrs Shollei.

"The Committee has powers to remove members of the JSC. If we find they did not follow procedure, we will write to the National Assembly to pass a motion and instruct the President to form a tribunal," he said.

"Judiciary reforms are not a monopoly of a few persons and we need to guard it jealously. We will let them know that non-attendance would have legal implications."

Judiciary's Chief Registrar Gladys Shollei was on Monday sent on compulsory leave and investigations ordered into malpractice allegations against her.

The decision was reached at a meeting of the Judicial Service Commission (JSC) chaired by Chief Justice Willy Mutunga and attended by nine members, which upheld an earlier resolution by a section of the JSC in Mombasa on Saturday.

"Five of the nine commissioners voted in favour of asking the Chief Registrar to take compulsory leave during the 15 days when the investigations will be in process. Four commissioners voted against this decision," announced Dr Mutunga at the Supreme Court after a marathon session.

The Chief Justice said two JSC committees - Finance and Administration and Human Resource Management - would investigate the allegations of malpractices touching on procurement, employment, administration, finance and corporate governance of the Judiciary.

Mr Justice Isaac Lenaola and lawyer Ahmednassir will lead the investigations.

Deputy Chief Registrar Kaikai Kissinger, will temporarily take charge of the Judiciary.

ABSENT COMMISSIONERS

But a few minutes after the JSC decision was announced, Mrs Shollei, addressing the Press, blamed the attacks on a cartel she claimed was resisting reforms she was implementing in the Judiciary.

She termed the decision to suspend her as irregular.

"There is no statutory or regulatory provision for sending the Chief Registrar on compulsory leave. I understand that the decision was not unanimous (5-4). Some commissioners including the Attorney General and Justice Isaac Lenaola were absent," she stated.

She went on: "I can guess those commissioners who supported the resolution and their reasons. But that is for another day."

Mrs Shollei said the reasons for which she was being fought had been the subject of media speculation and insisted her reputation was above reproach.

"There is no financial impropriety or irregularities in the procurement processes at the Judiciary. In fact since I took office I can tell Kenyans that the Judiciary is the only government institution that has not had an appeal against any of its procurement decisions at the Public Procurement Appeals Tribunal," she said.

CONTEST DECISION

She further hinted that she may contest the decision to send her on leave: "Whereas the JSC has made its decision, I reserve the right to contest the process and procedure used. I am aware that this might be construed that I have something to hide. I do not."

Mrs Shollei called on other relevant government authorities, including Parliament, to carry out their own audit into the matter.

The inquiry has been prompted by questions being raised over among other things, the procurement of an office space leased at Elgon Court to house some of the judicial staff costing over Sh700 million, her failure to audit the renovation of the Milimani Law Courts and purchase of several luxury cars for judges.

The Milimani courts project was implemented by the previous Judiciary administration.

Supreme Court judges have been asked to move to the new facility by end of August but some have opposed the decision, saying the new building was not conducive for their work.

The matter prompted the Law Society of Kenya to write to the JSC registrar.

"Yes we are aware of the concerns raised by some judges in regard to the new office facility and we wrote to Mrs Shollei regarding this," said LSK chairman Erick Mutua.

Meanwhile, drama unfolded at the JSC meeting on Monday after some of members disowned an earlier decision in Mombasa to suspend Mrs Shollei for 30 days.

The Nation obtained minutes of the meeting held at the Serena Beach Hotel and attended by eight commission members chaired by JSC vice-chairperson Christine Mango.

The August 17 retreat was also attended by Justices Lenaola, Smokin Wanjala, Mohammed Warsame, Emily Ominde, Florence Mwangangi, Mr Ahmednassir Abdulahi and the Rev Dr Samuel Kobia.

"That the two committees will after due process hand over a report on the investigations to the Judicial Service Commission within thirty (30) days," read part of the resolution contained in a confidential document signed by Prof Mango.

"This is a rogue JSC"! Those were the words an angry Chief Justice Willy Mutunga uttered yesterday as he walked out of the meeting that resolved to send Chief Registrar of the Judiciary Gladys Boss Shollei home for two weeks to facilitate investigations.

The CJ was apparently upset by the decision by lawyer Ahmednassir Abdullahi and four others to force through a vote for the suspension of the Shollei over unsubstantiated claims.

During the heated four-hour meeting, Ahmednassir is reported to have rallied four other commissioners to defeat Mutunga and three others who did not support the proposal to send Shollei home.

The commission failed to make a unanimous decision and when the matter was put to the vote Ahmednassir's carried the day with a 5-4 vote in favor of sending Shollei home.

This means that Sholei will proceed on compulsory leave to facilitate investigations into, among other things, procurement by the judiciary including buildings and generators for all supreme court judges.

Apart from Ahmednassir, others who supported the proposal included Supreme Court Judge Ibrahim Warsame, Professor Christine Mango, magistrate Emily Ominde and LSK representative Florence Mwangangi.

Those who objected to the proposal to suspend Shollei were CJ Mutunga, Reverend Samuel Kobia, Public Service Commission chair Professor Margaret Kobia and Supreme Court Judge Smoking Wanjala.

Sources said Ahmednassir and his group which met in Mombasa over the weekend refused to allow two other JSC members-- Attorney General Githu Muigai and Justice Isaac Lenaola--to participate and vote via phone arguing that it was illegal. Githu is with the President in China while Lenaola is in Arusha for an official function.

Rev Kobia who attended the Mombasa meeting where the proposal to suspend Shollei was mooted, yesterday disowned the resolutions reached in Mombasa saying they were made in bad faith.

"He said he was lied to," said a source familiar with yesterday's meeting. Six MPS have come out in support of Shollei and accused those behind her tribulations of being members of an anti-reform cartel.

Addressing a press conference yesterday at KICC the MPs, led by Elgeyo Marakwet senator Kipchumba Murkomen and the Senate Majority Leader Kindiki Kithure, said the cartel was also plotting for Mutunga's succession in two years.

"We are aware that there are some individuals within the judiciary system who feel threatened by the professional manner in which Shollei has been executing her role and their fear that she has the potential to succeed Mutunga," Murkomen said.

"It is unfortunate that Shollei who has been in the fore front with other reform- oriented judicial officers in fighting corruption is being now being fought by some cartels who want the old order to prevail," Murkomen added.

Nominated Senator Ziporah Kittony said the "robust leadership which Shollei has shown in the Judiciary has earned her negative smear campaigns to tarnish her reputation".

"Shollei deserves protection from all the members of the society who are reform-oriented. As women we shall stand by her in asking for fair investigations rather than subjecting someone of high integrity like Shollei to such baseless allegations," she said.

Kindiki said he and other legislators " will not allow some commissioners in the judicial service commission to make such serious allegations just because their favours have not been met." He called on the JSC to carry out thorough investigations in accordance with the law.

I first met Glady's Sholei at KU in December, 2012 where everybody inspired her. The lady is clean, hardworker, talented, result oriented, visionary and that she played a positive role in three decades to transform judiciary systems in Kenya, and that there is no doubt the lady is a right person for this position. Mambo haya ni wivu wa wataka vyeo
 
She's on compulsory leave to enable investigations take place, this is a very normal procedure in public service and actually that's how the Kenyan constitution clearly states. If Mrs. Shollei knows for sure she's clean then why does she seem so comfortless? It's better she stays calm and cooperate as the saga might end advantageous to her.

he may not do anythin, but it is good to avoid speculating, bcoz you do not know how this began in the first place. Ukweli wote ukishapatikana, then inakubalika kuweka conclusions.

The Judicial Service Commission has been restrained from opening disciplinary proceedings against suspended Chief Registrar Gladys Shollei.


Mrs Shollei, who was sent on compulsory leave on Monday to pave way for investigations into allegations of corruption against her, Thursday sued the JSC and three individual commissioners – Justice Mohammed Warsame, Magistrate Emily Ominde and lawyer Ahmednasir Abdullahi.

Justice David Majanja, who heard her urgent application for injunctions ex parte, ruled that it was necessary to stop any disciplinary process against her pending hearing of her case.

"I am satisfied that a case has been made out to prohibit, pending hearing, further proceedings so that the matter may be ventilated in court," the judge ruled.

PENDING HEARING

The judge restrained the JSC, which mandated two of its committees to investigate Mrs Shollei within 15 days and make recommendations, from continuing with the proceedings pending hearing of the application on August 27.

Presenting the application before the judge, Mrs Shollei's lawyer, Donald Kipkorir, said that the embattled Judiciary Registrar had not received any communication from the JSC either verbally or in writing "other than being sent away through TV broadcast."

"She has not been informed of the charges against her," he said.

In a supporting affidavit, Mrs Shollei replies to some of the allegations against her. She states that expenditure by the Judiciary is approved by Parliament, the National Treasury and the JSC.

She says that she never authorised cabling of the Milimani Law Courts at a cost of Sh1 billion. The allegations of disrespect and authoritarianism against judges and "unsubstantiated bar-room gossip" that flies in the face of evidence, she claims.

This is it,,,if she is clean,,why worry,,,why go to high court and stop the inquiry.

I have regarded mrs Shollei,,in high esteems,,,but the way she is complaining,,,
aiiiii,,,,i fear there are things,,,,we do not know.

Funny enough,,,that this time round,,,there are those in CORD and Jubilee
who supports her and at the same time,,,those in CORD and Jubilee who
feels that she must be investigated.

How can you be investigated while in,,,office?????

Let us follow the constitution,,,,let her be investigated
and get to the bottom of all this,,,saga.

But what we see,,is people jumping the gun and saying
so much,,,as if we are,,in the past where corruption
was defended,,the same way,,,we are,,witnessing.

If,,mrs Shollei is innocent,,,why is she calling all
those press conferences????

Why not wait til the end of the inquiry??????

Why blame some people like Nassir,,who is just
doing his job,,of oversight.
 
Gladys Shollei to resume duty after agreement with Judicial Service Commission

Nairobi, Kenya: Chief Registrar of the Judiciary Gladys Shollei is set to resume official duty only nine days after she was sent on forced leave by the Judicial Service Commission (JSC).

The commission reached a settlement with Ms Shollei even before the expiry of the 15-day timeline for which she was to be on leave, pending investigation into unspecified claims of mismanagement.

Though details of the agreement will be recorded in court on Friday, sources indicate that the JSC had agreed to have Shollei resume work.

The deal will see her withdraw a suit, which she filed last Thursday challenging the commission's decision to send her on forced leave.

In a statement, her lawyer Donald Kipkorir said, "We wish to inform the public that Gladys Boss Shollei and the Judicial Service Commission have reached settlement that protects their respective rights and mandate, and also the integrity of the Judiciary. In pursuance of the said settlement, Ms Shollei has withdrawn her petition and she is at liberty to resume work."

Other lawyers involved in the case declined to discuss the matter, preferring to have the agreement recorded before High Court judge David Majanja.

Shollei was last week sent on compulsory leave to pave way for investigation into unspecified allegations of financial irregularity against her by some members of JSC.

Chief Justice Willy Mutunga announced the decision following a three-hour meeting of the JSC in which commissioners voted five against four to send Shollei on leave pending a probe that had to be concluded within 15 days.

JSC mandated two committees of the Judiciary to probe various allegations relating to procurement, employment, administration, financial management and corporate governance of the Judiciary made against the Chief Registrar.

Did not attend
Nine out of the 11 members of the JSC attended the meeting. Attorney General Githu Muigai and the representative of the High Court judges, Isaac Lenaola, did not attend.
