Morocco's king revoked on Sunday the pardon of a convicted Spanish pedophile that sparked angry protests in the North African nation.
"King Mohammed VI has decided to withdraw the pardon previously accorded to Daniel Galvan Vina," the royal office announced on its official website on Sunday.
The statement said the "exceptional revocation" was ordered by the king because of the "gravity of the crimes committed by the person concerned, as well as out of respect for victims' rights."
According to official newspapers, Galvan was convicted of raping 11 Moroccan children and sentenced 30 years in prison in September 2011. The children ranged in age from 4 to 14.
Galvan, a retired professor, was arrested in December 2010 after he was found with CDs and external storage units containing pornographic images of him raping children.
It was unclear whether Galvan had left the country, as several media reported, but the monarchy said the king has ordered the Minister of Justice to speak with his Spanish counterpart about the actions that would follow the revocation of the pardon.
On Friday, hundreds of angry demonstrators protested outside the country's Parliament building in Rabat, the capital, to protest the royal pardon, according to media reports and social media websites.
A statement posted on the official Moroccan monarchy website on Saturday said that the king had not been informed of the details about the case.
The king "has not been informed on all gravity of the despicable crimes committed by this person," the statement said. The monarchy also said that it will investigate what led to Galvan's release.
Galvan was one of 48 Spanish prisoners who were pardoned. King Juan Carlos of Spain thanked King Mohammed for his action, according to a statement on the Moroccan monarchy's site dated July 31.
Meanwhile, Moroccans on social media are trying to organize another protest in the next few days.

The Pope has vowed to never pardon paedophiles after admitting the Catholic Church kicked their heels over abuse for far too long.

Speaking during his first meeting with the papal abuse commission, Pope Francis said there can be no place in the priesthood for those who harm children.

And he said he had learnt from his own mistakes in handling such cases.

The Pope met the group for an hour and rather than speaking from a prepared speech gave 20 minutes of off-the-cuff remarks.

One of the 14 members of the Pontifical Commission for the Protection of Minors present at the meeting was Baroness Hollins, a professor psychiatry and member of the House of Lords .

She said: "He said if paedophilia is proven then he will never pardon an ordained priest and that the Church has come late to an understanding of how serous this matter is.

"He is completely committed to trying to get the Church to address this properly and he said he felt deeply ashamed about what has happened."



The Pope faced criticism earlier this year when it emerged he had softened a sentence of laicisation against Mauro Inzoli, 67, an abusive priest in the Diocese of Crema. Inzoli has since been de-frocked.

During his meeting with the commission the Pope admitted this was a mistake, confessing that he thought at the time he was dealing with matter in "the most benevolent way."

Pope Francis added, however, that he learnt from this and would never do it again.

He said: "Whoever is sentenced for sexual abuse of children can turn to the Pope for pardon," but he stressed he had "never signed one of these and will never sign."

Describing paedophilia as an "illness", the Pope. admitted that the Church had not faced up to the problem of abuse quickly enough.

He said it was thanks to a number of "prophetic" men and women that the matter was now being taking seriously.


He stressed that the Congregation for the Doctrine of the Faith (CDF), the Vatican department which acts as a clearing house for abuse case, will be getting more resources.

There have been complaints that the congregation has been under staffed and that cases are being processed too slowly.

Baroness Hollins described the Pope's talk as "very honest" adding that she believes he understands the gravity of the problem.

In the official text prepared for the meeting, Francis re-iterated a "zero tolerance" approach on sexual abuse.

He pointed out he had implemented new laws to hold accountable any bishops and religious superiors who are negligent when handling cases.

The Pope explained: "We are ashamed of the abuses committed by holy ministers, who should be the most trustworthy.

"Let me say quite clearly that sexual abuse is a horrible sin, completely opposite and in contradiction to what Christ and the Church teach us."

The papal safeguarding commission is meeting in Rome for its bi-annual general gathering.

The commission will assess recommendations for improved protection of children and vulnerable adults within the Church, and care for people who have been abused.

These will then be submitted to the Pope for his approval.

Pope Francis has so far accepted all the group's recommendations.

Earlier this year the commission suffered a blow when Marie Collins, a sexual abuse survivor from Ireland, resigned over internal resistance to the group's work by the CDF.

Ms Collins has continued to offer her advice to the Church and was in Rome earlier this month to address a group of recently ordained bishops at a Vatican organised conference.

The abuse scandal has dogged the Church for years.

Iceland’s justice system has received praise in recent years for its successful prosecution of multiple bankers who helped bring on the 2008 financial crisis. Though some of those bankers have been released early from prison, the latest controversy in the country stems from an entirely different miscarriage of justice.

Last week, it emerged that Prime Minister Bjarni Benediktsson knew of attempts by his father, Benedikt Sveinsson, to have the Ministry of Justice grant “restored honor” to a convicted child rapist.

Benediktsson kept this secret as the rapist, a friend of his father’s was essentially exonerated.

Restored honor is the controversial process by which convicted criminals can have their crimes expunged and return to society with all rights and privileges restored. It requires that the convicted person serve between two to five years of their sentence on their best behavior and that they have multiple letters of recommendation. Sveinsson provided one such letter.

The Reykjavik Grapevine, an English-language Icelandic outlet, reported on the recent case of “restored honor” on Thursday:

This information was kept hidden from the general public, despite repeated requests from the media, until a parliamentary committee ruled that the Ministry of Justice was legally obliged to disclose this information. The Prime Minister was aware of his father’s actions since at least last July, but said nothing.

In 2004, Hjalti Sigurjón Hauksson was convicted of raping his step-daughter almost daily for twelve years from the time she was five years old.Citing Stundin, another Icelandic outlet, the Grapevine summarized that Hauksson was granted restored honor last August.

The Ministry of Justice initially refused to disclose who had provided the letter of recommendation for the convicted rapist, but after a parliamentary committee pushed for full disclosure, the ministry revealed Sveinsson was responsible. However, after news of the secretive arrangement emerged last week, the prime minister’s father claimed Hauksson had penned the letter and asked him to sign it, also asserting he believes Hauksson is sorry for his crimes.

Hauksson’s victim called the decision to restore his honor “surreal.”


Exacerbating the controversy is the fact that Prime Minister Benediktsson reportedly knew about the letter to restore the rapist’s honor as far back as July of last year and said nothing. Further, the prime minister and the minister of justice, Sigríður Andersen, are members of the same political party — the Independence Party.

This scandal has reportedly brought down the government.

The Guardian noted that

The Bright Future party said on its Facebook page that it had ‘decided to terminate cooperation with the government,’ effectively bringing down Bjarni Benediktsson’s administration barely nine months after it was formed.”

The Bright Future Party is one of three main parties, and their decision to break with the government will usher in the second “snap election” in a year. The Reform Party, the third major party, has also withdrawn support for the government, advocating a new vote.

According to the Grapevine, the incident has outraged not just the major political parties, but smaller ones, as well as the Icelandic public:

The Icelandic public has been in an uproar over the matter, and the opposition parties are gearing up to push back. Pirate Party MP Gunnar Hrafn Jónsson spoke with Grapevine on the matter, saying, ‘The opposition, and certainly the Pirate Party, will take this matter forward with great urgency. The nation is outraged and demands it.’

This is not the first time a rapist has been granted restored honor in Iceland, and it aligns with similar instances in other countries where pedophiles have evaded accountability for their abuses with the help of people in power.

Many non-Americans (and a lot of Americans, too) are flummoxed by the US policy whereby convicted felons in some states lose the right to vote, sometimes in perpetuity. To many, it is entirely unfair to disenfranchise someone who has paid their debt to society. In Iceland, everyone can vote, no matter what kind of crime they committed. In fact, Iceland takes things a step further with a little thing called “uppreist æru.” Roughly translated as “restored honour,” it’s a controversial legal procedure whereby, no matter how badly you screwed up or what kind of crime you committed, you can have your reputation wiped clean, in a civil sense, allowing you access not just to basic rights but extensive privileges.

How does it work?

If, for example, you want to run for office or be a lawyer, these professions require by law that you have a spotless reputation. But how can you have a spotless reputation if you’ve already spotted it yourself? Don’t worry; the legal procedure of restored honour can help pave the way. But it’s not simple.

First of all, two to five years needs to have passed since you finished serving your prison sentence. Article 85 of the General Penal Code also specifies that you need to provide “solid evidence” that you’ve been on your best behavior since then. This typically means witness testimony in the form of letters of recommendation from people who can vouch for your good character.

If these conditions are met, the matter is then submitted to the Ministry of the Interior for review. While technically it’s the President of Iceland who grants restored honour, all that is actually required of them is their signature; it’s the ministry that handles the case and decides whether or not to refer it to the President.

But how can you have a spotless reputation if you’ve already spotted it yourself? Don’t worry; the legal procedure of restored honour can help pave the way.

What kind of people get it?

Iceland is not a very punitive society. The maximum sentence anyone will ever serve for anything is eighteen years in prison, and in most circumstances, they’ll be up for parole after serving half or even a third of their sentence, if they’ve been on the best behaviour. Even then, maximum sentences are rare, and a stint in prison isn’t going to prevent you from going back to leading a productive life again upon release.

However, for those who want to pursue a career that legally requires a spotless record, restored honour is the way to go for them.

One of the more famous cases in recent history is that of Atli Helgason, a lawyer who was sentenced to sixteen years for manslaughter in 2001. He served ten years of that sentence, and in 2016 he was granted restored honour, because he wanted to be able to return to court in a professional capacity once again.

Another instance where restored honour was applied was in the case of Árni Johnsen, who was an MP for the Independence Party before doing time for theft. In 2006 he applied for restored honour so he could run for Parliament again. However, the President was abroad at the time, and so the matter was instead handled by then-Prime Minister Geir H. Haarde, then-Parliamentary President Sólveig Pétursdóttir and then-Supreme Court President Gunnlaugur Claessen. What raised eyebrows was the fact that Geir and Sólveig were both members of the
same party Árni belonged to. There was talk of special treatment, but ultimately, Árni ran for office, and won his seat.

Then, amazingly, things got worse

Both of these cases brought with them their share of controversy, but neither of them even come close to the case of Róbert Árni Hreiðarsson, who now goes by Robert Downey. In 2007, he was sentenced to three years in prison for having sexually abused at least four teenage girls. He recently sought to have his honour restored so he could practice law again, and this was granted.

This sparked a great deal of anger from the general public in general, not least of all when the Ministry of the Interior declined to disclose the names of those who had vouched for his character. The survivors of his abuse soon came forward, expressing their shock and sadness that Robert had his honour restored.

Privileges are by definition not granted, they are earned, and they can be denied or lost by bad behavior.

The details of Robert’s crimes were bad enough. What made matters much worse was Robert’s lawyer, former Supreme Court judge Jón Steinar Gunnlaugsson, who went on the offensive by publicly imploring Robert’s victims to forgive him, advising that they would “feel much better” if they did so. This prompted even more pushback against Robert.

One detail that continues to remain in all this is that Robert has never admitted to, let alone apologised for, the crimes for which he was convicted.

The matter reached a fever pitch when another woman soon came forward, also claiming abuse at Robert’s hands prior to his sentencing. She has pressed charges against him. Where things will go from here remains to be seen.

Why do we have this thing anyway?

The concept of restored honour rests upon those seeking it having repaid their debt to society and demonstrated that they are better people today. As defenders of restored honour will tell you, everyone deserves a chance to own up to their mistakes and get a fresh start in life.

However, Robert has been completely silent during this process, and has done nothing to demonstrate repentance. Indeed, his own lawyer implies it is in fact Robert’s survivors who are the real culprits here, as they continue to speak out against him. No matter how you look at it, Robert’s case certainly tests the limits of restored honour.

One thing, however, is clear: being a lawyer or a member of parliament isn’t a right; it’s a privilege. Privileges are by definition not granted, they are earned, and they can be denied or lost by bad behavior. While some felons in the US have been stripped of the fundamental democratic right to even vote, once-powerful Icelandic men are able to get their privileges back through this curious, and undoubtedly controversial, law on our books.

Sex offenders pardoned almost as often as other criminals

Nearly all the sex offenders who apply for pardons in Canada successfully wipe out their criminal records from public view, despite the Conservative government's promise four years ago to make the system tougher.

Over the last two years, 1,554 sex offenders applied for a pardon with the National Parole Board; only 41 of them were rejected, leaving 1,513 without a trace of a criminal record, unless they apply to work with children or vulnerable individuals.

The new numbers from the National Parole Board show that the 2.6-per-cent rejection rate for sex offenders is only slightly higher than the overall rate of failed applications for convicted criminals, at 1.5 per cent over the last two years.

The high pardon rate for sex offenders is surprising, given that the Harper government promised to change the rules long before the Easter weekend revelation that hockey coach and sexual predator Graham James had been pardoned in 2007.

A fact sheet from the National Parole Board

In 2006, after The Globe and Mail revealed that retired teacher Clark Noble secured a pardon for a 1998 sexual-assault conviction, then-public safety minister Stockwell Day called for tougher rules as part of a review of the pardon system.

"We want to ensure that unwarranted pardons are not granted to violent or sexual offenders," he said in a statement.

Following up on Mr. Day's request, the National Parole Board enacted new measures in 2007, calling on two board members, instead of one, to approve or reject requests from sex offenders. In addition, the board decided to undertake "more rigorous" consultations with police in the cases of sex offenders, to "determine if there is any recent and relevant information available."

But in a statement on Thursday, the government said Mr. James's pardon, although approved under the old rules in early 2007, demonstrates the need for further changes.

"In 2006, Minister Day discovered inadequacies and moved to address them, based on what was then known. The pardon of Graham James has illustrated that more must be done to safeguard the public and the integrity of the system itself," said Chris McCluskey, a spokesman for Public Safety Minister Vic Toews.

In particular, the government sees a need to change the Criminal Records Act, which doesn't call on the National Parole Board to differentiate among criminal offences or take account of the serial nature of some crimes.

The number of criminals receiving pardons has increased over the past decade as more employers conduct criminal background checks. Companies offer services to help get the records expunged for $400 to $600.

A pardon means that someone's criminal record is no longer public and will be kept separately from the records of non-pardoned individuals. However, the records can be disclosed if a pardoned sex offender applies to work in "positions of trust with children and other vulnerable persons."

An expert in sexual abuse and pedophilia said it is essential to have an alert in police databases when a sex offender seeks a job working with children. Benoît Dassylva, a psychiatrist who has diagnosed and treated hundreds of sex offenders at the Philippe-Pinel Institute in Montreal, said that the clear majority of pedophiles do not recommit crimes, but that, like alcoholics, they have different levels of vulnerability in certain situations.

Liberal MP Mark Holland thinks this week's display of outrage display of outrage from Prime Minister Stephen Harper and his government over Mr. James's pardon was just for show, given that the government approved the National Parole Board's reforms three years ago.

"They had every opportunity in 2007 to make additional changes," said Mr. Holland, the Official Opposition critic for public safety. "They are trying to seize on a sensational case and turn it to their political advantage."

Mr. Dassylva said 85 per cent of cases of sexual abuse of children are committed by friends and family members of the victims, and that toughening up the pardon system is not the only solution.

"For the population," he said, "it's easy to believe that the danger is a pedophile with a criminal record lurking in a park, when the real danger is someone we've known for two or three years."
