Why Magufuli administration misses the point on Government splurge

True from the last stolen elections we know the constitution also needs to revoke presidential powers to arbitrarily appoint the chairman, commissioners and the executive director of the NEC

The president is not the only stakeholder in our elections

So wielding such unchecked appointment powers are subject to abuse as we have seen this NEC was 100% a CCM affair

So we need constitutional reforms because what we have now is a very partisan president who has no regard to electoral justice and there are no guarantees in future we will not have another such a polarising figure in our political history

We need all elections stakeholders to have powers of appointment of NEC commissioners

We need the constitution to revoke judicial representation in administrative management of elections because they exploit such an opportunity to advance personal yet parochial interests

Judicial representation in executive dockets has become a backdoor to corrupt the judiciary by the executive

So we need the doctrine of separation of powers in order to work to expand beyond institutions of governance and include individuals

Because our political system of governance is extremely corrupt we have a reason to keep judges afar from executive positions whether still active or in retirement

Our experience has shown independence of the judiciary is incurably compromised no sooner judges know by delivering executive friendly decisions will be rewarded by the executive through appointments in executive dockets such as chairman of NEC or human rights commission or political parties commission or any other plum executive jobs

Our experience lead us to believe very corrupt judges are the ones who get favours of executive appointments so they can inflict more injustices against God

This is why all Commissions run by judges do not work to advance the cause of justice but perpetuate injustices

Even the law reform commission is useless because it never recommends constitutional and law reforms to reduce injustices

Most righteous judges are never patted in the back with executive positions so unless we bar judges from holding executive posts we will be condoning executive "carrot and stick" which has been used effectively to perpetuate injustices in courtrooms

So, we need 8 commissioners four appointed by opposition political parties and four commissioners appointed by the ruling party regardless of the composition of Parliament

The chairperson of NEC ought to be a lawyer directly elected by the TLS annual General meeting to serve for one five year term. No future president should appoint anybody in the NEC

Commissioners can serve a maximum of ten years each term of five year
So two term limit should be imposed on commissioners

No age limit imposed on the chairperson and commissioners but NEC secretariat age limit must be sixty years. Nobody should serve on the NEC secretariat if he is over sixty years.

And, the executive director of NEC too can serve a maximum of two terms each of five years meaning NEC must advertise that post every five year circle and fill it but the incumbent subject to performance can get a renewal only once

The opposition will use their general meeting for each political party to recommend one name to be considered as NEC commissioners

Once each registered political party has recommended a name of potential NEC commissioner then members of the executive councils of all opposition political parties regardless of their parliamentary clout will convene a special meeting to vote openly for those who should represent them in the NEC as commissioners

The first four to receive most votes will be the opposition eyes in the NEC
