Timamy charges similar to Uhuru’s



Relatives of Governor Issa Timamy and Lamu residents who jammed the High Court in Mombasa on June 26, 2014 for the hearing of the case in which he is being investigated for murder. Mr Timamy was remanded at the Port Police station in Mombasa for three days.

Legal experts are seeing a striking similarity between the crimes the Lamu Governor Issa Timamy is being investigated for and those facing President Uhuru Kenyatta and his deputy William Ruto in The Hague.

Mr Timamy is being investigated for murder, forcible transfer of population and terrorism-related offences as a result of the Mpeketoni attacks in which 65 people were killed, according to what the prosecutors told a Mombasa court on Thursday.

President Uhuru Kenyatta and his deputy William Ruto are being tried in The Hague with crimes against humanity comprising of murder, deportation or forcible transfer of population and other inhumane acts allegedly committed during the 2007/08 post-election violence.

The three charges Mr Timamy is being investigated for fall under international crimes even though murder and terrorism have often been prosecuted by Kenyan courts.

Following the post-election violence, the Waki Commission had recommended that Kenya establishes a special tribunal to prosecute the alleged perpetrators failing which the alternative was the International Criminal Court in The Hague.

The Waki Commission’s own assessment was that the local courts as constituted then were incapable of handling the post-election violence that bordered on ethnic profiling; similar to those Mr Timamy is being investigated for.

As a result, there is a debate under which law the governor will the charged at the end of the investigations given that most of the crimes he is being investigated of fall under the ambit of international crimes.

Ndung’u Wainaina of International Centre for Policy and Conflict said: “It will be recalled that Mr Uhuru Kenyatta and Mr William Ruto are accused for either directly or indirectly aiding, financing, ordering and facilitating criminal gangs to kill, maim, rape and transfer population in areas of Nakuru/Naivasha, and Eldoret/Kericho.”
