Two people have been sentenced to death by a Malindi court for violently robbing a fisherman of a packet of cigarettes and Sh40.
Malindi Principal Magistrate Dominica Nyambu sentenced Haidari Ahmed Shaibu and Ali Kassim to death after they were found guilty of the offence.
They were charged that on the night of February 24, last year, at Buntwani beach in Malindi District, jointly with two others not before the court, they violently robbed Hussein Bahhassan of one packet of Safari Blue cigarettes and Sh40.
Chief Inspector Dennis Onyango, who was representing the State counsel, informed the court the suspects accosted and attacked Bahhassan at the beach on his way to fish. Mr Onyango said the four-demanded money from the victim.Bahhassan told them he only had Sh40. This annoyed them and one of the accused cut him on the palm of his hand and below the check with a machete.
Land dispute
The complainant, who sustained a fracture and a deep cut, engaged the four in a tussle before he escaped to the roadside where he fell unconscious. A Good Samaritan took him to Malindi District Hospital, where he was admitted and discharged three days later.He reported the incident to police leading to the arrest of the two.
While passing judgement, the magistrate said she had carefully considered the evidence adduced by the complainant, especially that he knew the accused persons before and the medical evidence before the court.
"I have no doubt the accused persons are guilty and I convict them to death in accordance to the law," the magistrate ruled.
