Why Magufuli administration misses the point on Government splurge

What are the Covid-19 options? A myriad of options at their disposal...we will discuss a few and their ramifications..

FIRST OPTION. (WE HATE)

They can ignore CDM adverse ruling and keep on serving them by de facto means a courtesy of a very partisan House Speaker.. who has promised "kuwakingia kifua..."
We hate this because it will be a curtain call in the opposition political arena unless a permanent retirement after 2025 is preferred which we seriously doubt...and more gravely they will be at CCM "beck and call" and we can only imagine the sexual abuses patiently awaiting to torment them..in the next five years. With CCM there has never been a free brunch...

SECOND OPTION (HIGHLY RECOMMENDED)

They can rush to High Court on Monday and lodge a complaint laced with a court injunction to hold their dismissal in abeyance till their matter is resolved...nothing is more scrumptious than teaching your bosses a lifetime lesson in law and usher in some momentus precedent rulings which will stay being good law for a foreseeable future...

THE THIRD OPTION (WE DESPISE)

The third option is to test internal CDM remedies which will sadly not change the status quo ante..their goose is cooked already!

But since they were condemned unheard, High Court injunction is too attractive to ignore...it will be the sweetest revenge to these myopic politicians...teh teh teh!

While CDM may claim that they had given the Covid-19 their right to a hearing but the High Court will disregard their legal arguments because they never informed the Covid-19 that their pleas of postponement were rejected, and a new date of a hearing was set...before seizing of the main matter without the knowledge of the Covid-19..their right to know of the outcome of the preliminary proceedings before the principal hearing remain irreproachable!

Since CDM did not inform the Covid-19 that their plea of postponement was rejected and a new date of hearing was affixed then the latter had a legitimate expectation of getting a hearing on another date after being informed of time, venue and the agenda among other issues....

In fact, Covid-19 were not heard on their request for a hearing postponement and were embarrassed when they heard CDM CC refused to hear them on the preliminary objection on the matter of the suitability of the proposed date of hearing and went on to determine the main matter without their knowledge!

After this analysis we are now in a position to make a major projection

The Covid-19 will march to the High Court under mandamus orders seeking CDM CC decision to dismiss them be suspended indefinitely until their matter of being condemned unheard is canvassed, heard and finally disposed off

All options on the table

Such Court injunction will stay active in the next five years legitimizing their perk parliamentary representation without surrendering to CCM hegemonic duress...

What surprises us most is why did the CDM CC refused to hear them on their preliminary request of postponement

Without informing the Covid-19 that their preliminary request was rejected, setting and informing them of a new and a specific date of hearing, the venue and timeline of the main issue, therefore, the CDM CC lacked the jurisdiction to proceed with the main issue because the defendants were nursing legitimate expectations to be heard on a preliminary matter and that right to be informed on the outcome of their postponement request was taken away

After incurably mishandling the preliminary issue of postponement, CDM CC now cannot say internal remedial measures still work for a simple reason of an element of bias which offends the principles of natural justice...

We must add in passing that the whole regime of administrative justice in CDM fall short of accommodation of Appeal machinery.

All disciplinary issues ought to be resolved by an independent committee from the CC as a first place of resolution but when the CC holds original jurisdiction of hearing and determination of disciplinary matters how can there be remedies of appeal after coming to terms with CC is the highest organ inside CDM..

Can the CC review or revise or hear appeals from its own decisions? In other words, can the CDM CC be a judge of its own cause by licking own vomit...

To us, those remedial avenues inside CDM are unworkable and gives the victims another reason to seek judicial interpretation of such wide, unchecked powers to determine disciplinary disputes

With the enviable and glittering arsenal of legal minds stocked in CDM CC we keep wondering why they have taken off the hook the Covid-19 where patience was all was needed..nobody can be punished twice for the same offence, needs no a screamer...

Some of the lame excuses advanced by Mbowe were and are still very laughable...you cannot talk of the merits of the main hearing without a determination of the preliminary request of postponement which goes to the root of the matter and informing the victims before further steps are taken detrimental to the welfare of the accused..

It's akin of placing a cart before a horse and insist the journey is too important to be delayed but how do the cart take you wherever you want to go unless the horses are in front pulling the cart?

We are beginning to see why God refused to hand power to CDM because they are simply not ready

If they cannot put own house in order how can they put the whole nation in order?

Charity ALWAYS begins at home if you cannot extinguish fires in own home who will trust you putting away fires in the whole nation?

If CC CDM is too impatient to wait for just a week will they ever have the demeanour, the composure and the gravitas needed to lead this great nation to the Promised Land?

From what we have seen so far we strongly feel unless they get rid of Mbowe once and for all, CDM will always be CCM tail exercising poor judgment day in day out..

Disco joker has clearly exhausted his template it is time to pass the baton to a younger generation full of vigour and the patience needed which Mbowe and his coterie seriously lack...

Mbowe had averred the main matter was preponderance but was it weightier than the constitutional right to be heard on preliminary issue of agreement on the date of a hearing and letting the decision to that request be known to the aggrieved parties before seizing the jurisdiction of hearing and determining the principal matter?

We had already projected Mbowe is the linchpin of the Covid-19 and the postponement letters were written to throw a spanner in the works... now CDM CC either out of sheer ignorance of the law or part of a careful orchestrated stratagem to rescue the victims somehow Covid-19 will never be dislodged from CDM over these incurably vitiated proceedings

We recommend the two warring sides to sit down and find a common ground as we see in unity they are strong but in disunity they are weak..in contemplation, we see no ouster reason based on the tenets advanced of "principles:...

Principled men are patient and attentive to detail...they are not driven by misplaced anger or vendetta..or frustrations of a stolen elections or even its brutal aftermath...to them the building the future overrides the murky past..

Had CCM spared Tundu Lissu from massive rigging will CDM not accepted the results after knowing the Treasury strings will be controlled by them?
