First and foremost, the position of our laws is inheritance matters are civil matters, and saying so the police has no role into it

So the way the police got themselves into this civil matter raised our eyebrows

After meeting the stringent criteria of the matters worthy our consideration we are now in a position to dig out the facts as the laws direct us

Once, there is a deceased who has left behind inheritance whoever considers himself an interested party may seek primary court orders to be the executor or the administrator of the estate of the deceased

He may prepare an itemised list of the properties, cash which the court will attach in the order

Parties interested in the matter may lodge dispute in the same primary Court challenging the validity and locus standi of the plaintiffs seeking orders of the estate administration

Allegations of fraud, forgeries of wills, biological evidence of DNA etc ought to be ordered to be collected, assessed and decided in a primary court vested with geographical jurisdiction

If you read the matter covered in Mwananchi above the law as discussed above was not followed

First, there's no any Court order which has decided on issue of the DNA to establish whether the child in question was a biological offspring of the deceased

Second, the primary court is yet to establish claims of will, shares etc were fraudulently secured

Third, the primary court is yet to appoint the estate administrator

Fourth, since there's no legal administrator of the estate who can sue or be sued on behalf of the estate of the deceased the role of the police was illegally secured and very much premature
