Sheria ya kazi inampa haki mfanyakazi kwenda likizo ya siku 28 kila baada ya miezi 12 ya kazi. Na endapo mfanyakazi ataachishwa kazi akiwa na likizo ambayo hakwenda kwa sababa maombi ya likizo yake hayakuwa approved na mwajiri anatakiwa alipwe mshahara wake wa mwezi kwa kila likizo ambayo hakwenda.

Lakini kifungu cha 31(9) kikisomwa kwa pamoja na kifungu cha 31(3) vyote vya Sheria ya Kazi na Mahusiano Kazini Cap. 366 R.E. 2019 vinanichanganya kidogo. Naomba ufafanuzi wa kisheria tafadhali wanajamvi.

Hivi hapa:

31(3) An employer may determine when the annual leave is to be taken provided that it is taken no
later than—
(a) six months after the end of the leave cycle; or
(b) twelve months after the end of the leave cycle if—
(i) the employee has consented; and
(ii) the extension is justified by the operational requirements of the employer.

31(9) An employee is not entitled to be paid any pro rata amount for accrued annual leave if the employee has not taken the leave within the periods and circumstances prescribed in subsection (3).

Lugha ya kisheria kwa kingereza ina maneno kadhaa ya kilatini na hata kigiriki. Kwa kifupi mwajiriwa huimizwa kwenda likizo kila mwaka bila visingizio; na kama haikufanyika hivyo kwa mujibu wa vifungu hivyo, likizo hiyo hupotea...yaani mwajiriwa hupoteza likizo yake! Na ikiwa mwajiri ndiye alisitisha likizo kwa sababu maalum hiyo huweza kufidiwa kwa ama kulipwa fedha au kupewa likizo nje ya mzunguko wa mwaka.
 
Navyoona mie ni kwamba mfanyakazi hawatakiwi kupewa likizo baada ya kipindi cha 6 tangia alivotoka likizo au miezi 12 au anaweza kuongezewa kwa mambo ya kiutendaji.


Nb huo ni ufafanuzi baada ya likizo ya mwanzo kupita hivyo mfanyakazi anaweza kuomba likizo nyengine hivyo sheria inampa mamlaka mwaajiri kuangalia hiyo likizo.
